    Anthropologically speaking, many disciplines uses special language to shroud itself in mystery and create an in-group status. That makes sense for engineering and physics where such language is efficacious. The oddity in law is that these terms are readily translatable. Great video, thank you. Dan ....I’m dealing with a case now that is coram non judice.

    Big fan of this video. Is there such a thing as deference in an appeal trial de novo? Should latin only be used when its a well grounded maxim? Three weeks ago I was pulled over and let go because im confident the officer read a motion I had written were I used latin to explain that a requested transcript was in limbo and I believe the transcript was necessary to properly file my appeal. In addition I thougt prima facia as in prima facia evidence means evidence on its face supports the claim and must be rebutted otherwise.

    i have 2 questions...1. can a court or agency get personam jurisdiction by placing a person under duress? 2. isn't the habeas corpus also for restraint of individual's liberties or property? thanks

    If you don’t reside in the location of the court or maintain a connection with the area that the court is located in, you must consent to be subject of the jurisdiction. You need to file a claim of duress with the courts when you feel you are there not on your own free will and you must show proof for it to have standing. Which should be easy enough if you are truly there under duress. Thus should void in personam jurisdiction. Also, if you feel the courts do not have proper authority to hear the case at hand, being that the claim brought against you had no in fact evidence, you can file a motion to show the burden of proof and/or challenge jurisdiction as a whole. If there is no burden of proof, there is no claim, if there is no claim there is no jurisdiction/power to overhear the case. Remember as well, a claim needs to be for an actual right enforced by law. To break it down simply, a claim is either for a loss that is under a contract, or for an injury due to negligence. Regardless, when challenging jurisdiction you must back up your statement with some case law to ensure the proper steps are taken by the courts. Never proceed until jurisdiction is proven on and for the record. You can also challenge jurisdiction at any time, even during the appeals process. As far as it goes for habeas corpus, I’m not entirely sure. -I’m not a lawyer, I do not practice law nor do I pretend to. Aforementioned statements above were for educational and informational purposes only- If I am incorrect in any of my statements then please for the benefit of all, correct me. Although my studies have found that the information I presented is completely accurate.

    What's the Latin sentence/phrase for when a man fixates on one thing that someone else is guilty of, and he uses that as an excuse/justification for him doing (or refusing to do) a bunch of other things (which are unfair or harsh toward that guilty someone)? How would one say this concept in Latin? This scenario I described here is a common one. As you've probably seen yourself, it happens a lot in interpersonal conflicts (and court cases). I've been trying to see if there are any Latin/Law professors who would be able to answer this. Please share this post with someone who would be very knowledgeable about this. I mean, "the punishment doesn't fit the crime" is a bit similar to this scenario but still pretty different from it. I'm talking about when someone puts one thing on a kite (figuratively speaking of course), and runs away with it, and tries to see how high it will fly and how far they can run with it.

    Thaat is a good question. Particularly when a policeman commits tresspass, battery and theft and then seeks to prosecute the victim. I have been searching for a term to describe this. It is bringing a cause of action for an improper purpose. Barratry perhaps?

    No, a deposition is a lawyer asking questions, a court reporter recording it, and at the end of the day, it's all under oath, and that is what gets used for or against you. That is testimony. In a deposition, we ask questions and get responses. In other words we "pin people down into their positions." We use that as we need to. Great response, thank you!! SV
