Alec Baldwin LIVE Jury Trial | Jury Selection Begins | Summary

Chandler (‪@remy_legal‬) and I were in court all day for jury selection -- let's talk about it!
A grand jury in New Mexico has charged Alec Baldwin with a fresh count of involuntary manslaughter over a fatal movie set shooting in October 2021. Alec will stand trial in this series as we cover the case live.
The Allegation: Alec Baldwin received the firearm from David Halls, a safety coordinator and assistant director (not the armorer), and was told it was safe (He shouted 'cold gun', meaning the gun was not live). Interestingly, Halls had witnessed two negligent discharges (ND) in the days before the accident and had failed to take any appropriate action.
Also, in his position of Safety coordinator, he should have checked the gun was indeed 'cold' before handing it over, in my opinion. While the buck might stop somewhere else, he is still in the chain of negligence [and pleaded 'no contest' to the charge of 'negligent use of a deadly weapon',] and was convicted of that last year.
Baldwin did not check the firearm, and seemingly the person who handed it to him did not check it either. The armorer was not on set. The armorer should always be on set when firearms are being used to ensure safety protocols are being followed. Usually an armorer should give an 'all clear' once firearms are secured. There is scant information on whether Baldwin had the required on-set safety training mandated. Even if he had been using guns on set for decades, it's still required to go over things with an actor before the scene.
As an actor he may be culpable for the incident if it can be shown that he acted negligently when in possession of the firearm. However, an actor is not supposed to be a firearms expert. That's the reason why productions are required to hire someone who is. However, he was also a producer on the production, so in his capacity as producer, he might have some level of culpability. Especially as the armorer, Hannah Gutierrez, said that the producers overruled her and therefore created unsafe work conditions.
However, Gutierrez was found guilty of the misdemeanor of negligent firearm use. It is further alleged that she spent most nights drinking heavily and smoking weed and was very likely hung over when she loaded the weapon.

    I hate Baldwin. I don't believe he purposely kill the woman. The woman in charge of the gun. I see her trail and I see her face and I think she did it with all bad intention. I see everyone who attempted against President Donald J Trump ended with the they life destroyed. I'm not religious but I believe in the almighty God. God it's holding president Trump and protect him. To save us from evil.

    I second this observation. I saw another lawyer critique that she is crooked because she invokes sympathy over and over and even tries to backdoor testimony in to show blood and autopsies and wounds over and over even though the suffering of the decedent is not a relevant logical piece of evidence and actually is provocatively designed to make jurors act irrationally, emotionally, and not logically.

    I know the Marine Corps has a standing order when you pick up a gun or are handed a gun. The first thing you do is clear the action, even if you were the last person to handle it. I remember at basic a friend named Andrew who was probably the most knowledgeable about M4s had finished cleaning his rifle when another recruit was having a small problem and asked for help so Andrew set his rifle down on the table right in front of him and help the other guy then picked up his rifle and because he didn’t clear it again the whole squad had to do 2 hrs of PT. It’s not like he walked away from it or anything it was on the table right in front of him closer than most people have their dinner plate and he knew that nobody touched it. But because it left his hands when he picked it back up he had to clear it again. Some people would say that’s a little extreme and there’s no reason to clear it again but maintaining that kind of discipline prevents accidents.

    They talked about limiting the information the jury shares on what they know and have heard about the case. Both sides were in agreement of this! They discussed having the juror individually coming up privately to the bench. So I believe you are being overly critical on something they all agreed upon.

    Rules of gun safety are 1. Treat every gun as if it were loaded 2. Do not point a gun in anything you do not intend to kill/destroy 3. Know your target and what is beyond it. Beyond that military, most shooting ranges, shooting clubs, and most gun stores have a policy of when you pick up a done the first thing you do is to clear it and check for yourself even after that, you’re still following the three golden rules.

    @@thedaily30 this was a real fully functional Italian made replica of a Colt single action army in 45 long Colt if it was actually a prop gun how did a real bullet get fired out of it? In fact, the FBI fired 12 rounds and stated the condition as “fully functional works as designed”

    The sporting goods store i an assistant manager at has both an outdoor and indoor range at any given time we have 300 guns in stock and we have had a strict policy about if you don’t follow the 3 golden rules you will be banned from entering the store this applies both at the range and at the sales counter even though every gun at the sales counter has both a trigger blocking lock and a cable lock through the action. While in the range area in addition to the 3 golden rules policy we adopted a clear the action first policy similar to the one that the Marine Corps has.

    I think the person that was prosecuted and found guilty was the correct person to be behind bars. there never should’ve been a live round on that movie set and that is not his fault. But that’s my opinion. I doubt actors ever check the gun and I doubt they have ever been expected to.

    I watched the Gutierrez trial. Kari Morrissey seems like an okay attorney but I don’t like her tone. It’s aggressive (not assertive) and condescending. It’s so off-putting.

    It’s time to widen what “media” means now. MSM is no longer as they don’t do actually non- biased reporting most of the time ; thus, content creators and independents have picked it up and have huge followings because of it. I get all my news from independent sources now . MSM has lost all my trust years ago.

    There is proper attire for courts. Usually men suits, business casual (dress shirt, ties, belts), no jeans, shorts, tennis shoes, sandals, mid drafts, no sleeveless tops, no tank tops, no shorts, no cleavage showing, and similar items. However with the lack respect for rules and authority most individuals under 45-50 do not adhere to “proper attire” anywhere…not in the courts, not in church, not in the workplace……

    The information about him being a producer the defence should have let in as all the producer responsibilites credited to Baldwin actually were the responsibility of the second assistand director under the control of the director. I would think that the defence should be supporting the prosecution trying to use faulty information. The safety failure in this area belonged to others who look like skating.

    Thanks I was just curious because I did get selected for federal court jury here in Illinois, but I had sent in a hardship for an excuse and it was granted but I got thinking man I don’t really have any dress clothes, etc. just serve a jury I’d have to go out and buy a whole new wardrobe

    I can see the defence going for the gun was destined to be used in an unsafe manner as part of the shoot (i.e. being pointed at someone in the scene) therefore Baldwin was not reckless by assuming the gun was safe.

    I could be wrong, but during HG trial I got the feeling Kenny was sleeping with Sarah, that that was the reason she was hired. Sarah was big mad at HG, I would'nt put it past her to have noticed how lax HG was with the ammo, and put some live rounds in the mix in the hopes of getting HG fired, and Sarah promoted PS Hancock, Morrisy & Poppie said the ammo was not put under the Rust case ref number, because they only put evidemce collected at Rust in there. That was a lie. Kenny was not on set, and they took EVERYTHING he said as gospel. Hancock talked with Kenny 40 times. After yesterday I definetly think HG was set up by Kenny & Sarah, and if I remember correctly Sarah was given immunity

    Regarding the prosecutor: the first thing that bothered me about her was her lack of vocal training, her voice is very nasally, its irritating and sometimes she is hard to understand. you would think a "special prosecutor" would have taken care of this through some vocal training, unless she wins by being so annoying they vote for her to get it over with. a lot of people have this problem and need vocal training in order to just enunciate properly to be understood. this tells me she is not self-reflecting and likely not very self-aware. the next thing that bothered me was totally predictable. un-self-aware people are rarely competent in any way. this proved itself out in this case. this "special prosecutor" is so incompetent that the charging documents did not charge alec baldwin as producer, but she's going to argue it in trial. even a legal moron like me can see this stupidity. has she lost her mind or has she been faking it this entire time?

    I like Morrissey, sometimes she goes a bit too far, but good for her not to get intimidated by Baldwin's 8 fancy NY lawyers Oh, and Baldwin.... If the scene had called for him to put the weapon to his own head, he would have checked it 10 times I'm sure

    The prosecutor does definitely have an attitude, what you saw today is just smaller sampling of what was exhibited in Hanna G’s trial. The judge read Hanna the riot act at sentencing. This will definitely be an interesting trial. As long as the prosecutor nails Baldwin, she can have an attitude. Anyone else who had done what Baldwin did they would have thrown under jail for 20 years or more. Baldwin knew YOU NEVER aim a firearm at anything you do not intend to kill.

    He has already been charged criminally… that is why there is a trial… Had the entertainment industry protocols and procedures been followed this incident would not have happened. The jury will decide if he is guilty of the crimes he was charged with (manslaughter)
