    I'm not sure which is more exaggerated....the plaintiff's claim that a range of subsequent childhood illnesses were attributable to the sticker, or some of the moms in the comments pretending that they *NEVER* take their eyes off their toddler. I expect no more, nor less, diligence from a childcare provider than I apply to myself - kids will get into stuff and the defendant was 100% on top of the incident.

    I understand the sentiment but just like you are responsible for any liabilities that may occur on your watch, the daycare provider should be responsible for anything that happens on her watch. The judge made a wise decision.

    These babies are swift so even thou you are watching them they still stuff things in their mouths- I have a toddler and he always put things in his mouth - I just was more cautious on what is around him and reachable that he don’t do it

    I worked in daycare for 15 years. We had several kids come through who were like little chipmunks, every time you turned your head they would store something in their cheeks. You had to watch them like hawks. My guess it this is not the last time this kid stuffs his cheeks full of junk.

    My guess is that this wont be the last time the day care neglects to watch a kid as it puts a foreign object in their mouth. Pray next time it doesnt result in choking or death

    Craziness. I used to work at a preschool and we had a parent come storming in and going crazy and yelling and threatening lawsuits because a student fell and scraped his knee on the playground. Like what are we supposed to do? Cover the kid in bubble wrap every time?!

    @Shhhh You’re absolutely correct. Several well known sociologists say that’s the reason why there’s so much of this hyper-sensitive, snowflake, cancel culture nonsense now. They refer to those kinds of parents as bulldozer parents, because they try to bulldoze every obstacle and difficulty out of their children’s paths. The problem is when those kids get to be young adults, they can’t handle anything that doesn’t go their way and seem to believe that the rest of the world needs to cater to their needs.

    @MizzLizzyLiz - Yeah and if you did cover the kid in bubble wrap then the parents would sue you claiming that the plastic you put on them cause them to sweat and become dehydrated. There’s no way to win when dealing with people that are completely unreasonable.

    I don’t think they went all the way to court for just $200.00. I think plaintiff wanted way more. She was trying to get bills paid for a couple of infections and a week long hospital stay.

    I agree with the judge. The defendant seems like she is absolutely professional and has assistants to help her. I feel that often parents will put the blame on daycares unnecessarily

    ​@@dn2ojpretty sure it was all the other visits to hospital for unrelated crap she was trying to say was a result of the sticker that she kept trying to bill the childcare provider for that made her decide she wasn't gonna pay anything, she probably told her okay take this to small claims court and they'll tell you what I'm responsible for and what I'm not. The £200 makes sense, the rest is really grasping at straws

    Words like "back" are very subjective in nature. She could have meant close to the soft palate which is on the roof of the mouth and very close to the throat.

    I really appreciate the sensible and reasonable comments from people who understand how difficult it is for childcare educators to be constantly monitoring children's every move, every second of the day. It is not possible. Also some parents seem to have this unrealistic expectation that educators are only taking care of their child. I love judge judy's common sense and compassion for the defendant.

    Yea like seriously. Kids get into things at home too (per her other child having stitches) it happens.. she didn’t stop working when the kid got stitches 😂 or take them out a school… I agree with the judgement but jeez.

    And I wonder, if she wouldve done it as soon as it happened, if the "skin wouldnt have torn off," ( if it tore at all)? You know, like, if it was only stuck to his mouth's roof for 5 minutes, maybe it would have came off easier bc it wouldnt have been stuck on for so long, with his tongue probably pushing it on harder constantly on a whole trip to the hospital that who knows how long it took. (Ok, I kno my wording is all messed up but I think it's still easy to follow lol)

    Although that's normal, freakish things can happen out of your control. A freind of mine had given her toddler one of those little boxes of raisens. She heard him crunching and she thought, raisens don't crunch. Took the box from him and there were little tiny pieces of metal in the pack! They whisked him off to the ER and sure enough, an xray showed them inside him. She never sued the raisen people. He's fine and eventually passed them, but can you imagine?! People have to be so careful with children.

    It sounded like the plaintiff was suing for other hospital visits like the fever and the later one in December. If the defendant had paid the initial $200, they'd probably still be there for the other bills.

    Pre-pandemic, I was teaching "mommy and me" toddler classes. There was me, 2 assistants, and then a parent with every child. We still had issues with kids shoving things in their mouths! We had one little girl who even her mom joked about getting the girl handcuffs - literally EVERYTHING she touched went straight to her mouth, even other kids' snacks! Every adult in the room was trying to keep an eye or hand on her, but she still managed to eat from the sensory bit, lick paint or glitter, anything! Her mom said she was just glad that the girl had no allergies, but man, she had some colorful poops sometimes! Fyi, the mama said glitter passes right through and truly makes sparkly poop.

    I was a nanny for many years. Still in contact, and on good terms, with all of the families I helped raise their children. Nearly all of the babies put stuff in the mouths. Offcourse you keep them away from the dangerous ones. But to think you can take care of a baby and them not try and do this, silly. I remember one ate glitter at arts and craft. Not intended offcourse. We did look forward to glittery poop, but were sadly disappointed 😁😂😂😂😂

    @sprinkles but both Daycare and Mom testified to staff and Mom trying to retrieve the caught item. Then the open wound due to the removal of it. Which was in the report. Cause and reaction. I just felt JJ could've went about that one aspect differently. Other than that, just never send another child to them.. 😫

    In court, it's about what you can prove. Correlation does not imply causation. If she had some kind of report or expert testimony to back her claims, them she would have proven her case and been awarded more money. Children at that age put everything in their mouth and even parents are not able to keep an eye on them 100% of the time to prevent that.

    @@brittbritt3196 Could have *gone Stomach infection doesn't happen from an open wound. Something has to be swallowed, and children stick their unwashed hands in their mouths all the time. Which is why there's insufficient proof that the illnesses were caused by this. We also don't know if they were wearing gloves when they tried retrieving the sticker from his mouth. They were all trained in first aid and licensed.

    It's a shame that the plaintiff didn't ask someone to give a medical opinion to present to the court (as an expert witness), because I work in the ER and I absolutely believe that the wound got infected and caused a fever. It's not a rare occurrence. It's a stretch to link it to abdominal problems months later, but a fever within a few days? Absolutely - especially when multiple people had their unwashed hands in his mouth and he clearly wasn't being watched properly, resulting in multiple foreign bodies and a laceration (the mother fished two other foreign bodies out, then the hospital got the sticker).

I n my Mrs have 5 kids, 12 grandchildren n as of Ground Hogs day Now 4 Great grandchildren. The Mrs is a retired R.N n eldest grandson a physician. I turned to the Mrs here. As shes a Die hard JJ fan too. Since JJ came on air. Mentioned your thought. She said The Lady is wrong. On germs, infections, exposure, virology, etc. (But she recommended I say this politely,lol.     @@damftrophydoe Honey if your child gets through childhood without having to visit an ER, you are doing well. That comes with the territory. Kids are curious, you cannot realistically keep your eyeballs on them every second of every minute of the day. We do our best to keep them safe at all times, but kids get into things they shouldn't all the time. And removing skin was a medical staff issue. I wouldn't need to take my child to an ER for that, i would have them drink something, get the sticker wet and remove it myself. I mean sweet Jesus i have to ask if some people are actually equipped to be parents if they cannot remove a sticker from a childs mouth, ridiculous.

    $200 is a week's worth of food for that family. Daycares carry liability insurance for a reason. This wasn't the mom's fault and she was entitled to reimbursement.

    I have worked with children under the age of 5 for over 30 years . Children are always sticking things in their mouths . Does not mean there not being watched . Things happen at home also .

    I'm suprised they didn't talk about the waivers you have to sign when you enter your child in the day care, saying you won t sue them for this or that. So, it really doesn't mean anything to sign that. That's good to know. Also, 3 adults for 7 children seems pretty responsible for me.

    My take; Mom wanted to be home from the start. Husband said no way. Thats why she had to follow thru in suing to prove to her husband the child would be best take care of by Mom staying home to care for him. Because WHY would anyone want to waste the time and energy going to court for this? JMO

Her sueing for the fever and so on is more of a case that she's unable to prove it's the sticker that caused the fever and not something else. Hardly easy payday since all she is sueing for is to have her money refunded. She isn't a penny richer after this trial.

    @@acousticshadow4032 I was, and I hated the fact that she was trying to say nothing happen to the plaintiff other 2 kids while under the defendant's care, so she should brush what happened aside. Which is so wrong. The defendant is being paid to watch the baby. If something happens under her care, the right thing to do is cover the expenses. Why should the plaintiff do it?, when it didn't happen under her care?

    P said back of child’s throat, but med report says roof of mouth like D stated….I understand and agree with mother’s concern, but acknowledge that this really could’ve happened on her watch. Glad she was reimbursed. Perhaps D refused because P was accusing her of neglect and also because she really probably could’ve gotten it out herself. They were both civil and calm.

    The plaintiff made a mountain from a mole hill. The baby put a sticker on his mouth and it stuck. It probably could have been removed without going to ER. The defendant should have offered to send the baby to a primary care doctor who could have easily addressed the situation. She was being excessive suing for inflated "damages".

    They tried to get the sticker out. They had the baby held down in the drive way while the defendant and her staff tried to get it out. That sticker was likely stuck for a while. They probably really weren’t watching the baby.

    Probably a bad example for a parent like me. Prior to my experience I would have lost it however this exact thing happened to myself and my husband. My husband was changing our 10 month olds diaper. He removed the sticker from the wipes. My son as quick as he could throw out the diaper, popped it in his mouth. Because it's flat he was gaging but breathing. We didn't know what it was. The Dr were so nice, and understanding but it scared the hell out of us.

    I work at a preschool in the toddler room. It's very common to go "What's in your mouth?" and have to remove something, or have the child spit it out and hand it to you.

The baby suffered a very small injury to the roof of the mouth, which shows it was best a doctor removed the sticker just in case. Imagine if you dropped the sticker in their throat as you removed it, I wouldn't want to be liable for that, would you? If you are a childcare business and something like this happens you are liable to an extent. It doesn't make them a bad daycare it's just kids do this kind of stuff and that's why they have insurance. $5,000 was ridiculous though, everyone in the US wants to sue for hurt feelings and suffering etc... I see it all the time on this show and thankfully JJ doesn't tolerate it.

If they had a major amount of liability Judy would have said so. She gave her the deductible but me personally would have just paid it. That’s my opinion, I wouldn’t have sued the daycare for that.

    A sticker? She was charged 200 purely for going to a and e and using a doctors time. I LOVE how she painted it by saying a “PAEDIATRICIAN SPECIALIST” when JJ asked what they did for him at the hospital, as though it was that severe they needed a specialist! But that’s literally just the name of the doctors that deal with children lol also how she kept being ambiguous when JJ asked how they got it out. Yes, they pulled it out… because it was a sticker on the roof of his mouth. Something she could have done herself instead of wasting A&E’s time for a STICKER!!

    Yes, a sticker!!! A sticker that could have easily become dislodged and blocked the child's airway while they were holding him down trying to remove it. If you want to experiment with your own child please feel free to do so but you don't get to decide what is best for someone else's child. A broken fingernail is no big deal... A sticker stuck in a infants mouth could easily become a life or death situation IF he started choking on it. It sounds like mom wanted him in good hands with trained professionals and the proper equipment in case shit hell the fan and I certainly don't blame her for that. The defendant should have had the stickers out of reach of the infant.

    Exact thing happened to my baby with a window sticker, but my baby is a chipmunk even with eyes on her she’ll shove anything in it and even if you think you’re fast, toddlers are faster. My sitter not only got the sticker out fine (that was also on the roof of her mouth), she immediately took down all the window stickers and let me know from start to finish what happened. I know for a fact as well if my sitter wasn’t as fast as she was she WOULD have to pin her down gently to get the sticker out because they’re also little wrestlers and hate laying down 🤷🏻‍♀️ putting random things in their mouths is just what babies do. I think this lady just wanted her bills covered

    He's telling the truth. I'm 4'10" and I used to be a fire cracker; learned from my mom who chose a abusive relationship instead of her and children's safety. I was conditioned to be mean. Punching, biting, pulling knives, throwing hot grease until that one fateful day when he had enough. 5 years later, we keep our hands to ourselves and our communication is immaculate! I realized I was the problem and when i started purposefully being a better person, everything started to fall in line automatically!

    This is 3rd child?? How is she acting like it’s her first??! My then 2 year old thought everything was fair game for his mouth. I would run over. Pin him down to get a waded torn post it note from his mouth. Did it hurt him? No. Did he cry? Yes. Probably because he wanted to eat paper! The time it would take for me to buckle him in a car seat, I could’ve had removed it, given him hugs, gave him juice & lots of kisses, removed the objects higher & away. She saw an opportunity to get money. There’s no reason to take a child to the ER over a sticker.

    Yes but why is she taking her kid to the ER for a sticker on the roof of their mouth? She’s incapable of removing it at home? The only major risk factor with that sticker is it the kid chokes on it. Maybe she used a different type of bubble stickers but I’ve used bubble stickers many times and they don’t stick very well. I have a hard time believing it got stuck enough to remove skin, since babies drool so much. Sticker removal was not worth 5k.

    I do think that when you have younger children some activities shouldn’t be available to them yet. Like arts and crafts is fine but not with items easy and small enough to put in your babies mouth. However this does happen and could happen again. There should be a seperate area for babies so they only have bigger toys they can’t choke on.

    He wasn't doing arts and crafts the other kids was. They should have had him somewhere else though seeing as he was just starting to grab onto tables and hold his self up.

    At first I thought the Plaintiff was being greedy. However, it is good she went to the er because, if she is telling the truth, the skin from the roof of the mouth came off with the sticker. She also took out a piece of comb and wood prior to going to the er. Don't they always say, go to an er because the item can be pushed down the throat, especially with a squirming, crying toddler? I feel for both sides, but also sounds as if the toddler had a rough time after as well.

    Why's everyone hating on the mother? She isn't asking some exorbitant amount of money, just what she's out of pocket. She obviously had already asked for it from the daycare and got a lawyer letter in return. Nothing wrong with what she's doing here. Accidents happen, sure. But she shouldn't be out of pocket 200 bucks for what happened at daycare.

    I believe the plaintiff had the right to sue. At the end of the day, she put the child in a daycare to prevent stuff like what happened to her son. Also I think there is a reason she said throat and the report said roof of the mouth. It was probably lodged on the soft palate which explains why the sticker could have ripped out the sensitive skin. Edit: Ideally, the workers are supposed to watch the babies at all times but that is not reasonable. However, one should expect that the baby should be watched most of the time. I believe that it was an accident and that there was probably very little to do in that time frame but she's still responsible in my opinion. It isn't the mother. The mother did the right thing. It isn't the child. The child doesn't know better. It is the person watching the child. All I am saying is that the defendant take responsibility for the outcome as scenerios like these are why she was paid in the first place.

    @@dejha.daniel You know what, fair enough. But it would be my responsibility to fix if that happened to my child on my watch. Also, you're right that I don't have any kids but aren't guardians supposed to be watching the kids at all times? That includes helping the kids with the crafts. Your rebuttal is like claiming that a babysitter shouldn't be responsible if a toddler touches a hot stove because toddlers touch everything. Edit: When I say "at all times", I mean most of the time. Like 99% of the time.

    @@thesecondderivative8967 No parent, no guardian, no care giver can watch a kid 24/7. Your analogy with the stove does not apply to this situation as that would be gross negligence(in the legal sense) and not just a matter of an accident. Kids are sneaky little buggers and some have super powers. The day care is paying the $200 for the ER so the mother has been made whole in that regard. Plaintiff did not have any documentation to show that subsequent illness was as a result of the sticker episode.
