A Dream Home Now Unsellable; Family says Chatham Co inspectors missed serious violations
A Chatham County family's home was built so poorly, they've been told it would be better to tear it down than repair it. 5 on Your Side's Keely Arthur explains how the home had approximately 30 building code violations, and why the builder or county officials have taken no responsibility for their mistakes.
Error after error the builder made was missed by county inspectors. But no one has taken accountability for the mistakes. Jake and Anita Muehlbach told 5 On Your Side this home was supposed to be the home their girls would grow up in. "This is close to where I grew up," Jake Muehlbach said while sitting on his front porch. The family went with Lindley Builders, Inc. to design and construct the home in 2020. Shortly after moving in, they started noticing problems.
Lindley Builders, Inc. is based in Pittsboro, Chatham County, NC. Lindley Construction is based in Ramseur, Randolph County, NC. Lindley Construction is not involved in this home build or report.
When the 5 On Your Side team was at the home, floors were bowed and uneven, sheetrock was cracked, cabinets were pulling away from the ceiling, and doors would not latch. All those issues are symptoms of a bigger problem.
"These load-bearing walls aren’t supported," Jake Muehlbach said, pointing out three different walls in the downstairs of his home.
The structural problems are so severe, Jake and Anita Muehlbach said they’ve been told by engineers that the house isn’t worth fixing.
"They’ve all been confident, ‘oh, I can fix it’; and by the time I get half way through this tour they’re all like ‘yea, you’re probably better off tearing down and starting over," Jake Muehlbach said.
There’s also concern that the home could suffer a structural failure.
"We fear failure is gonna happen. Hopefully my family isn’t in the house when it does," Jake Muehlbach told 5 on Your Side.
Approximately 30 code violations were missed by Chatham County Building Inspector Daniel Gunter. He was later relieved of his duties by the county, and his inspector certifications were blocked by the state.

In the cases I know where I grew up it is not so much paying off but 'helping out' say one of the workers of the contractor is a good mechanic or has done work building so and so's garage. Being buddies or related or school mates also goes on. The good ol' boy network will cost you a boatload of money in the long run.
Think about all of those Chatham Park homes being built for between 5-700,000 dollars or more. They are getting the same quality inspections by the county. Just imagine how many other screwed up homes there may be out there.
the go fund me idea I understand, however the country has an insurance policy to protect its citizens for these exact types of situations. Its absurd to think tax paying citizens should band together to cover the mistakes of a negligent contractor, and the county who is unwilling to protect its residents. This whole story is absurd! Sickening! DO THE RIGHT THING!!!! Be held accountable! Truly disgusting behavior.

Chit some guy got a over payment for a few yrs for retirement. They garnished his social security checks even after he died they were taking his wives benefits too. But it's fine when they make mistakes.

50/50 on the county and builder. beams put in the wrong place is entirely on the builder. inspector missing it is pretty bad too. soil compaction problems could be a factor as well. That can be hard to pin on anyone.

@@krakenwoodfloorservicemcma5975 it's interesting you mention soil movement. back when my home was getting started, my excavator was putting in footers for my house. he told me it'd cost a little more due to extra concrete. he said he doesn't believe "standard" footers are good enough. he only does footers that are 24" wide and deep. he says this will go a long way to prevent home problems due to movement. i liked this and i'm very glad i didn't disagree. 24 yrs later and no issues at all.
Do something without the county's approval - FINED! Try to hold the county accountable for their "drive-by" inspection, DISMISSED! I sure wish I had qualified immunity in my job...

So the county assumes no responsibility for their actions but they fire the county inspector? I think that move by the county, within itself makes them accountable.

They do this because they know there is no actual accountability for their mistakes. Judges and government officials are all corrupt. They are both morally and legally responsible, but they also hold the gavel. Those who enforce our laws behave as though the laws do apply to them.
The county needs to take care of this family! This is not right. If someone gets hurt who is responsible?!
They should hold the judge liable if something happens to that family inside their home. Why is the county and the government immune to a lawsuit? This is not ok, are putting this people lives on risk.

The judge has to follow the law that says that the county is immune. He doesn’t make the laws. I can’t believe legislators would allow the county to not be responsible nor liable for its failures to call out unsafe situations which would allow the builder to have made corrections along the way.

This is why most general contractors ask for 1/3 of the total cost up front,you dont just pay full amount, until you see what you're getting, where if your not happy with the work,you can hold some power,by NOT PAYING THE FULL PRICE UP FRONT.
They need to stop hiring inspectors who aren't qualified. Don't they have to test for certification? 😢 This is horrible.

That's what it's going to come to. Also a lot of youtube videos out there explain how to do contracting/repair work. Reputable ones. We do a lot ourselves and keep an eye on who we hire. But the build of a new house starting from scratch, that would be too big for me to oversee.

Become a City or County Inspector to make a difference. And if you work your way up you can Demand more from your staff to protect the Home Buyers from unscrupulous Developer / Builders. With the force of Codes. Take it from a Retired Chief Inspector from SoCal. We are not perfect but anyone leaving California will Not tell you they are leaving because Building and Safety Department Inspectors are Lousy. Lol.
the homeowner in this case needs to determine who the GC and developers were for this house. Then, file a lawsuit against them holding them liable for the damages.
They had the same thing to happen in Las Vegas, a while back. They had to destroy blocks of newly built homes.
This is a BIG heads-up to anyone thinking of building in Chatham County, NC; I think I would look elsewhere.
Gov't "Congats, your house passed inspection", family moves in, the gov't "Hey, we noticed your house isn't up to code"

Imagine what can be the risks when eating or shopping in establishments inspected by the County! Any inspection done by that inspectors must be revisited, immediately.
they just posted an update. The builder had his license suspended for a year, but nothing else has been done as far as compensation or getting the house repaired.
The county claiming immunity is insane. They should appeal that decision, I know lawyers aren’t cheap but I’d certainly appeal. I’ll say a prayer for this family 🙏
The takeaway: RUN when a builder says he's an architect, engineer, and builder and tells you he's going to save your tens of thousands of dollars. The last straw: WHEN YOUR PLAN IS ALL IN HIS HEAD! Pay to get your home properly built! When everyone else's costs over $200/ sqft and yours is $60, BE VERY, VERY CONCERNED! Remember, you get what you pay for!
Funny how the County can hold homeowners accountable for doing something they find, but when it's the otherway around the County finds a way to not be liable for a shotty inspection.
The agency is responsible that is their job that's why they make you get permits. The judge his judgement is in serious question and I would try to take it to a higher court

And if you don't get a permit, county can make you remove the structure. I've seen it happen.
I think the judge made the wrong ruling. The state inspector was clearly not doing their job and therefore shouldn’t be protected from liability from failure to do their duty. It’d be another thing if the inspector acted in good faith, which they clearly didn’t.

Well we can't blame the judge. He/she has to follow the written law. Otherwise it would be challanged in appeal and the ruling overturned. Go after the county and state government. They write the laws. And that's what elections are for.
This need to be shared and read the video note as there is Lindley builders and Lindley construction, two separate companies. This needs to be shared especially in the area that company is working. Start asking the state Attorney General how this can occur and get it sent to that office, keep it on the AG social media. Even if the contractor doesn't have the funds they could be transparent to say they are getting quotes and saving the funds or whatever but truth be told the builder has insurance also. These companies also work hard to keep bad reviews hidden and get cases dropped so it is real difficult to sort things out. One of the things that bothers me is that the contractor type also have 'I love the US' and 'America is #1' and those sort of things on their vehicles. The situation can be fixed but what a huge amount of stress. The sooner it is fixed the better for the quality of the build. Also drag in those who did the site inspection/permitting. If it were that unsafe they would not be allowed to live there, the county would condemn it. Keep up on this.
The answer to this is an insurance-backed warranty. These are a legal requirement for new houses in some jurisdictions (such as the United Kingdom), but they are expensive.
As bad as this situation is, if this couple had put this house up for sale during Covid, they would have gotten $40,000 to $100,000 above highest value of the house if it had no issues and they would not have had to agree to an inspection to get that price. Lots of homes were sold that way during Covid. I was amazed at the number of desperate buyers that over paid and ruined the market for all buyers. Now those bad purchases are coming back on those too anxious to buy now.

Was inspector for 17 years. Not in N.C. but in many other places. The job is all political. When you fail a contractor they call the Commisioners who then call the Building official who then calls the Inspector and tells them to go easy on them or else.
if you're wanting a home built; the LAST thing you should do is hire a "home-building company" that handles "everything" to build the home. i did all my subcontracting. i took the time to pick my builder/electrician/plumber/foundation guy....etc.... it's been 24 years, and other than replacing my furnace/water-heater last year (which is normal upkeep).......i've had NO issues.
I intercede on your behalf that GOD shows up and shows out. That all things will work out for YOUR GOOD.

Isnt permits and inspection supposed to "make sure its built safe and properly?" Isnt that what they are about. If not then fuck permits and inspections. The city failed this family and who knows how many other there are. The city and the judge is frightening from a lawsuit from all their citizens.

People are woefully uneducated about homes. Especially about contractors and expect the city/county inspectors to do their jobs and at minimum be able to hold them liable if they don't. What is the point of the city/county inspections at all at this point. And some people would argue that you shouldn't trust the government. But why the hell not?? You can't live a life saying oh well, I chose this when people are doing the things to you. At some point you should be afforded at least what you pay for. Its wrong.

@MandaPandaPeters it is wrong I 1000% agree. Everyone has failed these people, but I'm sorry, rule #1 is ALWAYS get independent inspections done.
Govt immunity like this has to end. How many other homes did this guy inspect? Is the first question I would ask. And are they structurally compromised as well? ( I see the update answer below is NO they will not even look at them) Yikes. Where are the investigative journalists on this? Either the inspector was on the take, or dangerously incompetent in the job. Both are the govts job/problem. AND the builder should be on the hook for all of this non code construction and anything the dangerous bad construction ruined. Since engineers condemned the home, why are they allowed to stay in it? The builder should build then a new home or go bankrupt. The builder obviously strayed from the build drawings, or did not have an engineer draw up the plans. If that is the case the govt failed when approving the plans before it even started.
They didn't miss them. They got paid off. Money under the table. The builder and the inspector should be sued!!!!!
all i can say is when investing this much getting an outside private inspection for each major step may add 3-5% to the overall cost but the problems would have bin caught at or before framing . to understand there problems now even with the judgment if they get it between the demo and rebuild they will have a deficit of over -$400.000 but the builder has no assets , all that's waiting is for someone to step in and try recovering money to force the builder into bankruptcy .

Who is the contractor? Home owners engineer? Something is missing from this story.
Wish I had a life savings to put away, my family lives check to check with little that can be saved back. They're still realitively young, they can start saving again.
Should be able to sue the county.
When about contractors slush fund? You qualify if you win a lawsuit. I think the cap is $250,000. Check it out.
This can be you either now or in the future. Corrupt system needs fixing. Someone is paying someone to pass these unsafe houses.
If the county had no culpability. What were they being paid for? Money grab?
Have the family do a Go Fund Me, that is one I would trust donating too --- this is very sad and makes me want to get an engineer out to inspect my home that was built in 2019 in Wake county.

of course the county isnt responsible here I mean it was just the County employee who failed to do his job every step of the way which caused him to be fired and lose is certification. The county vetted, hired, trained, and supervised this inspector. They are absolutely liable. If this were a private inspections company hired by a municipality to inspect homes, the company would be liable for it's employee. As such, the county is liable. It's just lucky it has the court system on it's side.

@@shanem3843 Cheers! Gotta feel for the homeowners. Their only fault was not educating theselves more about building a a house and hence putting their trust in the bulder to draw it up. To build a house, you really need a good set of plans. Ideally one that has been drawn by a reputable building designer or Architect and has been stamped by a engineer. People underestimate the value of a good set of plans. Most homeowners fret at a $5000 set of plans but won't even flinch at an $80k custom cabinet. Your cabinets are worthess if your house is falling apart. Depending on the scope of work of the architect, it can be as low as 10-20k and top 100k just for a custom designed 3500 sqft plan. For the high price, architects are checking on the jobsite periodically to ensure the build is right per their plans. Let's face it, house plans can be had for a couple hundred dollars. To people who are not in the know, this is like a godsend! As far as they are concerned, they are saving a ton which can be passed onto ammenities. What they don't understand is a cheap $400 plan is not the same as a 20k plan. Like anything else, you get what you pay for.

I hate my country sometimes because you can do everything right and you're still screwed but we're all supposed to cry about a billionaire who died spending 200,000k! Just to see the titanic!!! 200,000 is the price of some homes.
The main problem I saw is that the home was built on a cement block foundation. This is obvious that it's a modular home. Like mobile homes that become unlevel over a period of time.
Note to self: Don't move to, do business or buy property in Chatham County, NC

I'm a 40+ year homebuilder, this is Insane. It's way cheaper to tear down this house and start from scratch. Sue the homebuilder, the subcontractors, the architect and anyone related to the project.

New home construction today is junk. Unskilled laborers, Home Depot imported garbage materials, the list goes on and on. My home is a 108 year old Craftsman Bungalow.built by true craftsman with materials second to none. It seems that many people today are only looking at the paint or paneling or the color of the carpeting rather than location and quality o construction thanks to these ridiculous home buyer TV shows.
