They’re in the middle of a sub level super max prison attached to the GCPD with about two dozen guards armed with assault rifles, pistols and tasers ready to pacify them by any means necessary they can’t do anything without being lit up by cops or wailed on by the Batman so their only option is sit there and wait

Unfortunately that is a line Batman won't cross. He sees "mercy" like that as being no different than murder. However, as Bruce Wayne he will likely use the Wayne Foundation to find a treatment- both physically and mentally - for them.

The first malitia guy you catch with the Brocken arm you can attack just go up to him and press x for Xbox and square for PlayStation

Imagine completing all the side missions before the Militia attacks GCPD (which I assume some people did). Adds more tension and risk.

Imagine if gcpds power shut down and they all escaped, and because there’s no batman (or so we think anyway) there would be chaos amongst the streets, damn that sounds like a pretty good plot for a game

No. You don't unlock most of the side missions until after you release her, and even at that point the ones you have discovered will be locked until a certain point.
