Can seniors avoid paying taxes? Of course, everyone should pay their taxes if they can. But for poor seniors, it isn't fair to ask them to pay tax bills instead of rent, food, or medicine. Not filing a tax return is a crime, but not paying your taxes owed isn't. Poor seniors struggling to make ends meet can be put on Currently Not Collectible status, which means that the Internal Revenue Service will not attempt to collect unpaid taxes from you. Sometimes, all you need to do is make a phone call. It can be complicated, but the HELPS Nonprofit Law Firm can help with the paperwork.
The IRS can take 15% of your Social Security benefits if you owe back taxes. But many of these people don't know that they can get on Currently Not Collectible status to stop the government from taking their Social Security benefits to pay taxes.

    This is a terrific channel with information for seniors! Thank you! Keep up the good work! I became disabled after my husband passed away and I owed taxes that he didn’t pay and also I owed Student Loans! The government forgave both the tax debt and the student loans after I filled out a form for the IRS that they shared with the Department of Education! The only times I was contacted was by scammers trying to get money by threatening to access my bank account. I told them that I was forgiven those loans and reported them! Yeah! For the Good Guys!

    ​@deeprollingriver52 I dispute your calling AARP a Liberal Flying Monkey. AARP is worthless for average Americans, when their aim is more toward the wealthy, and just wealthier Seniors. AARP also promotes big business, including private for profit rip-off medical Insurances, and others, even with its short stories they are woefully incomplete by providing little (if any) helpful information. And AARP it is often misleading, and lies by omission about Healthcare, etc. And most of the members of AARP do not use, or rarely use the discounts they offer, especially when most people can get Senior Discounts upon request anyway. So what you said deeprollingriver52 btw, nice user name) about AARP being "Liberal" has to come from a mindset of confusion in terminology, and especially even more so, when the word 'Liberal' is linked to "Flying Monkeys" which came from the movie, "The Wizard of OZ". These monkeys were sent by the witch to do her dirty work). Today the phrase for a "Flying Monkey" has since become synonymous with people who end up doing the dirty work of a Narcissist." Smh In saying that, this video and others like it do provide GREAT information that especially applies to Seniors, which fills in the large gap of the lack of information (for a large swathe of Seniors who need to know this, and Seniors who can and will benefit from it).     I am currently on non-collectible status with the IRS. I just sent them a letter listing my income and my expenses. I didn't fill out a form, but in a few months, I received a letter telling me that they put me on Non-Collectible Status. However, they will continue to add the penalties if/when you pay. BUT, you can ask them to waive those penalty fees and they usually will!

    @@Querencia7779 I don't believe my age had anything to do with it. I can't say they will always accept it, but if you TRULY cannot afford to make payments, this might work. I have done it previously and after a couple years, I was able to pay my debt off due to some money I received. So, I'm not doing it just to skip out of paying my way. You might try it & see if they will accept it.

    I really appreciate these videos! I am 100% debt free and my taxes are 100% paid up but it is still good to know this just in case anything ever happens. The only thing I wonder about these videos is how old do you have to be to be a senior for all of these different things? Some people say you are a senior at 62, some at 65.

    Seniors who owe land taxes sometimes have to go hungry to pay their yearly taxes. In Wythe County Va people who are late on their land and home taxes are reported to the local papers and their names are put in there for all to see about their deliquent taxes...I have always believed that was an invasion of privacy. The county has got by with that for years...in Wythe county Va

    Virginia like many other states has laws in place that help seniors and disabled persons who qualify waive property taxes or a certain amount of property taxes. Just search the internet for county and property tax waiver for seniors and disabled persons. Eric HELPS

    @@SeniorLivingOrg I am aware of that but I do not think its fair to put people's names in the public papers for deliquent taxes. There are poor folks who own a house and are finding it hard to meet ends and get the taxes paid and its like punishing people.Also it invades privacy when they put names in the paper. Wythe county does it every year and the busy bodies and gossips wait for it every year so they can read the names. Its been going on for years and very cruel to the poor.

    How I stopped paying income taxes at 31: I just stopped. How I stopped filing returns at 31: I just stopped. What I did to figure this out: I actually READ "Title" 26, with a law dictionary (NOT Webster's) in hand. Read the LEGAL definition of the term 'includes'. It means 'ONLY YTHIS'. Then look at 26 USC 7701 (definitions) where it defines the United States: it says "includes the District of Columbia" - in other words, it is ONLY the District of Columbia. In other places, sections will say that it "ALSO includes" territories, possessions, etc. In some sections it mentions the "50 states of the union", but NOT as "The United States". So in other words, UNLESS you "reside" in the District of Columbia, you ARE NOT "within" the United States. And (reading relevant sections) unless you have "income" that is "effectively connected with the United States" - guess what? You do NOT have "income" that is "within" the United States. This is not fantasy, it is not "patriot" BS, it is BLACK AND WHITE, written right there in Title 26 (which, BTW, has never been entered into law by an Act of Congress). It is the rules, so to speak, of the Internal Revenue Service. What's interesting is that NOBODY ever asks what that corporation's title means. Specifically what does the term "Internal" mean - internal to what? THE TREASURY DEPARTMENT! Well, what is "The Treasury Department" a department of? The FEDERAL RESERVE. The "Treasury" of the United States, as far as I've been able to figure out from my research, no longer exists, or has no actual function "within" the corporation we call the United States. There' a lot more to this, wherein one can find out what's the REAL situation with this corporation called the United States, what OUR relationship is to it as people out in the American states, and how almost nothing we've been taught about this "country" is true, but it's a lot easier if you ust go to anna von reitz' website (run it together and add com). She's not the only one who's be saying this, as The Informer and his fellow researcher found this out back in the 80's, and Karl Lentz has been teaching how to use common law, based on this info, but I figured it out on my own in the mid 80's - because I realized LEGAL terms rarely have the same meaning as everyday ordinary language words. That's why you have to use a LAW dictionary when reading statutes, codes, rules, regulations, public laws, etc.

    I like it. I don't pay a damn dime to them, in fact they pay me over 2,000 a month and I own my home. They give me money to give back to them for their so-called taxes, but it's only $50 a year. I worked on and off, for 46 years and I've never made as much per year as I'm making now. Cindy's husband: a veteran...

    Yeah it's actually corporate law everything is a corporation period and the District of Columbia is its own state. There is a tribe in this world that has attached these taxes to the people because America went bankrupt in 1933; furthermore for the Payback a Social Security number was attached to everyone being born. This number is a corporate number to the corporate District of Columbia. Putting your name in all caps to where you are obliged to pay taxes in order to pay back the money changers. The IRS is not a federal agency. It is a private Corporation.

    I am self-employed. Last year I earned just enough to pay rent and utilities. I was on food stamps and other programs. I had no money to pay my self-employment taxes. I had some money in savings and that is what I used to pay my self-employment taxes.

    IRS files a "notice of lien", not a Lien, which is a judgement after due process is invoked. Notices are not liens, but banks surrender the victim's funds unlawfully by treating a notice of lien as if it was a valid lien. This is a crime by the bank, but no prosecutor will charge them.

    Thank you. I turn 67 this year and all my adult life I steadfastly saved for the property taxes. I always paid on time . Now no one will hire me when I turned 65 and I went on social security all because I did not find a job and my wife was sick. So i still saved and we paid . I was proud to. as the savings dwindle.

    Many states have programs that discount property taxes for seniors. Also depending on your equity a reverse mortgage can provide to pay property taxes. Senior Living has a video on this you should look at. Eric HELPS

    Homestead act…apply for it through the county u live in and pay taxes too ….what is with this trend where seniors are proud to pay taxes!? It is not something to be proud of because it’s doing nothing but funding wars in countries that hate us and are getting funneled into politicians pockets …ur paying the mob for a home u paid for and kept up ur entire life and ur proud to pay the mob to keep them up and going to do again to the next generation?     A senior friend of mine in Oregon owns her property and little falling apart trailer she lives in on the property. She has no retirement. She saves up her social security all year in order to pay her property tax. She has to get food card in order to eat. She got her food benefits cut off because of the $ she had in bank she saves up to pay her taxes. Absolutely ridiculous. She gets letters from IRS all the time because she is barely able to keep up with back property tax before the new tax bill comes in. I wonder if this is just an Oregon thing.

    I pulled almost all my money out of my bank. She can pull her money out, then put it back in at the time she pays her taxes. Just keep your money out of the bank until the taxes are due.

    Home stead act…see if she qualifies for the homestead act through the county she lives in…my parents finally qualified after paying property taxes on their home for 45 years…it’s been paid off for decades but they still had to pay taxes and insurance until someone told them about the grant through the homestead act that waived the amount

    I wish the ARRP and their Lawyers should fight for seniors to get the taxation of Social Security and 401k and IRA benefits repealed in Congress and our new so called progressive Politicians in Washington and President Biden should support the repeal of taxation of retirement benefits if they have any moral compass st at all?? Plus fight for decent Cola raises on Social Security benefits of at least 5% yearly so we can afford to live and contribute to our economy? The AARP should become like the gun lobby for seniors in the areas that I have brought up?

    @@stevenmckay3688 No he didn't write it actually, he was a Junior Senator and not on that Commission. What he did is VOTE FOR IT. And IT was levying taxes against what was then HIGH INCOME SS EARNERS.     If a senior owns a house upon which the IRS has a lien, and there is a catastrophe -- the house burns down, say -- can the lien be taken from the insurance coverage?

    For the vast majority of seniors, at least right now, tax rates are very favorable and you will pay none or very small amount (which is more than reasonable). If your only income is social security, it will be zero. If you want to live in this country, paying some tax is patriotic. Now I do think the tax on social security is bad and should be overturned. You should receive that tax free.

    @@tamiweber7118 well, I said if your only income is social security, you pay no tax. So most seniors pay no tax. If you have other income, your social security may be taxed, which I oppose.

    We all pay taxes that pays in to our benefit such as roads and schools via the states sales tax program and luxury tax programs…u put gas in ur car right?     Irs froze my bank account because I hadn't filed taxes for 3 years. I had to file the taxes and actually got an 8000 refund then the freeze was lifted

    People should be tax exempt,because the cost of living is so high today,and Social Security is not enough to live on and the Cola raise are a joke. Even with a 401k or IRA benefits are not enough to Iive on. Especailly live in San Francisco in which rent is even higher then the benefits. So if retirees total income is less then $85,000.00 yearly should be tax exempt status?

    I am 70+ . I owed the stat less than $300. When I received notice. I tried to go on line and use their system to choose payment options. I also made a payment at that time. The next thing I new, the stat went into my bank account and took far more than I originally owed. The bank also changed me $75. , to process. I am a senior retired., taking money from my 401k to survive.

    Social Security and pensions are protected from state tax collectors. Twice the amount of monthly federal benefits including SS deposited into a bank account are protected from garnishment by federal banking regulations,. If you had another account then it could be subject to garnishment but if the source of the funds were exempt SS or pension then you could file a claim of exemption, However states make that process difficult or hide it. Sometimes Credit Unions don't understand the law and allow a garnishment by a state contrary to federal law. Eric Olsen Executive Director HELPS

    I'm 71 and the noise is terrible I'm 98% deaf except for crippling noise in my head.2/9/21 at oh 12:45 am I went to my frequent pit stop bathroom I was walking out and felt myself start to pass out from noise I caught myself on sink .I didn't go down...but frightening think about injury..my toes r now distance friends..

    I have been unemployed for almost a year and do get unemployment for now and Social Security. I am a travel agent and don't know when I will go back to work. My income is a big ?????. I joined HELPS this week. They are the real thing. A great organization that really is helping seniors.

    My husband worked on the road for 17 years and new York is the only state we have to pay all the time. He is a resident of michigan. Is there anything we can do to not pay them. They are the only state that makes us pay

    i had to pay on a loan because of the bush bust. they took a big part of my social security and thats when i found out i owed it. so i paid them.i got no notice. they just took it from my check.but i just paid them from the 1200 covid money.and as you went on it was the address thing.

    Before founding HELPS I probably filed 40,000 bankruptcies. I have been an attorney now for 42 years. The IRS as a practice does not take a person's home. They can file a lien but that is it. Perhaps in very peculiar cases with persons with very very high taxes and very valuable homes, they might take steps but if your CPA told you that he was incorrect. The right to do something and what happens in the real world is often completely different. The video talks about set off of SS, garnishment of income wasn't addressed.

    ​​​@@suzihazlove4979Call your local representative. Call your County Courthouse, ask your tax preparer. Depending on the seniors income, they maybe edible for a reduction in taxes after they fill the paperwork out then a refund will be sent. In our state my parents received a discount on their school taxes and $385.00 back out of the $1000.00 they could've received depending on their income. Some renters can qualify too.

    can you make a video on how expat seniors living and working in other countries can get help to get home and if they are staying how to open a bank account living abroad. i have saved a little bit but don't know how to get it home... i don't want to carry cash and have it taken at the border or stolen... what are our options and the laws on returning with cash.     How can you find out whether u need to file or not, for sure? Most accountants won’t tell you unless you bring your income tax in to file and charge you just to see. I draw SS plus a small pension from AT&T. The filing fee is expensive when I don’t think I even need to file, yet I don’t want to cheat.

    When the firm closed is went bankrupt I collected unemployment which was not enough to cover my mortgage or anything else. I borrowed from my 401k/IRA. I did not take out taxes because I needed every cent. I was 54/55 in 2011. I still owe $2900 which is now $3935. I paid a little here and there. They called my case UNCOLLECTIBLE. However they never told me interest would build up if I paid a little or nothing. I'm collecting SSDI as of end of 2018. What can I do to remove all of it? I was told the monthly arrangement could be as low as $55. I cannot pay that much. In 10 years they can't get any funds from me. So what can I do now to give something each month or get rid of the $3935 for good? I hate having a government bill hanging over my head forever!

    If you are on SSD and non-collectible now status wny are you worried? You dont' need to pay anything and the statute of limitations takes care of the tax after ten years. There is nothing hanging over your head. Eric Olsen Executive Director HELPS Nonprofit Law Firm

    I you been and will be on disability due to incarceration or mental status, your past taxes stop but the interest on that builds at an extranomical level. Is that true. This is what I have been told for a family member ?

    IRS taxes have a statute of limitations for the collection of ten years. No matter, if your income is low enough and you qualify for non-collectible now status with the IRS it wouldn't matter if owed a hundred dollars or a million. They won't attempt to collect. And state tax collectors cannot garnish Social Security or pensions. So for lower-income seniors interest accumulating on past-due taxes they can't pay anyway should be no concern. It's like worrying about getting swept away in a tsunami in the middle of a Kansas prarie. Eric HELPS

    Suppose you are on SSDI and can't work but ring the bell for the Salvation Army November and December when you can but have taxes taken out and don't file to get the money. Can you get the money or do it hurt you and they owes you.

    It might be easier to claim 9 as exemptions on your w2 form. That way your employer won't take anything out for taxes so you will get all the income Eric HELPS

    Property tax is levied by the county and state, not the federal government. (That's why the IRS wouldn't pursue your home. There's a case coming before the Supreme Court in which a state has not only kicked someone out of her home and sold it, but kept ALL the proceeds of the sale, much more than what was owed.

    State tax collectors cannot garnish SS and pensions. Your income is protected in a bank account as described in the video from garnishment by a state tax collector. Twice the amount of monthly federal benefits is protected automatically in the account into which they are deposited no matter the actual source of funds in a bank account at a time of garnishment.     This is currently happening to Me in Ashtabula County OH - My Mom died 2009, I was named as executor, 3 months later I was removed as ex, - reason: I allegedly did not list a Estate owned vacant lot for sale, yet I instructed the R.E. Broker to forward listing paperwork to opposition lawyer. I was removed as Ex. a subsequent hearing was scheduled at which I was presented with a copy of the new appraisal of the vacant Estate owned property, appraised by the same appraiser as Myself! On the cover of the appraisal was the same photo used when I had the property appraised several month prior. In front of the Magistrate that removed Me as Ex, I pointed to the photo and stated - See that Caldwell Banker for sale sign ! that is the sign that proves I had listed the property for sale when You removed Me - NOTE: this was proof provided by the opposition and ignored again by the Magistrate just as previous proof was ignored. ( The Judge was being poisoned with antifreeze by His, Nurse, wife at the time - He lived : ethyl alcohol is the antidote to antifreeze ). This was only one of many bizarre instances of blatant denial of the facts. 2 years later after which the property could not be sold ( 2008 -2009 G.F.C. ) I was offered the property at no offset to any distribution and I accepted in writing 2 ways including registered mail, but was instructed to sign a blank page in acceptance, I refused. The property remains titled in My late Mothers name as of today. The tax collector wants Me to pay the back taxes, now almost $6K, on the lot, however the subsequent executor of the Estate having received almost $100K in Estate cash neglected to distribute it and was dismissed by the same Magistrate without transferring the vacant lot nor was there an accounting of the Estate !!! WHAT !!! Did I mention that the opposition Lawyer as well as the Magistrate and likely Judge were, allegedly, socially alcoholically associating with the opposition? This is only a portion of what I can only describe as racketeering. I gave 6 years of My life to protect this Country and this is what I get for it. Finally, the property taxes on My primary residence increased 52% this year.

    Property taxes are a different animal. They are governed under state laws. They are really owed by the property to which they attach. Some states have programs that reduce property taxes for seniors. There are sometimes other answers.     You said something about owing for 10yrs.and then it's written off.I have state tax debt owed from my 2011 income filed in 2012.is the 10yrs.up in 2021 or 2022?I was told no payment plan monthly and the only thing I could do was a lump sum offer.I never could do that and now have had soc.sec.for 1 yr.now?what should I do now?

    Depends if your contributions to the 401k were pretax or post tax. If pretax, you are deferring the tax to when you start receiving your 401k, if your contributions were post payroll taxes, then you already paid the tax and there is no taxes on the 401k distributions except on the investment gains made by your 401k because this is passive income and gains separated from its capital is income. Will you recoup the tax when you file your income tax...probably! This interview on KZread really doesn’t help you.

    So I have a question my dad is retired and my mom due medical issues is not able to work and well I remember last year the people on ssi got a stimulus for $1400 but the lady who did their taxes insist that the $1400 they're having to pay back are from what the irs gave them the child tax credit money now can someone help me understand how that happened
