    If you are selling via the web using a dba name are you required to register your dba name in all states where sales are made or just where you have physical presence?

    Ah yes so you'd be getting mail about the tax status and also about setting up an employer account, so you can run payroll to pay yourself.

    I am planning to start a food truck. I hope to sell my own food products from the vehicle, but I am afraid. My fear is that the people who come to get services from me will sue me for hiring another employee for my food truck because my single service is not efficient. They don't have the right to say that, right? It's something I have to decide whether or not to hire an employee for my business. Will I have to go to jail if I start this business?

    I don't see any reason someone could sue you for having employees or not having employees in this situation. Maybe if something was horribly dangerous and not having enough people caused the danger (like if someone was using dangerous equipment or hazardous materials), but I don't see that applying to a food truck or other food sales

    Great tips! I don't know if a sole proprietorship would actually be a better choice even tho it is simpler due to Liability issues. For example, if Joe owns a cleaning service as a sole proprietor, and accidentally destroys a $100,000 something, wouldn't he be personally liable (and thus his personal belongings such as his house etc would be at risk, where as with a LLC, there is a sort of separation and the business would be at risk, but not usually the personal belongings of the business owner?

    Yep that is the idea of an LLC. You can (and should) also get liability insurance for those kinds of accidents, too. Sometimes in the beginning if someone has very limited money, it makes sense to spend it first on liability insurance before getting an LLC. But in a perfect world, it is good to do both

    I am a solo developer. I hope to introduce my own commerce app but I don't have any team that means I am the only member in this business. I can't do this business by myself, will my customers sue me because I am doing this business alone?

    Well I think if someone sued it would just be because the work was not done correctly, not because there were no extra employees

    What happens is that you have rights in only the places where you are continuously making sales (like those areas / states). They can get a federal trademark and in theory get the other places, and (short answer) it creates a mess of concurrent rights

    It depends on the city, if they require all businesses to have a biz license, then yes

    Can you make the buyer responsible for sales tax?

    Hm well the buyer usually pays the sales tax but the seller is responsible for submitting it and filing a sales tax return for their own business. The time this does not happen is when the buyer is in another state (then they are supposed to pay a "use tax" on the purchase)

    In most states it is not required, but I highly recommend it (especially if more than one member) to provide a papertrail for the LLC
