    What makes me see red is that criminals with guns who sell them to other criminals aren’t keeping records of these guns. People who do things legally aren’t the bad people. But the ATF is punishing the WRONG PEOPLE.

    Just say it. The GCA is not consistent with the text and/or historical tradition to keep and bear arms guaranteed by 2A. Keep and bear imply buy, sell, create, destroy, modify, borrow and lend.     If that were true then background checks for private transfers would be mandatory. It's actually illegal to sell to a prohibited person IF you have reason to believe they are a prohibited person. If you don't then it's actually not illegal to sell to them.

    They TF cannot break the law. If it is not a written law passed by Congress and they cannot do these things. They do not have the authority to do so. It is unconstitutional for any law officer to apply their own rules to the constitution without it being a just law. Plus the government has no authority over the constitution and cannot abolish it under no circumstances because it does not belong to them it belongs to the people. They have no say so over the constitution and cannot get rid of it.

    SCOTUS needs to Abolish “rule” making. It’s Absolutely unconstitutional for a government agency to make laws. Congress Also needs to stop these agencies from doing their job. But I highly doubt congress will pass a law that will stop the ATF from making laws. They can’t agree on Anything.

    Sell cash only. The only way they would know is if it's a sting or if it is used in a crime. If it's a sting, you're screwed. If the weapon ends up being used in a crime, say it was lost or stolen recently. There is no legal obligation to report lost or stolen firearms. The tricky part is going to be lining up a buyer without creating an electronic communications paper trail that undermines your claim the firearm was lost or stolen, but you can always say you were GOING to sell it and then it was 'lost or stolen' (Be intentionally vague about this-- you most likely wouldn't know if it was lost OR stolen, and you don't want to answer questions like 'Why was the exact gun you were going to sell stolen and nothing else was?'). You can always delete the messages but you can't delete them from the buyer or your ISPs. Maybe even follow up your transaction with a message to the buyer that says something like 'Oh shoot, I can't find the gun I was going to sell you looks like the deal's off 😉😉😉'. That should be a reasonable doubt, I don't see how they could logically prove guilt in that case. Then insist on a jury trial in case you get a corrupt judge, and hope you get a sympathetic jury member. In my state, even though we have pretty decent gun laws otherwise, the state police do record firearms transfers, at least for handguns, so that's how they know where the gun is 'supposed to be'. Other thing you can try is say you sold it years ago, but again, there could be a message trail. Another thing you can do-- If you have a wife or adult children-- Claim they must have sold it, and have them claim you must have sold it. They can't charge all of you because someone must have done the crime.

    This sounds like what Colorado did fairly recently. Every private sale requires a background check to be performed by an FFL before transfer. Not saying it's _right,_ mind you, just saying they did it. And encouraged by their success, they're aiming to do a lot more this year. Guess it's just too hard to go after the black market, so they're gonna go after the one with a paper trail instead. What a load of BS...

    Selling a handgun privately outside of your state already requires that firearm to go through an FFL. As long as your sale doesn't cross state lines then its outside of the federal governments authority to regulate under the Commerce Clause. I have sold firearms that I get tired of locally, every person I sold my property to went through a publicly available criminal history check.

    What about their "livelihood" remark? If you sell one or two guns for ten or fifteen dollars profit each, that certainly isn't making a livelihood. The vagueness of the "could be a dealer" is the one I find most disturbing. If you build a collection, are you going to be told there's a limit you can own?

    Any gun I sold was transferred to a qualified purchaser, age 18 or over, with a written bill of sale. No one got hurt. Let it be. ATF rules may fall deeply into the earth

    The government has no legal lawful constitutional authority or jurisdiction to pass or enforce any gun laws whatsoever under the Supremacy clause, article 4 section 2 paragraph 1, second amendment,9th amendment,10th amendment,14th amendment section 1.

    What Dose'nt the ATF UNDERSTAND SUPREME COURT BASICALLY TOLD THE ATF. THEY CANT MAKE RULES ON FIREARMS. ATF RULES ARE NOT LEGALLY INFORCEABLE.

    The timing of this is suspect considering the execution of the poor guy in Arkansas. Make some murky rule and deal out the punishment in the investigation, search warrant, and run up; then lose in court or drop the charges. The new method of crime and punishment in the US!
