So for libel, can both the author and the publisher be sued by the defamed person at the same time?
Insolvency doesnt just happen.. theres a great deal of thought that goes into creating unicorns and gazelles.

No. The term 'without prejudice' indicates an offer of settlement is being made (in respect of a dispute) but with a view to settlement and it not being permitted to refer to the offer in court if it is not accepted, so the offer is 'without prejudice' to that person's right to pursue (or defend) the claim.
