If you've brought a new cell phone or cell phone plan, joined a gym, downloaded a game or app, purchased a streaming service, or signed up at a bank, you likely signed away your right to a jury trial, and you didn't even know it. But the big question is: Did you have a choice? In most cases, the answer is no. You either sign the document and get the product or service, or you don't sign the document and you don't get the product or service. Why are big corporations making you sign such agreements? UPDATE: After production and during editing of this video, the U.S. House voted on March 17th to pass the FAIR (Forced Arbitration Injustice Repeal) Act, which would end forced arbitration and restore the right of workers, consumers, nursing home residents, and small businesses seeking to enforce their rights under the law.

    My Bank automatically opted me into an arbitration agreement as dispute. I recorded them opting me out and informed them I will sew for infringing on my constitutional rights. Now a atnt is refusing to give me my earned cell trade in benefit if I don't agree to arbitration.

    Question, what if a company wants you to sign an arbitration agreement years after you're employed? Also, according to the FAA aren't you supposed to agree to the arbitrator? Thank-you

    my boyfriend was forced to sign an agreement against his will..they used the phrase or els threatened him with jail it was a shit show from the get go..it was over a will contest we wanted a third party administrator and take it in front of a judge and bring up all the finational exploitation and abuse of the mother..our lawyer didnt do nothing to stand up for us..knowing my bf has learning problems the other lawyer made sure i wasnt there to help him understand things i caught the other attorney ease dropping on a private meeting for over 45 min..we was violated threatened or blackmailed made in fun of it was just bad..we was told by our att. the 2 mediators that thier mother has/had no rights her son can do whatever he wants to to her take n forge whatever he wants from his mother..i thought there are laws to protect our elderly even against family members..

    Can the Consumer Financial Protection Bureau help employees and consumers with forced arbitration clauses? How about forced arbitration opt out clauses? What if the consumer or employee did not understand the arbitration agreement that was signed? This is very confusing.

    Many contracts do not include language giving an employee or consumer the right to "opt out", but that would be amazing. The fact is, contracts with arbitration language is there to protect the employer, the business, the hospital, the medical facility, etc., not to protect the rights of the employee, the consumer, or the patient. It sucks and it isn't fair, which is why Plaintiffs are coming together, filing group actions, and beating the system at their own game. Thanks for stopping by, watching, and commenting.     I bought a new car one time and they presented an arbitration agreement, and i signed it. I never had an issue but im willing to bet the reason they do it is not because it is beneficial to the customer. Unfortunately millions of people are not going to refuse it, so that gives them free reign. They think its funny, "if you dont want to sign it no _____ for you". I think it should be illegal to deny you anything for refusing to sign their bs agreement. Thats like extortion. Im not familiar with what you mean by "forced". Sounds like they "update their policy" without informing you or your consent and just slide it in there?

    Thanks for sharing your story. Many nursing homes have "forced" arbitration agreements and the patient's admission to the nursing home is contingent upon their signing the agreement. So if something happens and the patient dies due to neglect or intentional harm, the patient's family is forced into arbitration after filing a Complaint in court against the nursing home. The defense presents the Agreement with a Motion to Dismiss and the court often dismisses the case, which means the only course of action the family has against the nursing home is in arbitration. Unfortunately, arbitration is historically a defense-favored institute, and statistically bad for Plaintiffs. People don't think twice about signing them because they never think it will come into play. And then it does, and then it sucks. Thanks for watching and commenting. I appreciate you!

    Its very scummy. The only way I see creating a change is for each person to refuse to sign it. So millions refuse it, nursing homes are empty, and they will have to cut it out. But millions wont do that, so like i said, they think its funny, no signature, no problem, no ______ for you.

    Forced Arbitration should be banned, since people believe that arbitration always favors the business and not the consumers. In today's society, there should be a law to protect the consumers if they don't want to sign the MANDATORY Arbitration that most (if not all) businesses FORCE their customers to sign before providing services or products. Arbitration should be an OPTION and not a forced agreement for providing services. If the customers choose to opt out the arbitration, business CAN NOT refuse providing services/products to the customers. Customers believe that arbitration is an UNFAIR way to resolve a dispute and should be banned, since arbitration is always in favor to the businesses and not the customers. Arbitration could lead the businesses to believe that they can cheat or do any harms to the customers and can still get away with it, since they know that arbitration will prevent the customers from suing them; and if an arbitration is conducted, the business will always win anyway because the rulings come from an arbitrator instead of a judge, who uses a set of laws to rule and whose salary is paid by the government. People look at arbitration as a wolf in sheep's clothing. Imagine if all businesses require the consumers to sign an arbitration to give up their rights ( i. e., cannot sue) and will not providing services/products until signing the arbitration, then it would be a disaster. If arbitration has to be in the contract, make it as an OPTION for the customers to opt out, instead of a requirement for providing services. Business dispute should be resolved under a court of LAW and not based on the BIASED subjective OPINIONS from the arbitration.

    How is it forced if you as an adult with the capacity to read and understand sign the agreement. You have the option to not sign and/or negotiate employment contracts and if the provisions aren’t favorable then you are free to walk away. No one is holding a gun to your head. Plus in civil cases there won’t be a jury but an individual judge. Generally employment tribunals are also presided by one adjudicator or a small panel. Having an arbitration clause in an agreement doesn’t make a company evil. They are enforcing clauses in contracts signed with them.

    You've provided one example of having the option to walk away in an employment scenario. However, how about for nursing home patients who were just discharged from the hospital, required to rehab in a facility, and the only bed open within miles is requiring an arbitration agreement be signed without negotiation. Then a month later, that person dies because they were neglected (ex. raped) and passed shortly thereafter. The family's right to sue is now greatly diminished. Your thoughts?

    I have been working for my company for 2 years and we were just told at the end of the day on Friday that we must now sign an arbitration agreement by 2/22 at 5pm or we will not be employed. That seems forced to me.
