CONTROVERSY
On September 11, 2019, The New York Times reported that Justify had failed a drug test for scopolamine after his Santa Anita Derby win. The substance was found in excess of the allowable limits which could have led to his disqualification from subsequent races, including the Kentucky Derby. The California Horse Racing Board (CHRB) initially delayed taking action and ultimately dismissed the case, attributing the positive test to potential feed contamination by jimson weed, a claim that was supported by similar findings in other horses. The controversy escalated when the owner of the runner-up, Bolt d'Oro, sued, resulting in a 2024 court order that mandated a disqualification ruling from the Santa Anita stewards. In response, Justify’s owners filed an appeal, arguing that their due process rights had been violated.
