19-year-old with special needs brain dead after being beaten in jail

According to the Harris County Sheriff’s Office, Fred Harris was beaten and stabbed by Michael Ownby, 25, in a holding cell on the third floor of the 1200 Baker Street jail around 11:16 p.m. Friday.

    I'm confused as to why he was in jail in the first place if he was special needs. Isn't there a protocol to place people in a facility if they are not of the right mind? This is so sad

    @@ladywed2699 he had an intellectual disability, not a learning disability, they are worlds apart, he had an IQ of 60 something, there are protocols for ppl like him but they weren't implemented, and now he's dead.

    That’s probably why the mother all of a sudden somehow “cares” but couldn’t somehow take care of him and had him in a group home. Looking for a payday. Sad. I’d take my child over money any day.

    He was in jail for Showing a knife to someone he was scared of. I understand that is unacceptable, but to have him in jail when he has special needs…how about the right way and send him to a psych ward until his court date?

    To those who have not been to jail: Certain jails can be DEADLY places where there are NO rules and morals. Beating and fights are almost a 95% guarantee and alot of times jail staff literally turn a blind eye. Someone who is weak or disabled can be seriously injured or even killed in jails mercilessly and it would be seen as just part of "jail code" while on the outside a normal functioning human being would call it attempted murder. Some jails can be a literal jungle where you have to literally fight to survive.

    They are taking disabled people and just throwing them in jail with violent felons disregarding the fact that they have intellectual disabilities. That man did not know how to survive up in there he had the slightest clue there's no way he was going to last up in there without a support system. This is very disappointing.

    It's more common than you would think. Cook county locked up a old guy with dementia for 45 days(not county days, but actually 45 days) because of trespass which normally would be 24 hours in jail. The old man would get highly confused when he talked to Judges, state DAs, and his state lawyer. It took one last judge 30 seconds to see what was wrong with him and let him go.

    Don’t blame the judge. First he had to be arrested before you see any judge. Plus We don’t even know if he had already been to court. Blame the officer that showed up to the call and decided yea it would be a good idea this take this young man to jail

    Sometimes the state looses funding to help special people like this. Also they shouldn’t be going out in public alone. Being unsupervised by there family. To remind them not to break the law. Real easy. If you break the law? You go to jail 🤷🏽‍♂️

    How can someone with an IQ of 62 be charged with a crime? The group home also bears some responsibility for his death. If they felt their residents couldn't safely use knives, there shouldn't have been knives around the residents.

    It seems like the arresting officer, the district attorney, and the probable cause judge failed him. Then hes been in jail for awhile so more than likely if he'd made it to court he would have got time served. Never made it. They let the wrong ones go and keep the wrong ones!!

TECHNICALLY, experts say Chris Benoit had a very low iq from brain injuries and we knw how that ended. GRANTED, Benoit was like 240 lbs of solid muscle and I am sure the roids did not help his condition. BUT, just for context cause you asked how can someone with an iq of 62 be charged of a crime? So I was giving a possible example. Again, I agree with everythibg you said and this poor kid was bullied.

The facts are the young man(adult) was in jail because he threatened someone with a knife. He was put in a cell with a much larger man, this happens all the time, and the bigger guy killed him. It's tragic, but not at all uncommon. There are a lot of people in jails, and prisons with low IQs.

    Something isn’t sitting right with me because 1. Why was a special needs person in jail, 2. Why was he in a cell with one bigger then him, 3. Why would he need the knife for protection unless something was happening to him in the cell and 4. How did he even get access to the knife?

    That prisoner knew he was intellectually delayed. He killed him he felt his life/safety would be overlooked. Looks like he was right. None of the officers heard a struggle? Felt the need to keep an eye on him? This is sad. Just sue the city. Looks like taxpayers dollars are only being used and enforced for certain people anyways.

    Not only did the prisoners know that he was delayed but the police knew it too. I feel like they get off on killing the intellectually disabled and mentally ill.     Idk why he isn’t being charged with 2nd degree murder instead of just assault but the police are primarily to blame for this. They put someone mentally handicapped in a prison where he didn’t belong in cell with a man nearly 3 times his size with a history of violence and expected nothing to go wrong, failing to move him to a safe environment even after they affirmed to the mother they’d protect him. Sheer disregard for his well-being, the people who arranged all of that have as much blood on their hands as the killer.

    @@locochang6533 Care to explain? If a parent knowingly left a child with a murderer and the child died would the parent not be charged with negligence? No one is questioning the killer needs to pay but you seem to hold police to a separate standard where they can’t be held accountable for their actions, this boy wouldn’t have died if they’d been more responsible with his detainment. It’s literally the police’s duty as civil servants to ensure public safety so much so they swear an oath on it, this is a clear example of them going directly against that by not keeping the boy’s safety in mind.

    Police pulled my son over for a traffic stop. Arrested him and Took him to the most violent jail in the city to punish him for questioning the stop. They were trying to lock him up overnight. Fortunately we have resources. It is intentionally done. This has been happening for a long time.

    Mine will turn 22 in January and he has Aspbergers & Autism w/ severe anxiety and he was arrested for fighting with his grandfather (who doesn't understand that Sam doesn't think, act, or relate like a 20 something adult...he's socially like a preteen & he will sleep with a knife under his pillow if he feels scared or threatened. I tried to speak with a few Deputies and tried to explain that it's NOT safe for him in jail! I was told the same thing that sweet Mother was. It's just awful to put people with mental health issues in jail because it can traumatize them! It's too loud, everyone is a stranger, medications aren't given in time (major issue!), and they cannot handle the change well at all! I'm scared for the future. That group home should have had a better way to handle situations like that!

    @@roderickahairston9935 me too. You can't be too careful these days. I know I'd catch a case if I were in some of the situations I've been hearing about. Its sad cuz my son has a heart of gold. He always speak to ppl even though he's sometimes rudely ignored. He opens doors for ppl coming/going out of store without a simple "thank you". These little things set me off because he is so kind to ppl. Fr fr, I'd catch a case.....

    @H B Did you even listen to the video the victim had an IQ of 62 and came from a group home. I case you are unaware what an IQ of 62 indicates, he had the intellectual level if about a 3rd grader and NEVER should have been in general population let alone houses in a cell with a known violent criminal! He was probably just being held in the jail awaiting a bed at a mental hospital for assessment.

    This is heartbreaking. My 17 year old Special Ed grandson was at a Halloween party on Halloween night. The officers recieved a ( shots fired ) call in the neighborhood. My grandson ran for fear of his life. The cops tazed him twice and kept punching him in the head. I've taken pictures and he has a Docters appointment tomorrow in which I'm reporting the battery by force , which is a Felony UPDATE : I have since, filed a report with the Police chief Filed a report with Internal Affairs And hired a Civil rights Attorney .

    The inmates are sick and animalistic and for folks to always blame prison officials for prisoners abusing others is crazy. Raping, beating killing others makes you barbaric and subhuman and if you will do that to a prisoner you definitely will harm folks on the outside world.     there was a girl who had special needs at my school and She was pinned down and held in cuffs. after someone reported her as some sort of crackhead around the school. when in reality, she got stuck outside and was having a panic attack, someone reported it, and the cops came and arrested her. this world has come to nothing but social standards. there’s a difference between a special needs person and a crackhead.

    This is beyond crazy! He was attacked!!! So sad because there should be different facilities for the special need. He should’ve NEVER been placed in police custody.     Apart from this video: Some people say that criminals deserve to get r*ed and beaten and killed in prison, and encourage police and guards to let it happen, but when that happens to someone they don't think deserved it, then they complain. You are either for or against it, you can't be both.

    Just an FYI - the term “special needs” is offensive to disabled people. It’s a euphemism usually used by non disabled people to describe disability because it assumes disability is a bad thing; it isn’t.

    I say I'm sorry for his death because I am sorry. Laws are great, but they don't make his family feel his loss less or make the hurt disappear. They only punish lawbreakers. Doubt there's one specific to his case too. Maybe a new law will be created to help others in his situation, but for this family, there's not any comfort to be had. So I say I'm sorry and that I will pray for them because at the end of the day, that young man should still be here with us.

    Over here in Michigan a judge let a man out on $10K bail after he shot a 6yr old through his front window for leaving his bike in his yard. Why they couldn't let him out with a ankle braclet IDK...and you're right sorry isn't enough.

    Prayerfully true angel's on earth would watch and protect over everyone with special needs especially if they don't have anyone left. I have a little brother with special needs and my heart is absolutely broken because of this story this is utterly ridiculous!!!!! What in that devil man's right mind would make him do something like that that's only satin smh!

    Showing a knife to someone you are scared of… That’s lawyer speak for having brandished a deadly weapon. Shame there wasn’t an alternative to the pokey but a crime is a crime. In an ideal world, there would have been a mental health evaluation and an alternative facility.

    @@richxnicko1932 all for seeing the attacker meet justice… just can’t ignore the crime that landed Fred in the clink. People are also saying that the white guy got away with it, yet the murder just occurred. Due process is still a thing, can’t just lynch the guy… I’ve had a family member murdered and due process takes time, even years. We ended up in a mistrial first time around and finally saw the murderer locked up the second time around.

    You know when it comes to race we haven't come to far.. Besides making segregation illegal in the USA after the 50s or early 60s.. Sad to say this but when it comes from the mentally ill, it's truly a 360 from 60-70 years ago..It scary and sad truth but that's me adding onto how we treat these people today.. The mentally sick/ill are falling behind the everyone is equal politics/way of life.. This is what happens when groups of people who wear vaginas only speak up on something that is already open and free to do aka same sex marriages... I won't include African Americana/blm, they truly have something to fight for.. The whole gay/women's rights should be standing for the special needs industry in the states.. I'm sure those kinds of hospitals breed terrible work staff, they will always be exposed to the worst that humankind has to offer. As adults we just keep it tuck inside our brains like child trafficking that happens 24/7 under our noses...

    America put anyone in prison for breaking the law I bet most have disabilities and mental illness read the law those with disabilities or say someone who suffers being in confined places breaks the law and goes to jail that would be extremely difficult you don’t want to still this kid with crazy’s ether or he will learn it my son has the same disability he learns from others bad behavior and habits he sees his brother throw tantrums then he will do it too that’s how easy for him to learn from someone else and the courts didn’t give dam about what I said the law was law even with disabilities my son was violent against me and our family but courts didn’t see what I live with and thought I abused him no I found out through court my son couldn’t have artificial dyes including cheddar cheese and dyes in ice cream and in his medications and muti vitamins that caused him to rage out in violence towards his family but again the courts wouldn’t believe me but I found out the cause and yes even during that time I called police on my son the second time the officer explained what jail was like and that woke up my son literally education is the key for kids with disabilities to show them the consequences if they were to cross the line the officer said he would have enjoyments he has right now and explained and that’s what did it for the abuse but artificial dyes was trials after trails the biggest one is my son saying no to artificial dyes even when offered I told him he’s better off without them anyways to be safe for himself and others around him. Courts put me through hell and I was innocent but parents with disabilities or parents in general that are good parents go through so much crap while parents who really abuse their kids and even murder I’m not that parent and frankly the boy should’ve been confined to his home on house arrest with ankle bracelet.

    I am more concerned as to why he was arrested in the 1st place just to find out he lived in a group home??? Why was he in a group home in the 1st place? He was a special needs kid and even his mother failed to protect him!

    @Live Action It's evident your parents did a terrible job teaching you common sense. He's a kid with special needs. They need more attention and more time learning things. Plus he pulled a knife on someone who SCARED him. If my kid ever pulled a knife to defend themselves from a threat, I wouldn't reprimand them for doing that.     He was bullied and intimidated in the group home and got a knife for protection out of fear so HE goes to jail. And gets murdered. The group home needs investigated too, not just the jail!

    This also happens in nursing homes with dementia patients. These homes call the police when a patient gets confused and panics aggressively. Then the elderly person is arrested with diminished understanding of what is happening further adding to their confusion. If they have family the family then gets to deal with the legal system and if they don't many are released out into the street, elderly and with diminished mental facilities to care for themselves or put into mental hospitals for a short periods of time and released.
