If someone has been cautious, asked for age and then asked for proof of age and they have a perfect looking fake ID that matches up to their lied age, then I can't see how the underage person could be the victim when they have conned someone who has done what they can to check that they aren't going to be with a minor. If someone intentionally is looking for someone underage then they need to be locked away for a long time, but if someone is doing everything they can to ensure they aren't seeing someone under age, but they have been conned then it is completely different matter.

    As much as I am against the hookup culture. What that judge did was WAY TOO FAR!!! You're deliberately going to impose an excessive punishment on him just because you disagree with his actions, want to "teach him a lesson," and make an example of him. You're basically ruining his life before it even begins! You don't impose your beliefs on someone, no matter what they may be, by abuse of power and excessive punishment! Absolutely unacceptable!

    I had something similar with cannabis. My life was essentially destroyed for possessing cannabis at his age. Who was I harming. The judge thought cannabis was the devils drug. And now it’s legal in more than half of the US but I still sit her as a felon.

    my nephew is basicly in same boat as this kid.he was 19 at a party with friends and hooked up with someone who turned out to be underage.judge was understanding about it cuz for real most people arnt gonna ask for an id.but years later a different judge decided to take it back to court and now hes on the list.system is messed up.

    Judge handed down a prejudicial decision. Even stated his "personal bias" in it. An appeal would have caused this conviction to be over turned. Get the judge off the bench. Parents could sue the girls family and the state for this

    When I was Deputy in Orlando, we had a guy in a bar drinking. He met a girl there who was also drinking, so safe to assume she has to be at least 21. Takes her to a motel, then fast forward. Turns out she is 16 and OPD arrested him and then they sentenced him to jail and sex offender status. Bar did not get in trouble for serving minors, because she had a fake ID. As far as I know, she never got in any trouble either. Now just exactly how was that guy guilty of anything? The law has to be about JUSTICE and should be flexible and open to interpretation, not just about blindly sticking to the letter of the law like a malevolent robot.

    Let me get this straight: 1. Serving alcohol to minors is a crime. The bar didn't know she was a minor due to fake ID. No punishment. 2. Having sex with minors is a crime. The guy didn't know she was a minor due to fake ID. Goes to prison. WTF??? Like how was he supposed to know? Pornhub is full of perfectly legal "petite" chicks that look 12 or something.     Also in the Bible both parties paid the consequences. So if they're not going to do anything to her, his sentence should be lighter.     I heard a story about a nine-year-old girl who was molested by her father and repeated the behavior on her younger siblings, as she was told it was normal by her abuser. She's now a registered sex offender for life. There needs to be a distinction made between sex offenders who are violent, sadistic rapists and sex offenders who got caught taking nudes of themselves when they were seventeen. Otherwise, justice is poorly served.

    i was arrested in 2007 for similar reasons. at the age of 27. in my instance, my only crime was being in a 21 or older byob bar and giving a ride to a girl. i dropped her off at the house where she slept with her 21 yr old boyfriend. turns out she was the 15 yr old daughter of the DJ. she didnt want to get her boyfriend in trouble so she pointed the finger at me... i spent 2 yrs on a 75k bond. my grandmother had to refinance her home to pay the bond. we spent thousands in legal fees and i too ALMOST ended up on that predator list... there needs to be moree protection of men, instead of just throwing them under the bus every time.

    I feel like you're the hiding truth in your story. Why did you get in trouble, what do you mean she pointed the finger at you, how is it anything to do with you? What does her being the dj's daughter have to do with anything, or do you mean she was there when she shouldn't have been simply because she was the Dj's daughter? How did you not know the difference between a 15yo and a 21 yo? Why were you driving her around?     He doesn't care. They think they are gods. A judge tried to take my daughter away because I'm in drug treatment but had been off drugs before I got pregnant.. And all I had was a public prosecutor so I was almost shit out of luck if the drug program hadn't stepped in and told him he's breaking a federal law and if they do this this will take him to the supreme court. Thank god for those people! Uneducated old ass judges that are mad at society and how the world is changing and are stuck in the good ole boy system..

    I’m 23 and work in a grocery store as a cashier. Most of my customers think I’m 16-17 and they always asked if school has been canceled for the day b/c I’m at work. It’s not always that easy to tell someone’s age from the way they look….

    There is a big issue with what the judge said. He said he was sentencing the way he did because he disagrees with hookup culture and said nothing about the age difference. Hookup culture is not illegal and his opinion of it should have nothing to do with this teen’s punishment. I can’t believe the lawyer didn’t cling to that for the appeal.

    I caught that, too. I am in 100% agreement with his position on hookup culture, but that has zero basis on the case. That judge should be removed from the bench, and disbarred, permanently. He should also be jailed for the same length of time that the young man was jailed. I wonder how many other people he convicted for violating his personal morals? Every single one of his cases should be reviewed.

    Just a little update for you guys: He was taken off the sex offender list, the parents started a petition and gathered over 200k supporters. I am happy Zach can now live life how he deserved but disappointed that they didn't take the charges off immediately when the daughter and mom even said it wasn't his fault.

    It's sad that the law actually does work that way. Even if the girl showed you a fake driver's license that said she was 21, you can still be convicted if she's actually underage. In many states, THERE IS NO LEGAL DEFENSE if you are catfished by a minor, no matter how many efforts the minor took to conceal/misrepresent their age. If you two had sex, you're guilty, regardless of the facts and circumstances.

    well why not honestly.. it would be smart. And done jokingly it would not even be such a turnoff. Were I to raise a son, I'd tell him to jokingly get proof of every girl's age. You could do that in a non-serious manner, like when you're out and she's presenting a licence for getting a drink "hey let me see that picture of yours" (of course when jumping into bed 5 min after meeting that s difficult..). And the law, you have to admit, actually makes sense if you consider young immature girls. They ARE frequently preyed upon by much older guys exploiting vulnerabilities (trouble or neglect at home, developmental delays, intellectual or mental deficits, drug abuse, sexual abuse at home etc). This guy is the atypical older guy with sexual relations with a minor, and considering the facts of the case it is right to give him a much more lenient sentence. But not all of them, by far, are "good guys", on the contrary.

    The judge technically followed the law, except the law is messed up. A minor already has no consent so that means that they cannot fight it court it’s already settled. It’s horrible saying that she lied.

    She lied to his face about her age. She lied on the app about her age, she wouldn’t of been able to talk to Zach if she didn’t do that. If she didn’t lie about her age multiple times, this wouldn’t of happened. Whilst a 14 years old can’t fully understand or consent to sex, they can understand lying and why it’s wrong. There are 14-year-olds who understand college-level math, various fields of science, etc., including rocket science, and sex isn't exactly rocket science. "or consent to sex" In Indiana where this story took place, and in many other states, a 14-year-old can legally consent to sex with someone who is 17 years and 364 days old, but not with someone who is a day older than that. In other words, it's arbitrary.

Now it’s 16, anyone can sex with someone 16 years old and over in many places. It’s not right but still somehow the law.     This reminds me of a case where a young girl used a fake ID to get in to a bar, and met up with a guy who was of age, still with a fake ID. He got the minimum sentence and the judge, as with the rest of the room, shared their condolences. I think it was something like 3 years.

    ​@@marge2548 Still didn't help tho. No one likes to admit it because to do so is to admit that the system is flawed, but that sort of detail has an unconscious effect on jurors. Most jurors don't think in terms of reason, inference, logic and probability because criminal cases are often quite complex -- and quite frankly boring, so most jurors analyse the case as a story. Any detail in their story about a playground in a case like this can easily trigger the wrong instinct.

But I am not from the US) It’s not as if he was lurking there in order to pick up kids, he went to a dating app for grown-ups and expected to meet a grown-up person. And I commented elsewhere that the place they met in was her hometown, not his, so it’s reasonable to assume that she told him where to drive, as he would not know his way around town. But I suppose you are right: I am reasoning all the time, and many other people will rather not do that.

    @@marge2548 It might be a Western thing due to sheer average length of cases. I’m not sure. I just know that criminal trials are for the most part, an absolute snooze-fest. They take forever. Most of it is boring legal talk. It’s painfully detail-oriented & demanding fortitude; the intricacies of forensic evidence. There will always be a good few on a 12 man jury that are just flat-out bored by scientific, clinical subjects - and then some of those jurors might be unflappable in deliberation. In the post-conviction documentary about Daniel Holtzclaw’s trial (police officer accused of like 15 cases of SA,) jurors openly admitted to tuning out pretty much every time a geneticist opened their mouth about the DNA evidence (which was quintessential to the case.) If science bores you, you basically have 2 options in cases like that; trust the academic authority, or go off who spins the better narrative i.e. which legal team is most competent at gaining your attention. So, when the prosecution is gifted the arsenal of an interesting narrative that dwells around the threshold of reasonable doubt e.g. sinister creep brings underage girl to playground to make her feel comfortable, or handsy police officer abused his power to target black women (Holtzclaw,) it can have a profound effect on jurors uninterested by forensics. OJ Simpson is another classic example. The defence team was quite simply more entertaining than the prosecution. It’s human nature to think in stories and simplify, and furthermore natural to be drawn to the finer yarn.

(And yes, I am female and I do have kids). Furthermore, I took it (as I commted elsewehere, too) that he visited her hometown, instead of the other way round.     @@sarahgrace3760 The only example this is, is of how you shouldn't trust anyone, let alone the Judicial system. He's being punished for her lieing and the judge's personal moral beliefs. The Judges moral beliefs should never be a factor in court of law, his job is strictly to interpret the law and deal out punishment in according to the law. The guy is the victim in this case, other than being tricked by a lie, he broke no laws. So he shouldn't be getting punishment for it, even to be an example.

    Why is this 14 yr old female not facing legal repercussions for fraud. She Misled him. And where were her parents, they should have warned her away for Dating sites where you have to lie about your age to gain access.
