Raleigh man's retirement dreams vanish when state's miscalculation leads to $241,000 debt

Years after he retired, Joseph Glenn was ordered to pay the state back for their error in calculating his retirement benefits. The state overpaid Glenn for 17 years, ending his comfortable retirement. The Department of State Treasurer mistakenly overpaid millions of dollars of retirement money to recipients for decades. Now the state wants that money back.
The error, which plummeted dozens of families into debt, was made public after one family called WRAL's Keely Arthur for help.
The Department of State Treasurer told WRAL 5 On Your Side that it manages $114 billion through the Retirement System Division. WRAL News’ investigation found the overpayments totaled approximately $6 million and went unnoticed for years.
Once the mistake was identified, 41 retirees were ordered to pay back the debt, according to the treasurer’s office. Individual recipients, on average, owed $146,341.46. Joseph Glenn is one of the many victims. He was born in 1939. His wife, Penny Glenn, told 5 On Your Side that he was illiterate, but what he lacked in formal education he made up for in work ethic.
"I’ve seen him knee deep or more, cold, icy, water repairing water mains," Penny said. "He would work day and night."
He retired from the City of Raleigh in 1996, where he worked as a heavy machinery operator. For years, the Glenns received letters from the State Treasurer’s Retirement Systems Division reassuring them that their monthly payout was correct. Then in 2018, the Glenns received another letter, which turned their lives upside down. It told the Glenns the state had overpaid them hundreds of dollars each month. The error went unnoticed by the state for 17 years. When the mistake was finally caught, the state told the Glenns they owed $241,181.19.
"I read him the letter. We looked at each other and broke down and started crying,” said Penny. "He said 'baby, what am I going to do? I can’t pay back $241,000. I didn’t even know they were overpaying.'"
The letter explained that their benefits should’ve been reduced in February of 2001, when Joseph turned 62. The Glenns were enrolled in a Social Security Leveling plan. The plan gave them a higher monthly payout prior to Joseph's 62nd birthday. When Joseph turned 62, his payout was supposed to drop and be supplemented by social security. But the payment was never reduced. In an interview with 5 On Your Side, we asked Treasurer Dale Folwell how families could possibly know their payout was incorrect, when they were reassured through letters from the treasurer’s office that their payouts were correct.
"That’s a great point, but the dates that you mentioned are called 'pre-Dale' because I wasn’t the treasurer then," Folwell said.
According to the letters, the error was made in February of 2001. Treasurer Richard Moore was in the office at the time.
Folwell also disclosed other instances of over and underpayments. Folwell told 5 On Your Side that he had no choice but to recoup the overpayments.
"We sent underpayments out immediately and stretched overpayments out as much as possible," Folwell said.
The Glenns were ordered to pay back all the money. Their monthly benefit was reduced to around $250 a month to compensate for the error. The Glenns were also told that the state would seize any tax returns to repay the debt.

    Indeed, that's accurate. I'm currently in my mid-50s. My husband and I were on a similar path until a couple of years ago when I decided to shift my investments to his wealth manager. While I haven't quite caught up to his accumulated profits over the years, I'm at least earning more now. I'm generating income even before retirement, and my retirement fund has experienced remarkable growth compared to what it would have with just the 401(k). It's quite amusing.

    It's regrettable that many individuals lack access to such insights. I understand why people might become anxious. Insufficient information can indeed pose significant challenges.     Absolutely. This was the states fault. The mental distress and the trauma the state put her through, she could blow this this up and force the state to settle because they are clearly in the wrong. The general public sides with her. I don’t see how any judge would rule against this retiree who couldn’t even afford to pay for her husbands funeral.

    This is heartbreaking. The new state treasurer is a piece of work, "this is pre-Dale" and then the chuckle. Your predecessor screwed up and you chose the easiest way to try and repay it, on the back of senior citizen retirees. Joe didn't "age out," he died delivering auto parts, when he should've been out fishing or sitting at home reading the newspaper.

    The State should have completed an investigation to determine who made the mistake and why they made the mistake for every year for a total of 17 years. Given the total failure of the State, they should eat this debt and if they want to recover the money, they should recover it from the people that made the mistake for every year of 17 years!     I am a retired lawyer and find this shocking. This honest, hardworking retiree should have hired a good lawyer and sued the city for abuse of their authority and violating his civil rights. All the resulting bad publicity would have forced the city to mediate and resolve this for pennies on the dollar.

    Are you sure you're a lawyer? There wouldn't be a civil rights claim here, they'd just be looking for injunctive relief. A judge can dismiss the debt. That doesn't mean they will, but they can, in theory. And the action would be against the state, not the city. The problem is the law is technically on the state's side. If a judge rules, it will be for the state. Their hands are tied by the law. This needs to go in front of a jury, and your play in court is "Jury Nullification"... that is (for any unfamiliar with the term) when the jury decides to disregard the law in their verdict. Juries do have that right, but it's very, very hard to pull off in practice. Most jurors don't even know they have that right and talk of it in a courtroom is typically barred, so it won't be part of the instructions they're given. No lawyer wants to take a case that hinges on jury nullification, they almost always lose. But she is sympathetic. That makes it possible (but still extremely difficult). However, I don't see this going to court, for reasons I'll discuss later. The other option is to amass public support and petition the Governor. What the President is to the United States, the Governor is to the individual state, they can make executive decisions in these matters. But they're elected officials, and if you want to take a chunk out of a state budget, the public really needs to raise the issue forcefully and relentlessly. They don't care about one headline or a 5 minute segment from a local news station. When people are talking about it for months, and they realize it won't just blow over, that's when they'll step in. Another way to go is to not address the debt at all, but rather make a claim against the state that the error (not the money, but the mistake itself) has caused significant damages to the family, and be able to show that the damages hopefully meet or exceed the amount of debt, and use any awarded funds to service the debt, or as leverage to settle without payment. That's a roundabout approach, but one that's likely to be heard at least. But that is not a route most lawyers would want to go. There would have to be some very compelling damages not mentioned in this report. I don't know that there are, but that's why she needs to talk to a lawyer. Any way you dice it, it's an extreme up-hill battle. A couple other options: Petition a Social Trust A Social Trust is a type of charity. The basic premise is that sometimes bad things happen, and nobody is actually liable, but someone is stuck with the bill. It's generally for things that one cannot be insured against, and would have no reasonable way to foresee. These are often set up by Churches, sometimes by community groups (various Lodges and commerce associations) etc. If she were Mormon, a Hassidic Jew, etc, those communities take care of their own, and likely would have chipped in and paid the debt already. Everyone would kick in $5-$10 if they could, and businesses associated with those faiths would likely donate more, or host some kind of fund raiser, etc. Police and Firefighters, for example, can often get those types of benefits from their respective associations and/or unions. There are a lot of private safety nets out there, but they're usually earmarked for specific groups, so I don't know if any would step in here. A Reverse Mortgage If she owns her home (it's all paid off, and the title is clear of any liens), she can borrow against the equity in the home. Basically, she's selling the home to the bank or an investment group, slowly over time. She can continue living there and gets a check every month, while a portion of the property's ownership is conveyed to the party paying her. That means she can't sell the house, and when she passes, it goes to the company, it's not inheritable. Let's say her home is worth $400,000. She could likely get $300,000 for it, broken up into smaller monthly payments. They're buying below market value, and assuming the value will appreciate. These are usually a last-ditch move for seniors who find themselves in dire straights. It's never a good deal for the homeowner, but it could give her some income to live on, if she can get an agreement for a low repayment plan on the debt. Given that they filed for bankruptcy, this may be a lot harder. Selling Life Insurance If she has a life insurance policy, sometimes those can be sold. Name the buyer as the beneficiary. When she passes, the insurance money is conveyed to them, and she gets a nice check up-front, which could be used to pay the debt. Some states have laws against these arrangements, again, see a lawyer. Simply don't pay it. Being awarded money is one thing, collecting it is another entirely. The state may technically be owed, but their ability to actually take it is limited. They WILL get it in the end, make no mistake about that. But they could be made to jump through their own bureaucratic hoops for years trying. Not to be harsh, but she's old, and probably won't be around for many more years, and stalling on payment for a few years is easy. But do so only under the advice of qualified legal counsel. Don't just stop paying and expect it to work out. The devil is in the details, and how you stop paying matters a lot. One commentor here mentioned "Qualified Immunity". That is true, the official and employees responsible for the original error could not be sued personally as liable. But the State still can be sued. The state itself has no such immunity. "Governmental Immunity" does exist, but is not in play here. She needs a lawyer. Discovery in this case is everything. What was the original source of the accounting error? That's what matters. Perhaps it was the result of a bug in their software, and the makers of that software may be liable. We're just assuming it was human error, but it happened to 40 other people. Or they may be able to establish that government employees were not sufficiently trained and qualified, or perhaps there was some fraud that occurred, and such errors were foreseeable, and this arose from institutional negligence. None of us know what would turn up in Discovery. And the fact that they likely won't be able to produce records going back 17+ years means a court could at least justify limiting the debt to a period in which records can be produced for verification. Make them show their work here. Get all the records, and if anything is missing from the production, fight them on it. This isn't the type of case that ends in a stirring courtroom argument from a talented attorney. These cases are won or lost by document requests alone. Realistically, this would never see a courtroom anyway. It won't be dramatic, it will probably come down to a sharply worded email from a paralegal, lol. Anti-climatic, but a win is a win.

    Regular black peoples don’t have the resources to hire a lawyer. White peoples are clueless to what we go through everyday. Our lives are held in the balance everyday. I’m working really hard to never have to go to the hospital, because most black peoples don’t have a chance in the hands of a white Doctor. My son delivered his baby at home, because of the trauma they went through with other pregnancies. So buddy, easier said than done. We are an oppressed people on every side. Only our Black God can save us and his chariots.

    I cried when I saw this story. This is completely wrong. ANY AND ALL errors the State made should be PAID FOR, ie; ABSORBED BY THE STATE...shame on them. The funeral parlor that donated the services is a blessing for sure. God Bless this lady and her family, I will pray for them everyday 🙏 .

    As a 67 year old retiree since 2020 at 65, hearing about this news story saddened me. Although, I worked in the private sector all my life, this could happen to someone in the private sector. Stress from this and Mr. Glenn having to go back to work in his 80's most likely took him on to glory. 😢 😭

    Alot of this is not an mistake. They change the algorithm/ formula to pay people less and they enforce it retroactively. Social security does it all the time and say they"over paid" but then say in the letter once their debt is paid, they will go back to getting the original amount.

I think a younger person would have known right away to take the state to court and would have had the energy and fight to help them see it through.     I don't have the words to describe how angry I am. So because of their screw up, they ruined this family. Imagine being in your 80s and instead of doing fly fishing or traveling to visit your great grand kids or tending to your garden, you're hard at work, trying to pay back a debt due to an error that was no fault of your own. How were they supposed to know the state screwed up? Usually with stories like this, I listen and say, "Ok, here's how I'll make sure that never happens to me". But in this case, I'm not sure if there's a lesson here. The man going after these people is evil, plain and simple.

    Not counting interest accrual, $241K over 17 years is about $1,181 per month. The benefit letter shows $1,719.01 , that mistake = 68% of the benefit received. Joseph probably knew something because he contacted the retirement system and retirement system confirmed with that benefit letter. He did his due deligence and his widow should not have to pay back that money.

    We make decent money, but I don't see how we will be able to afford funeral services. My dad didn't have one either, worked his whole life, had insurance, homeowner. Life in the US is expensive. Pensions like this don't even exist anymore. My mom won't either. That said, I do feel it was greedy of them. It went too far, these things do mean something to some people.

    The company I work for overpaid a retiree $160,000 for 20 years. It wasn’t discovered until after his death, when his wife started receiving a survivor benefit. Per IRS rules for qualified retirement plans, the company has to make an attempt to recoup the overpayment (plus interest). However, the company wrote off the debt by paying back the retirement plan trust the overpayment amount. There was no way his widow could have ever paid that back and the overpayment was a company error.

    When you owe a debt to the government, your funds are automatically garnished. Any direct deposit is automatically taken out to pay the debt. The only way for her to get money would be to accept cash only, but if the state and IRS finds out she hasn’t been paying taxes or her debt with the cash then she’ll have to deal with both the state and the federal government. And in case people didn’t know the IRS has the right to sell your property to get you out of debt, it happens many times where the IRS will sell their house they owned for generations to pay a debt owed. We army soldiers deal with this debt crap almost every damn pay check where we get overpaid and then we get a debt that we pay back.

    There is no way for anyone to find out they're being overpaid. As the video shows the state had been saying for years the amount was correct. Who else would have any idea? The way retirement amounts are calculated are too complex for outsiders to rely on.

    I retired early from teaching in North Carolina. The pension process is so unbelievably complex and confusing that ultimately you simply give up trying to calculate using their formulas and just fold to whatever the state says. I have no idea how they calculate my tiny pension check and don't get me started on the bizarre insurance coverage. My heart goes out to this lady.

    I received a check every month from the VA for 5 years. I got a notice in the mail that my disability check should have never been approved. The next day I received a bill in the mail from the VA. I owe the VA 80 thousand dollars. The sum of 5 years of receiving the checks. I will be dead before the bill will be paid. I payed a big price for serving my country.

    The people in the government is so money hungry and heartless at times. This story is so heartbreaking. May this man rest in peace and his wife gets justice. Life is so unfair at time It’s extremely sad they had to pay for someone else errors smdh.

    How terrible!!! They made the mistake but they wanted their money back but if they shorted THEM, they wouldn’t have even bothered paying that poor couple back!

    The state was supposed to take that as a LOSS since they made this error not go after the elderly like a debt collector 😣 #protecttheelders

    Laws should have the debt taken out of the workers and their supervisors paychecks who created and approved this amount of errors.

    Many people would know when payments are not correct but many do not. When the state tells them it is correct then this one is on the state and some a attorney should step up and take this case pro-bono. The state’s behavior is despicable, cruel, and down right evil!!!!!!!!! This woman is clearly unable to pay this back. If new legislation is required to make this right then the politicians should get off their rears and make this right. We all need to earnestly prayer this woman!!!!!!!

    I'm 54 and my wife and I are VERY worried about our future, gas and food prices rising daily. We have had our savings dwindle with the cost of living into the stratosphere, and we are finding it impossible to replace them. We can get by, but can't seem to get ahead. My condolences to anyone retiring in this crisis, 30 years nonstop just for a crooked system to take all you worked for....

    She should get a lawyer, there is no way for them to check accuracy. 17 years incorrect amount. This is disgusting, took the money for his funeral, absolutely not OK.

    They know what they are doing. The State Department can then try to access or steal a person's home or assets based on THEIR MISTAKES.
