Andrew Weissmann: ‘Our legal system has not held well holding an ex-President accountable’
Andrew Weissmann, former top prosecutor for the Justice Department and Rev. Al Sharpton host of “Politics Nation” on MSNBC join Nicolle Wallace on Deadline White House to discuss the challenges that the American legal system has been put through in the last four years to hold Donald Trump accountable, and how despite the conviction in the NY hush money trial, so much damage has been done to American’s trust in the rule of law.

I can’t honestly remember what Trump case it was, maybe the most recent Criminal one. But anyway I had to watch MSNBC’s take on the outcome. Who was there as an expert advisor? Mr Andrew Weissman. But poor man was on duty from the 5:00 o’clock bulletin with Nichole Wallis, right after midnight with Stephanie Rule, by then his eyes were bloodshot and watery, but he remained on fire with his advice. I totally admire this man.

Single district court judges have the power to halt actions of the federal government across the entire country. And because they have that power, and because the judges themselves have varying and widely known predilections and judicial philosophies, plaintiffs can place their complaints before a judge most likely to give them the outcome they want. The solution is for Congress to forbid so-called national injunctions except when issued by a panel of three federal judges. The use of these panels was the law until 1976, when Congress removed that requirement in most circumstances. The rules governing those panels should also guarantee a variety of perspectives among the judges hearing such weighty matters. In addition to the district judge to whom the case was assigned, the panel would include two appeals court judges, randomly selected, one from the circuit in which the case was filed and one from another circuit. Ideally, that other judge would come from the U.S. Court of Appeals for the D.C. Circuit because of its vast experience with administrative law issues, but that option might not be politically possible.

The last major rewrite has been in 1983, adapting the language to the current language and adapting the constitution to modern times. Other major updates 1815; 1848 and 1917. Because his lawyers have been able to delay these cases for months at a time. Look up the reasons for the delay in his DC Insurrection case. Between his own lawyers and the Supreme Court are probably going to be able to delay it past the election.
Are any of the threats traceable? Could the senders were reported, with the evidence, to their local justice people to follow up, as was done with the woman who phoned a death threat to Judge Chutkin? She was dealt with ultra fast, & her jailing was widely publicised, which was a good move. More reports like that are needed.

ref. 2:45. Weissman is correct. Most people are internalizing or even educated to know WHAT THE CONSTITUTION is and what is says, and why!!

Or do you mean to say, pre-civil war era. The Civil rights marches, sit-ins and Vietnam war protests were peaceful. There were riots in cities after, say, when Martin Luther King was assassinated.

Nobody in the civil rights movement was threatening to overthrow the gov't if their twice defeated leader still didn't win.
yeah, as an independent rural female, it's the conviction and the loss of the trial about his SA of the writer from NY. It's just too much.
There are other cases against Diaper Don that have been stopped. This ought not be allowed. Are we a genuine rule of law nation or NOT? If not, many of us are leaving.

Trump wants to be a dictator and never leave office!!!!!! REEEEEEEEEEEEE 😂😂😂😂
Here’s the question I have. We keep talking about trump and what he does n did. How about the MAGA people in the house n senate?? Even if trump loses this country will be under threat from one of them next!!!
This is happening at all levels of the legal system and it doesn’t matter who the defendant/complainant is. Judges can be subjective. I’ve found that in some cases, Legislation, coupled with lies (from one side or the other), a judge may accidentally (or purposely) side and enable the liar. It’s a costly process to fix an error in judgement. The social problems caused by this, compound on each and everyone’s daily lives
Andre is trustworthy and reliable, knowledgeable and knowledgeable 😊
I find it puzzling that the Constitution, the basis of the legal system, has clauses in it that seem unenforceable. Does it not have the force of law? Many people shout out their right to free speech or to bear arms, based on Const.clauses, but totally ignore others, like making state laws that directly counter other clauses, like establishing equal voting rights or keeping religion out of government bodies like schools. In order to reverse such state laws, someone has to bring a civil case against the offender. If the Constitution is THE basic law of the country, why are offenders not charged in criminal court?
Terrific questions, Nicole. Fabulous explanations and information, as usual, Andrew. Rev, you are a treasure to all Americans.

Faith in the judiciary system has been going down in direct relationship to all the young Americans (the poor and people of color) who negotiate instead of going before a jury, knowing that ethnic antagonisms might well be more injurioius than the 2 or 3 years they agree to to spend in prison. That is heinous. That's where the disease began. To hear all this stalk about "justice" in light of all the young people who have languished in jail for possession of marijuana, now that its a middle class recreational drug, is painful. Not that this other stuff isn't serious, but infections spread.

anyone who spends one minute examining the particulars of this "trial" will arrive at the same conclusion as the rest of us.
You obviously only like the law when it goes your way .
I wish Diaper Don had more in common with J.F.K. and M.L.K. if you get my drift.

Al Sharpton is spot on and needs to continue to be a voice in this election. More networks need to have him on.
They call Al Sharpton "The Rev." Love it.
The legal system... How about the Senate and House republicans????
Judge Merchan i pray you put him in prison
Respectfully, Nicole, at 7:15 you ask the question about the conversation you should be having if 45 gets a second term. Well, here's the question: what is my exit strategy? Where can I move to with my family that is outside of the US? What paperwork do I need to have ready to pack up and leave? What belongings are essential to take with me? And that's before he completely closes the borders to travel into or out of the continental US...
We need to hold politicians accountable if you expect the taxpayers to respect the laws! It may be difficult but the rest of us would get jail time. Apply Equal Justice for All!

the judge has been instructed to keep the gag order in place until after the election, or at least until after the debates. a three year old could spot it at a glance.

How do law professors teach in law schools right now? What are the conversations?? I wonder about this.

nice to see the positive in him being sentenced, but the sentence he'll get - most probably monetary - will not hurt him or touch him at all. so the sentence he'll get will only embolden him even more ... he feels untouchable and so far who can say he's wrong
What a concept!
When law is not enforced, its losses its meaning and value, it become worthless lies.
