What if you have no ties to your home country? As if you dont know your family or they’re dead?

Yes, always apply for advance parole and EAD as soon as you are able. However, there's an exception for some employment visas (H and L are the ones I know about) where you can travel with your visa and not lose the green card application. You will probably lose the advance parole application if it hasn't been granted yet but it's not as problematic as losing the I-485.

Question, I’m in the United States with a work authorization, I’ve been legally in the United States since 2001 ( since I was 14) never travel back to my country, im getting the green card because my mom is sponsoring me, they told me I was going back to my country to the embassy interview, do I need a parole once they give me the green light that I need to come back to my country for the interview??

@@ronnymarquez1986 why would you be doing consular processing if you are in the US? Usually if you are in the country you adjust status in the US and the interview would be at USCIS. Who are "they"? Advance parole is not for going for green card interviews. That would make no sense. It is for you to travel - for your own personal reasons - without abandoning the application. Check with an immigration lawyer, not KZread. We don't have all your details and anyway you should not be trusting strangers on life changing decisions :)

Yes you can!

My wife and I applied for i485 and AP/EAD. While her AP was pending my wife had to travel and USCIS rejected her AP. So she returned on H4 as I continued H1. Then she applied for AP again. After an year while AP still sending she had to travel, then again USCIS rejected her AP. Again she applied and its pending since 1 year. Now she has to travel again . Damn this USCIS and their services.

The issue I have with Advance Parole is that USCIS processing time says 11.5 months and I-485 is 12 months so basically when your I-131 gets approved you won’t even be able to use it to its full validity date because you’ll need to rush back to the US for the interview

YThereiz a regulation that says your I 485 is abandoned is you leave even if you get advance parole. Or at least there wS. I had this happen in 2004 at Garden City..

many acquaintances hired different different lawyers, and almost all of them didnt apply advanced parole for their clients. clients didnt know, and when i found out about it, i told the clients to ask why and asked for them to apply. the lawyer said it not part of the package ( but how the client know, most client hired lawyers because they needed help and didnt understand about immigration application ) end up charging them ridiculous amount of money just to file AP

Does everyone qualify for advanced parole? Someone who EWI qualifies?

No additional fees, no major extra work.....why wouldn't someone apply for it lol

We applied but it never came. We got the green card in October but the combo card never showed up. 🤷

Hi Jim. I realise that this is a bit of an "old" video, but I'll ask anyways. So, what do you know about the I-131 re-entry permit? Ive been waiting to get one approved for nearly 16 months... so frustrating. An I-131 is basically a passport that non-citizens use to get back into the US and re-enter freely. It shouldn't take much more than 6 to 8 weeks to approve and process, but for some reason there are wait times of up to or close to 2 years. So sad and frustrating since the applicant is exercising their natural right to travel, which they are entitled to.

My case is strong concurrently filed and pending more than 18 months now. Provided all documentary evidences and provided evidences for urgency. And also I’ve requirement to work under specialist and expert area as a Oracle PL/SQL Developer and to find the job with much better salary than the previous one extended time approving my gc can done. Uscis error issue and tooth implant was also mentioned.

does that apply to a newcomer on a DV visa? ny visa is endorsed but i haven't received my GC or SSN yet, just came yesterday but i have to leave the US for 5 months 2 days later, is it safe for me to leave?

I have a pending asylum court case and I have just been granted TPS can I apply for advanced parole and will I come back if I leave the United States and come back not to my country

Are biometrics required for Advance Parole? I am having severe delays rescheduling my I-485 biometrics appointment and I am concerned if this may affect the processing of my I-131…. (Especially because USCIS is tending to approve recently filed cases nowadays)

I would say the only time maybe you shouldnt apply for advance parole is if you have a removal order

Don't you need a specific reason for applying for AP? Meaning, is it possible to apply in advance without knowing the reason for your travel?

What time and days?

If I filed I-131 in May of 2023 on paper with my I-485, how do I get an update? Can I refile electronically to maybe speed it up and have 2 applications in? I received my work permits like 3 months after submitting all my applications but my travel permit is taking forever. I would like to travel for pleasure, but I don’t want to jeopardize my green card application.

Parent present in USA adjustment of status applied on 14 October 2021 finger print done 2 February 2022 work permit received on May 2nd 2022 uscis sent.notice 1-693 signed and stamp civil surgeon sant again not this time when we send instructions what time will take my green card

Hi Mr. Hacking! I have already done the fingerprints, 3 months after I filed the i-485, with priority date July 30 2021. I am still waiting for my Advance Parole to be approved and last status is "show that fingerprints were taken", on August 19 2022. Can I leave the US and have someone mail me the Advance Parole document overseas so I can return to make the i-485 interview later on, or if I leave without Advance Parole approve that will jeopardize my already approved i-140 EB2-NIW and pending i-485 petitions? I've been in the US for 3 years and haven't been able to travel because of covid travel ban and now because of pending i-485 and i-131. Thank you.

If a TPS recipient submit an I-131 Advance parole travel document without proof of emergency evidence, will the application be denied? The application mentioned it's a must. Others told me they've been approved without submitting evidence. If one is approved for the travel document, can they still be denied re entry in the United States? I was under the impression once the person has a valid travel document they can not be denied re entry?

It is different for every case, and completely up to them. Hard to tell how many days it will take.
