So the ATF absolutely cannot raid my house and put me in jail for any reason, no matter what I have or what I'm doing with it, according to you? Or did you mean they SHOULDN'T have the authority and power? Because I'm pretty sure there are lots and lots and LOTS of people in jail because of the ATF, despite their supposed lack of authority and power. 'Does not' and 'Should not' are VERY different concepts.

The bottom line is that you are guilty until proven otherwise. That is a violation of your constitutional right to be presumed innocent until proven guilty.

If that were true then background checks for private transfers would be mandatory. It's actually illegal to sell to a prohibited person IF you have reason to believe they are a prohibited person. If you don't then it's actually not illegal to sell to them.

Why is it leftist care so much about Americans guns, but not about people that are non citizens crawling over our border & flying them into America dumping them on US citizens. US government don't care about fentanyl that kills many more than any Americans legal gunsl or cartels who are coming over border or cartels selling drugs in America or cartels in America trafficking humans?? All these things much more important than taking away US citizens guns rights & US constitution.

They TF cannot break the law. If it is not a written law passed by Congress and they cannot do these things. They do not have the authority to do so. It is unconstitutional for any law officer to apply their own rules to the constitution without it being a just law. Plus the government has no authority over the constitution and cannot abolish it under no circumstances because it does not belong to them it belongs to the people. They have no say so over the constitution and cannot get rid of it.

SCOTUS needs to Abolish “rule” making. It’s Absolutely unconstitutional for a government agency to make laws. Congress Also needs to stop these agencies from doing their job. But I highly doubt congress will pass a law that will stop the ATF from making laws. They can’t agree on Anything.

Doesn't the ATF (or maybe somebody else?) have to approve the FFL? So if too many people were getting them they would simply not approve them. BUT... you make an excellent point... maybe it's time to get a FFL...

A rule is not a law. Only laws can be enforced. Rules cannot be enforced or prosecuted!!!

This is why you can never give an inch. This is in direct violation of FOPA....Where is the oversight?

Leave things intentionally confusing so they can make it up as they go.

Sell cash only. The only way they would know is if it's a sting or if it is used in a crime. If it's a sting, you're screwed. If the weapon ends up being used in a crime, say it was lost or stolen recently. There is no legal obligation to report lost or stolen firearms. The tricky part is going to be lining up a buyer without creating an electronic communications paper trail that undermines your claim the firearm was lost or stolen, but you can always say you were GOING to sell it and then it was 'lost or stolen' (Be intentionally vague about this-- you most likely wouldn't know if it was lost OR stolen, and you don't want to answer questions like 'Why was the exact gun you were going to sell stolen and nothing else was?'). You can always delete the messages but you can't delete them from the buyer or your ISPs. Maybe even follow up your transaction with a message to the buyer that says something like 'Oh shoot, I can't find the gun I was going to sell you looks like the deal's off 😉😉😉'. That should be a reasonable doubt, I don't see how they could logically prove guilt in that case. Then insist on a jury trial in case you get a corrupt judge, and hope you get a sympathetic jury member. In my state, even though we have pretty decent gun laws otherwise, the state police do record firearms transfers, at least for handguns, so that's how they know where the gun is 'supposed to be'. Other thing you can try is say you sold it years ago, but again, there could be a message trail. Another thing you can do-- If you have a wife or adult children-- Claim they must have sold it, and have them claim you must have sold it. They can't charge all of you because someone must have done the crime.

This sounds like what Colorado did fairly recently. Every private sale requires a background check to be performed by an FFL before transfer. Not saying it's _right,_ mind you, just saying they did it. And encouraged by their success, they're aiming to do a lot more this year. Guess it's just too hard to go after the black market, so they're gonna go after the one with a paper trail instead. What a load of BS...

So if I "engage" in buying cars at a good price and fix them up a little and sell them for more than i paid for them am I now a "Car Dealer" and need to get a business license and follow those laws as well...instead of it just being a hobby to make a little money.

Regarding this James Madison in Federalist papers 78 paragraph 11 says... No legislative act contrary to the Constitution is valid.

Selling a handgun privately outside of your state already requires that firearm to go through an FFL. As long as your sale doesn't cross state lines then its outside of the federal governments authority to regulate under the Commerce Clause. I have sold firearms that I get tired of locally, every person I sold my property to went through a publicly available criminal history check.

This guy that heads the ATF must have been a hall monitor in high school. I am sick of these damaged people running things. Give them a job with some power and they justify their existence buy using ever changing rules to get even with folks who laughed at them. FFLs didn't exist in 1886. Gun control laws didn't exist before the year 1934.

What about their "livelihood" remark? If you sell one or two guns for ten or fifteen dollars profit each, that certainly isn't making a livelihood. The vagueness of the "could be a dealer" is the one I find most disturbing. If you build a collection, are you going to be told there's a limit you can own?

Any gun I sold was transferred to a qualified purchaser, age 18 or over, with a written bill of sale. No one got hurt. Let it be. ATF rules may fall deeply into the earth
