A copyright infringement claim is not to be taken lightly. Rob explains the details of when you need permission or a license to use the intellectual property of someone else in your own designs. When designing your clothing, be sure to take into consideration all of the criteria that courts consider when substantiating an infringement claim.
Whether your starting out as a T-Shirt business or a clothing line, this is vital information to mull over. This applies to using celebrities or famous people in your designs, using movie characters or movie quotes, a design you pulled off the internet, or a design you created originally that might be similar to another brand.

    Huge department stores like Target, Walmart, Kohl’s, JC Penny’s, etc are NOT doing it illegally. They’re not stupid. Read my recent post about fraud. It’s something you want nothing to do with. Attorneys fees are $$$$$$. You will lose and they will take everything from you. Imagine if someone stole something from you and was making lots of cash off it. How’d that make you feel? It’s wrong. They’re seriously cracking down on this fraudulent industry just don’t do it.

    This is all well and good, but every t-shirt marketplace is like 70% copyright infringement material. Does anyone ever actually get in trouble? Or do the designs just get taken down?

    if you are using copyrighted material to generate profit then you are definitely going to be sued, but if you are printing a copyrighted material for you own private use then you should be just fine.

    @Ysr Aks I get that, but I also don't think that justifies it. I mean, its the age old "if everybody else was jumping off a bridge" thing. I am an artist and that also makes "stealing" or copying others' art very easy, but I never would because it's wrong. I would never feel right about it. But people who can bend their morals tend to make more money lol so oh well for me 😅

    @Ysr Aks fair use is a legal defense, not a law. there's a lot of "parody" designs and straight up copied designs on the internet and most of them won't get sued bc the big companies will not bother wasting their time on them. however, if the possible monetary gain is big enough, they can definitely sue you. so basically, they usually have bigger fish to fry until you become the bigger fish.

    I have seen many KZreadrs put their names along with other IP's on their merchandise and wondered if it was legal for them to do it. So apparently, most of them are flying under the radar and are on borrowed time with selling their merchandise. This video made everything clearer, thanks!

    What if a photo of my sister as a little girl got on the internet somehow and became a meme, then another woman falsely claimed the photo was of her, and a clothing designer put the photo on a t-shirt and sold it without my sister's knowledge or consent? I'd really like to know, because that's a true story.

    Contact a lawyer. Videos like this are good for getting a very general idea of what may or may not be legal, but if you've got an actual case contact an actual lawyer because it always depends on a wide variety of factors. But if the story is true, and you have the means to prove that in court, you have a very good chance of winning the case and getting paid damages. EDIT: Also, just out of curiosity... is it the girl watching a house burn down with a smile? :D

    as an artist and owner of a brand, the prestige i get when people buy my shirts because they like it is really satisfying. I know each time i get an inquiry they're not there just because of some popular character i put up on my shirt but because of my own creative inputs

    So I am curious if I created a design for one of my shirts that is similar to another companies t-shirt designs and i had literally never even heard of them before. Some elements are similar and it be potentially confused, they are claiming i copied their work.. How would you handle the issue? They had been selling their design longer than i have, so not sure what to do other than check with a lawyer potentially.

    So, if I make a collection of Sonic pins but with an original design that nobody has used, one with Sonic, one with Tails, and one with Knuckles, and sell them online, would I get sued? It's really a grey area. Should I contact Sega for permission? Or should I go along with it, just with a company that sells that type of stuff

    so for example a brand name is called " strike first TM" and if i wanted to use that as a phrase on my tshirt brand, can I put "strike 1st" followed by my brand name, can i do it since its not the same spelling?

    My experience says, it’s better to create your own characters or copyrighted work. The amount of money you make by infringing is too little and the risk of losing money due to a lawsuit is much higher. But with your own IP and some patience, you will make the most money! And of course you can get permission but it’s easier said than done.

In fact, using CC and other FREE images commercially can pose the MOST financial liability to end users* . If you choose to exploit these FREE image licenses in your media, you’ll have to conduct lots of due diligence to verify the copyright author or claimant and provenance of the image: Does the person who uploaded the image have the legal authority to place the image on these FREE sites?

    Would it be a copyright infringement to use a phrase from a seminar video on a shirt for sale? The videos are allowed by the original source to be reproduced by anyone as long as it is sound only (can be animated, add background music and unrelated scenes, etc., And cannot exceed 15 minutes in length). I would like to pull a sentence or short phrase to put on inspirational t-shirts for sale.

    If I use a quote said by a celebrity in an interview (not in a movie) and put that person's name below that (I want people to know where I got the quote from), would that be wrong?     I want to create some t-shirts with quotes from The TV show Maude back in The 1970s. There's about 32 words in the quote. This would be my first time ever creating t-shirts with quotes. So I'm trying to find out if I can use the quote? And what if I remove some of the nonsensical words would that make it not being a full quote?     Copyright only applies to things you’re trying to sell. If you don’t try to make money from it, you won’t get in any trouble. How would they even know? Any art with a copyrighted character would be considered copyright because the character isn’t yours, regardless of how fire your design is. Very unfortunate imo

    The spider-man character/name (logo) is protected by both copyright and trademark. If either the copyright or trademark has been registered with the US Copyright Office or the US Patent & Trademark Office, Marvel Comics (Disney) can get US Customs & Border Protection to intercept (and destroy) your unlicensed apparel from entering the US.     Is it legally to make/sell shirts related to a KZread/music artist? I saw someone recently selling ‘corpse husband merch’ that isn’t affiliated with him at all and he doesn’t know about. They used his name, lyrics and a trend that he started (#onlyhands) all they’ve said is “a small portion of the proceeds will be donated back to him”

    Very interesting video !!! But i still have question regarding the parameters of copyright and patent process. I am a leather jacket manufacturer and have my own jacket factory but i am really confused regarding the jacket styles. For example my biker leather jacket design looks same as 100s of other biker jackets from different companies. So my question is: Can a generic deisgn be patented of copyrighted. For example evry t-shirt in the world has a round neck deisgn, so can a company go and get a patent for round neck design to stop other companies to manufacture round neck t-shirts? Please note im not taking about the brand name or any specific pattern or deisgn on the t-shirt but i am taking about the basic design in clothing. I get inspiration from a lot of online leather jackets and i want to make the same designs in my factory but obviously without the pattern or label of the company from whose website i am getting the design ideas.     Mudassir Zafar This happens all the time in apparel like the tan nubuck work boot and same outsole that a lot of companies use. You cant really do patents in fashion unless its an ornamental patent and you have lawyers on hand. I spent some $ on that and it got challenged. The attorney requested I pay more to keep going and I said forget it. I have a t shirt design like no other and it will get copied for sure

    Say I put an image and then a word such as picture of dog and then the word chow after it on a shirt would that be copyright infringement if it is not actually referencing dog food or used to sell dog food?

    I want to sell my own t-shirts online. I am aware due to copyright infringement I can't use photos or album covers of celebrities.However, if i custom draw modified images such as caricature or water colours of artists or album covers such as Prince or Michael Jackson, would that be okay to sell?

    What if you use a celebrity picture and put a black bar covering their eyes. Would you be able to get away with that without being sued?

    Awesome video! I have a big problem- I just opened a website and designed it but I can't find tees mockups. I really don't mind to buy a good mockup but I can't find one. I'm using just illustrator (not photoshop). Can you help me?

    Here's a helpful tip: On Google Images, type in "blank black tshirt" or whichever type of shirt you want in blank - but be sure to go to "TOOLS" at the top and filter the results by "Usage Rights" and select " Labeled for Reuse" or "Labeled for Reuse with Modification". All of these results will be images you are able to use on your own website. You can also try contacting the company that you get your blank t-shirts from and ask them for blank images. A lot of the time they have a catalog for this exact purpose. Other than that, if you are looking for quality blank images you are going to have to grind it out and find them through hard work. We all use different types of blanks and different styles so each individual owner has to dig deep to find the blank images they want to use. I hope that helps!! Cheers

    When you click on a font you like you’ll see somewhere that says for commercial use send email or contact the owner. Contact them for permission

    Ok here’s a good 1. I make custom patented fretboards on bass / guitars. I add sticker inlays with any color combo. I wanted to add “purple and gold” stickers on fretboard and sell them online as “laker team color fretboard custom designs”. Here’s my questions: 1. If I sell online can I add a licensed laker sticker on the body? 2. Can I include a license Lakers sticker with bass that they put on? 3. Can I show the sticker on the bass in the auction even if I don’t include it with the sticker? 4. Can I sell the guitar saying it’s a Lakers team color but not include any sticker with it and ask them to add it or include links so they can buy them online seperate? The main issue is with adding a sticker to it or advertising it as being Laker colors? I will state it is not affiliated with Lakers in auction. I plan to show pics of bass with stickers on my social media pages to attract buyers but on auctions include no stickers in pics. It is important I can write “laker team colors” in auction title to get views.
