    It seems a bit excessive to jail someone for 99 years for essentially being really annoying, whereas most other crimes (including far worse things than being annoying) don't get you life in prison. Not saying he doesn't deserve any jail time, but lots of people were really stupid when they were young. Don't deserve life in prison for being annoying.

    My good friend is a lawyer who used to specialize in suing insurance companies over injuries until she went criminal defense because she says it's more fun, she explained generally injury lawsuits aren't a matter of whether or not the plantiff will win but the size of the settlement the lawyers can goad from the insurer. The whole idea of, "how much would someone have to pay you to willingly suffer this injury" goes pretty far with the jury and the insurers know it, so they desperately try to stay out of court.

    My college professor was an orthodox jew, he had 44 Information Technology certifications, basically all CompTIA, Cisco etc, taught fulltime at a University along with Fulltime at Community College and part time at two other colleges. Wrote multiple certification books and lab manuals all hundreds of pages. My weekly homework was around 30 pages of textbook reading, Going through a lab with 20+ pages of instructions and the homework submissions were 40 pages. Not to mention the areas and cities that have a serious problem with narco groups and live in a permanent conflict such as Jalisco in Mexico, Cali in Colombia or Rosario in Argentina; Those groups don't mess around and "clean" you off the map.     Someone in Canada won a case, in the 90's I believe, that he couldn't be charged for DUI because he was drunk when he got in the car. After that case the Canada government changed the Law to specifically say that being under the influence is no longer a defense for driving under the influence.

    Actually this defense could work in most western courts: To commit a crime not explicitly stated in that statute to have a penalty for negligent behavior requires intent. Intent consists of a voluntary and cognitive element. If you are incapable of recognizing the danger due to influence of substances, you cannot form intent. As such, you did not commit the crime, as it requires intent. Alternatively, some countries say that you can not be found guilty as you were akin to temporarily insane in that you were not in control of your own actions. Therefore, even if the law states „you can’t use this defense“ you absolutely still can, as it is a cornerstone of criminal law in the western world. They’d have to put it up and punish negligent behavior as well for this ruling to take effect. As for systems where it puts being under the influence and temporary insanity on the same level: you’re pretty much effed. You can only hope that the courts ruled once already that the intent of getting drunk also stretches towards the intent of getting in the car.

This is why the jury exists, to determine what the facts are, to determine whose version of the facts are the true version. Or that they did not take sufficient precautions to prevent themselves from driving drunk.

At any rate, what you described is the so-called "actio libera in causa", which describes exactly that: "I plan on comitting a crime, but I plan on doing it under the influence so i cant be punished" - which most courts solve by doing what I described earlier: Extending the intent of the action towards the intent of getting drunk and comitting a crime. As for not taking sufficient precautions: That would probably not hold up in court as you still have to retain a degree of assumption of innocence in that regard. The Jury can't just willy nilly determine someone should have taken more precautions and therefore they are guilty. They have to determine guilt based on the facts presented to them. IF the facts state "Mr. Roberts planned on drunk driving the moment he entered the bar. The barkeeper asked him to hand over his keys after his third drink, and Mr. Roberts refused, continuing to drink heavily for the entire evening before leaving the bar and driving his car" then yes, they can weigh that in. But they cant just decide "Well, Mr. Roberts should not just have handed over his key, he should have told the barkeeper to not hand it back to him, no matter what" The problem with juries is that it turns court into a theater play. It doesnt matter what is legally correct, it matters what you can convince the jury of (at least in most cases) - that is one of the reasons why US lawyers like to take acting classes. The one binding lawyers and juries to the law is the judge who will instruct the jury to disregard certain things being said (which is hard for the jury to do, once they've heard it and will still influence an outcome) Also, a jury doesn't determine what the facts are. The facts are the facts, and they are determined by what happened. Facts are objective reality. It falls to the jury to determine what facts weigh in how heavily when finding someone guilty or innocent. And it's the lawyers job to convince the jury of their side of the argument about how heavily the facts weigh in. The judge has to see to it that both lawyers play by the rules during a hearing.
