Thank you for all these wonderful videos! I have been binge watching them while I research whether or not to start a POD business on Etsy. One question I have is about the Disney and Harry Potter graphics being used on shirts. When I had purchased shirts for a recent Disney trip there were a billion shirts on Etsy using the same or very similar graphics for Disney vacations. On your "5 things I wish I knew before starting an Etsy Shop" video you scroll through one while showing how to research. Is there a website that has all these graphics you see on common Disney or HP Shirts for sale to legally use on t-shirts? Or are all these listings illegal? Vacation shirts like those were a niche I was considering, but I couldn't figure out how they were legal. I actually found all your tutorials when I started researching what was legal and illegal to sell on Etsy.

They shouldn't ever have been given the trademarked for that. They don't own the smiley face, it's been around way before them and no one should be able to own 3000 versions of it. That should be pushed back against, it's wrong.

No I have never had that issue! If you have, you are likely not making the canvas large enough when you start your design. I choose a custom canvas size and do 4500 x 5400 pixels.

I was wondering about Canva too. They have Minecraft images, Mario, and the smiley faces. I stayed away from the Minecraft and Mario but used a smiley face.

I just received a notice from Etsy regarding shirts I made for Yellowstone the tv series. I'm new to Etsy and purchased the graphics on Etsy (mistakenly thought if they were sold on Etsy it would be ok). I did make the designs my own however, it was still considered infringement. Etsy removed 6 listings and left the others. I immediately went on and removed all. You are absolutely right, it's not worth losing your store. Thankfully, they didn't shut me down, but warned me about future infringements could result in my shop being shut down permanently. Thanks for all your info Cassiy, I've learned so much from you. I can't tell you how much I appreciate it.

This is such a clear video thank you for this! I am looking to launch a POD Etsy store and researching the legal considerations presently. Can you please explain whether you can use quote from TV and Film if the programmes / films are copyrighted, but the specific quotes are not? I understand that there is a grey area of Fair Use and that you can use quotes if there is an 'original spin' on them - but I don't know if this means they can be lifted to put onto clothing for instance? Hey Cassiy! Thanks to you I just started my new Etsy shop. I did use a sticker from Canva of a flower with the smiley face inside the flower on a shirt. So even if its on Canva should I not use it? Thank you!

How about changing words to songs to fit a different theme or a subject? Are those infringing copyrights? Example: Take my “bread” away or anything of the sort.

I like to have them all within separate listings because this is the easiest way to make it fully automated! If you try to add all of this stuff to the same listing, it's going to be a lot of manual work.

Thank you!! And as far as graphics being ok to use, you are able to use the ones from CF but it's your responsibility to check if it's safe to use them in your store when it comes to copyright and trademark usage. If it's from a movie/tv show then just like I said in this video, then it's not safe to use! They also may not be checking for trademarked words so make sure to check those terms before downloading graphics!

I’ll add colleges too. I found out the hard way when I first started business (printables). Don’t use any college names in title/tags and of course design.

It all COULD be copyright infringement. Just make sure to check for trademarks. If it’s generic enough then you might be fine!

Yes Etsy ads can be great but I'd recommend only advertising once you get sales so you know that you have a good design and don't waste your budget.

Thank you for this video. Question: If you use part of a movie phrase or song lyric BUT you Change part of it, is that still an issue? For example, I have seem many shirts saying "straight out of ___", which is by the group NWA. The original phrase is Compton but people are saying things like straight outtta bed or shape (in place of the last world Compton) .

Good to know. One of my designs has a smiley in it and I never would have though it'd be an issue. What about a flower design with a smiley in it or a peace sign with a smiley in it? Or is it just a bad idea all around?

You’d have to do some research to make sure, at the very least I’d just never include “smiley face” in my seo anywhere. You can always email their legal team and see if it’s infringing or not!

I have a question about how similar something can be without causing infringement. For example, say I wanted to make a shirt that said Festive AF, but it is trademarked. If I change it to Festive A.F. (with periods accentuating that it's an acronym) does that make it okay to use because its not the same anymore?

I think it's a good idea to get a business credit card later on but don't let this stop you from getting started! You can even just use a seperate credit card to keep it separated from your normal spending.

If it has fallen into the public domain then you should be fine but make sure to do your research. Like Winnie the Pooh I believe is in the public domain, but only the way he looked 100 years ago. Not the more recent cartoon version of him for example. So just still be really careful and do your research of what you can do with it. Honestly there is so much money to be made doing safe boring things like teachers, I would just avoid anything like that personally.

This is super useful information! Can I use Barbies on shirts ? Anime characters? What about Marvel characters (movies and comics)? What about existing comic book characters that I've drawn with my own style? And if you want to use tweets or memes for your shirts, can you use them if there's a celebrity on the meme? Thanks!

Do you think its ok to sell shirts with cartoon pictures or line drawings of TV show characters? You MIGHT be ok if it says nothing about the show or character names but it's still a gamble you have to decide if you are willing to make. Because if someone from the show looked at it, it's probably pretty obvious that it's from the show.

If a local business wants shirts made with their logos, any leg work i need to do to protect myself? Or good to go? Like if they did something on their end (used some other company’s design i would have no clue)

Not a dumb question, these are all things I have learned over time myself. I def sold some fake locations stuff over the years but have since learned that this is covered under copyright protection. The things about books though is that some authors let you apply for official licenses to sell their merch! So if there is a book you want to design for, then I’d consider applying with that author or at least seeing if it’s an option ❤️

What would indicate that a font is trademarked on the tmsearch site? I’m looking to see specifically if the Barbie fonts (3) are trademarked, NOT using the word “Barbie”. EDITING TO ADD: turns out you cannot trademark fonts, only the name of fonts. All you need is a proper commercial use license for that font.

Trademarking the smiley face is the most obnoxious thing everrrrrrrrrr. Wow. Like trademarking the birthday song, greed has no bounds. Great informative video, thank you.

Hey Matt! I actually only sell in the US so I don't have to deal with VAT or checking for trademarks in both places. So I don't really have a good answer for you as I haven't dealt with it at all. The US market is the largest buyers on Etsy anyways so feel free to do the same if you feel overwhelmed and you could always add the EU back in when you felt comfortable in the future.

Good question! What you have produced is already copyrighted as soon as you create it and put it out there, assuming it's original work, not in common use, or in the public domain elsewhere already. Your paintings would qualify. Registering the copyright at the Copyright Office is just a public affirmation and is searchable so that others who want to avoid copyright find it easier. Having a copyright however, doesn't actually STOP someone from violating it. It just gives you rights that you can enforce. But you must be willing to enforce it, and that will cost you time and probably money. That may mean that you contact them, that a third party such as Etsy or KZread would act on your behalf, or it may mean you must go through legal channels. The question for most people is, is it financially worth protecting your copyright, or are there better options? Another option is telling others they can use your work or a limited part of it if they attribute you or pay you a license fee. If you sell a lot of copies of one painting or your name is otherwise well known and someone is making money or hurting your reputation, then it's probably worth it. If anything else, probably not.

But what if you bought the graphics from creative fabrica under the commercial and full POD license? For example, I purchased a bundle of Hocus Pocus svgs. Can I still use them since they were bought under the license? Thanks!

Yes it is super common for people to infringe with t-shirt designs, but you don't have to be one of them!
