I’m not going to go to court for this ! I don’t know if they can take my Ss they call over & over it was my card someone used it if I didn’t do anything about it bc it was a family member get I have 3000 although do have to accounts they said they will garnish, wages ! I don’t have much in my name

You guys are the BEST! Thank God I came across your KZread video! All other KZread videos I have been watching do not provide helpful advice for Seniors or for those on social security disability. I have talked to five lawyers and not one of them informed me that my widows social security benefits were protected, but only to file chapter 13 which is very expensive and I cannot afford to do that. I am a widow age 63. My only income is widows social security benefits. I am a homeowner and have equity. The state of Utah has a homestead but I believe it's only 20K-30K that is exempt, more than that it is not protected. I will be giving you a call ASAP and I will be informing my widows group platform about HELP Nonprofit Law Firm. It's unfortunate that many widow seniors are being tormented by credit card debt collectors and often are terrified what will happen to their income if sued. Thanks a mil! Unfortunately, in amerika, it's just all about scams and corruptions. When your debt is charged off, you owe nothing. Why? The lender already got its money back by deducting its loss from lts profit. Selling your debt to the bottom feeders is just a way for your lender to make extra money from the debt you do not owe. It's all just a scam and the people should put a stop to this.

In my 60s my spouse of over 35 years battle cancer for 5 years having to be on a speical liquid diet costing over 80 dollar a week plus travel medical supplies our credit cards run to the roof. In my State of South Carolina, if a senior owes money for medical bills or to a nursing home.....the creditors pounce as soon as you die. They attach liens on land, homes, or any real property that the deceased owns. If the children want to "keep the family farm" they have to pay off the medical bills before the probate court will allow any property be transferred to the survivors.

What about employment garnishment for hospital bills

Thank you both for helping seniors. Some seniors are loosing there homes nationwide due to the Hoa's with out being able to afford an attorney or to defend the Default Forclosures Judgements. Are there any laws on a senior who was in her final two years in a senior center who could not appear in court, the court awarded the default judgement to the Hoa. After she passed, daughter was served who did not appear in court, Forclosure Judgement was awarded and lien on property of deceased that has complicated Probate and handling the estate. So many seniors need help especially financially. Thank you again fir helping seniors.

NOONE, I repeat NOONE should EVER get involved with an HOA. Why on earth would ANYONE want to pay hundreds of thousands of dollars or more for SOMEONE ELSE to tell you how you can live in or what you can do with YOUR own property? WHYYYYYY??? Why would you do that to yourself. You pay all that money and are told how you can live in it and what you can do with it. If you get sued over something then I say that's your own stupid fault for buying there. I have no sympathy for anyone like that. None.

My mom is being sued and on social security. She can no longer work and on oxygen 24/7. She has her account where the ss is deposited and instantly used for bills. However, her and I have a joint one, since we live together, and she helps pays the bills while I work my small business. My paycheck is direct deposited in the account. Can they garnish my wages since she is on it? We are filing just a basic answer letter directly to the court tomorrow but it probably will proceed further. Also, both our names are on our house. Is there any threat to our funds and if so, what should I do? We barely live paycheck to paycheck and I work my tail off to do it. Tia!!!

Listen to the video beginning at 9:00 Bank and Credit Unions officers know nothing about these rules. But the department within the bank or credit union that handles garnishments understands the rules. Although after 40 years of dealing with Credit Unions, they would be more likely to make a mistake. But this law has been effective for nearly ten years so hopefully, they finally have learned, The branch manager or local employees however likely don't have a clue. Does FDPCA apply to automatic liens on homes from Hoa's? I read under the FDPCA because the HOA hired the Attorne I believe it said it makes them a creditor collecting a debt. A $6,000 bill in 2019 grew to the Hoa claiming $40,000 in Civil Court, because I did not respond to this case against my deceased Mothers Estate it then went to Sheriff's Sale $47,000. I took a BK the amount went to $66,000, then uou have to pay $1100.00 to the Trustee and the legal Attorney amount $400.00 per hour. Now it's probably going to be discharged, now what? The problem is some or most seniors can't afford an Attorney to fight the Hoa's. Since they put a lien on your home which is automatically on your loan documents they force Forclosure. Husband a 76 yr.old Injursd Vet, I'm disadled. We really need a pro bone FDPCA Attorney to help end this HOA Nightmare.

The FDCPA applies to debt collectors. However an HOA has a lien on the property for debt that is owed. So a bankruptcy doesn't solve the problem if the intent is to keep the property. Eric HELPS

Hi there we live in Texas and lost everything in hurricane Harvey like thousands of others We had to stay with my sister in law went pretty good Our 29yr old son got a job about 8 months after that he started showing bizarre paranoid behavior I'm his mom and I begged him to let me take him somewhere for help. He kept refusing so he jumped off a bridge and broke his back and had his left ankle reconstructed so he was released from the hospital a mental health hospital The place were living was alright. His Dad and I needed more room for the 3 of us and they're telling us we owe $1400 because we only lived there 11months Is this legal? We're both elderly 72 68.

I have a tv trailer an no longer use it can the credit union put a lean against my house , I want to give the home to my son when I pass, but will the credit union put a lean on it an make my son pay for it, I’m 77 years old, my wife an I were going to travel but she passed away , now the trailer cost me 680 dollars a month plus insurance , what do I do?

I only saw the beginning of the video, so my comment may be way off. But the same applies to EVERYONE, not just seniors. If you are not disputing the debt then not showing up means the court decision goes against you by default! It’s not a criminal matter.

There's no minimum age, but some issues and protections only affect people collecting Social Security (62+) or those on Medicare (65+). But some of our senior discounts apply to people in their 50's!

Hi. Question for you regarding credit card debt suit. Being sued by junk debt collector for an old credit card debt. Never heard of them or to my knowledge been contacted by them before the summons. I plan to fight the suit by asking them to prove if they own the debt., etc. I am 61 and a half and am not employed (cancer related treatment earlier this year). My income depends on my husband who receives a military pension and social security which I understand is protected. Is this something I need to introduce to the court or let the lawyer for the debt collector know? Am representing myself at trial. Thanks!! Forgot to add, court date set for 1 December 2023.

Well you can represent yourself if you want. It is perfectly legal for a collector to sue for a debt they purchased from a third party. Bottom line you have no income and your husband is not responsible. Even if they get a judgment it is uncollectible. Eric HELPS

@@HELPSNonprofitLawFirm If you look at the public property records for Madison County Alabama, you will see where Redstone FCU had a Sherriff sale ordered on my home over $20K in crediit card debit. I had to pay them $80K to stop it because of interest and fees.

If you had a 20k credit card debt that now is 80k it tells me the judgment was pretty darn old. I would bet your home was free and clear. And you had a heck of a lot of equity., Right now 190k in equity in a home is protected from creditors in Alabama. I am 72 filed around 40k bankruptcies and help tens of thousands of seniors throughout the US. I have yet to see a credit card judgment file a writ of execution to take a home- 44 years mind you. I suspect there are some strange circumstances with you. Lightening does strike of course. However, it is not fair to attribute what happened to you to everyone else. Odds always need to be considered. I assume you don't worry about getting hit by a drunk driver when you drive to the store on Friday night. @@rnickel123

I just starting receiving bills from an insurance co that claims I took out a loan in 1979. No way. That's the yr I cancelled my policy because I took a state job that gave insurance fir free. Claim I owe over $40k now. Will go to my state insurance complaints bureau.

Your retirement income is protected you won't have to pay anything. I very much doubt they would push a lawsuit to get a judgment out of someone they would never collect from. You don't have to worry one bit. Eric HELPS

This happened to my parents and the insurance company went to court and had it thrown out because they’d already paid a large amount and the lady didn’t have a reason for the suit other then she wanted more money..they dropped it and told her to leave us alone…they even threatened my brother and I when we were minors …the lady and her husband did this all the time as a way to make money…insurance fraud by causing car accidents

Can they attach the debt to the house?

Almost every state has what are called homestead exemption laws that protect a varying amount of equity in a home. However, it is simply not the practice of consumer judgment creditors to attempt to go after a person's home for a number of reasons. I am being sued by PYOD Collection for $1500 of past due debt. Can PYOD take both of my vehicles in which I have about $2000 worth of equity? My sole income is Social Security with no other assets except for the equity in my vehicles. THANK YOU!

There are several videos HELPS has done with Senior Living that discusses why judgment collectors do not go after personal property such as cars. For one thing, almost every state has exemption laws that protect a certain amount of equity in a car. And for many other reasons, it just isn't done. Eric HELPS

Great question, Laura. It depends on the state you live in. In some states, once you hit a certain age, you may be eligible for a property tax exemption.

in my state we get things like property tax rebates, the creditor can take that if its in a bank account...there is a limit of $1000 in assets....if you have $1000 in garage sale items, legally they can clean out most of your home and have a garage sale......they can take YOUR CAR!!!!!!

@@HELPSNonprofitLawFirm thanks for proving you are abusive narcissistic bigots..if i lose my junker car, I die....that is nothing to worry about..sure...my judgement was ILLEGALLY entered because of bigoted lawyers and their staff who violate ADA....i disputed the debt, they did not respond. I asked the court for disability accommodations, they did the opposite the 1st time and ignored me after that. BY LAW, a court must grant the requested accommodation or explain why they can't or how an alternate is equally effective....IGNORING an ADA request or doing the opposite is ILLEGAL! but that is what the courts do.

@@HELPSNonprofitLawFirm no he doesn't, the staff discriminates against the disabled and blatantly violates ADA by refusing a simple readily available disability accommodation of using electronic communication instead of phone calls.

These laws are based on income such as Social Security, pension, and disability, regardless of a persons age

My credit union took 2200 out of my account.

I’m a Senior on Social Security. What if my daughter has a second credit card. Will the Collection Co. go after her for the debt . Thanks 12:16

If she is an authorize user and not a signer then no she is not liable for the debt. Although sometimes collectors will try to intimidate and authorized user into paying when they are not liable. Eric HELPS

While your home and certain income may, or may not, be protected if the plaintiff wins a default judgment can they not still have your property taken and sold? And don't such judgments last for 10 to 20 years? Much better to contact the debt holder in advance and try to work out a discounted settlement, no?

The video explains why losing property doesn't happen. And why seniors' income and property are protected. These videos discuss seniors' rights particularly applicable to lower-income and poor seniors. Seniors who have money normally wouldn't be expected to get in this position as they can work things out. Eric HELPS

@@HELPSNonprofitLawFirm I believe he said it's highly unusual for property to be taken, but it's highly unusual to actually be sued for a debt as well. Some debtors really want their money. I stand by my belief that it is better not to ignore a subpoena and most people would be better off trying to come to terms with their debtor and actually pay what they owe if they can.

​@@theoldgoat4525 Everyone has their own personal reasons for credit card debt. It's not easy to call the collection Attorney or original creditor and come to terms.. They usually don't take the offer, I tried almost two years ago to work with them. Then I called a Debt consolidation company to consolidate all my Debts and they were the ones who referred me to helps because they wanted 600.00 a month for me to send to them to pay my debts down. They knew I couldn't even afford the 600.00... I am great full that I was referred to HELPS almost 2 years ago. Like Eric said, it' doesn't happen that a Debt consolidation Co will tell you that you're money is protected. I was blessed with a gentlemen,the Manager of this Company to actually call me back after me speaking with another person about my situation..

I enrolled at Helps because this debt collector wants to garnish my wage , I work part time , now HR is taking money out of my part time wage is there a way out from this?

You can always call HELPS and go over this. Federal law protects $217.50 net in wages each week and many states have laws that protect more than this sum from garnishment or don't allow garnishment of wages.
