I'm starting a pet waste removal buisness. The company name is THE SUPER SCOOPERS. I did a trademark search and the name super scoopers is trademarked already but my buisness is THE SUPER SCOOPERS. Will this be an issue?

Creative take on Trademarks! If you have to send out Cease and Desist letters would you need to have a Trademark Attorney on retainer to sporadically send ou?
That would be advisable / a letter from attorney is much stronger, plus the issues are complex.

Yes, potentially. But it would require re-applying (and would depend on the specific circumstances).

I have an overzealous competitor. He won't behind my back and made a trademark name similar to my legal company name. His is in the final stages of being approved and ready to be published. I was reading the files and it says that the examiner found no conflict between the mark getting approved and any pending (mine) or any other approved marks. So the examiner did not find any conflict between mine which is pending and the one that is about to be published with it still be grounds for a cease and desist after approval legally? As another words if the examiner did not find any conflict could my competitor tell me to stop using my company name once his mark is approved?

I just got a call from a Trademark scammer. TWO things to watch for: 1. A long speal blab of technical jargin. 2.) Fear of being sued when someone steals your name of logo and someone sues them- you get sued. 3.) Pay now a fee 435.00, then $300 per whatever. Next, 4.) give us your credit card number. I told HIM to rot in Hell and with some other slanderous foul jargtin about Him and his Mother! They hung up. I called back. They did not answer. I left a worse message on the message machine. It's funny though, they used a real return phone number and not a Phone ID cover up. I've been getting 100s of scam calls ever since a date way back years ago. Seems my Phone Number has been sold to every scammer opperation around the world. THIS is just ONE in many that appear to be a Global Criminal organization. Over 350 billion dollars a year is scammed from innocent people. Our US government seems to not be doing anything about it. The major phone companies like T-Mobil, Sprint and other are not doing anything about it. I have a solution but NO ONE seems intereasted. if you are, ERIK?, please contact me. It is possible, in the US, to apply if you have a bona fide intent to use a name. But in order to complete the registration process, an applicant needs to show use still although they may have up to three years after the application receives initial approval.

Great information! If the company is a service company and going to sell t-shirts (paraphernalia) with logo and slogan on it; would they have to trademark in 2 classes?
Possibly. But it would seem likely that the service category would be much more important.

If you have a trademark and want to add a slogan, would you apply for the slogan by itself or with the existing logo with the slogan under it?
It depends on how they are used - but generally protecting them separately gives you better (more flexible) protection.

An interesting statistic I learned from a Lanham Act 75th anniversary celebration video released by the USPTO that I watched in 2020. According to David S. Gooder, Commissioner for Trademarks... Since the Lanham Act passed in 1946: The USPTO issued 6.3 million registrations and 2.76 million live registions (by 2020). 76% of those active registrations are owned by solo filers and businesses who own less than 10 trademarks. The 30 days is from the publication date itself, which maybe a few weeks after the approval for publication.

Hey Erik. Because KZread prioritizes who can apply first, why are trademark protectons (if you own a registered trademark for example) not protected on handles? In other words, why can I not claim trademark infringement on a handle and get the handle?
This is a complicated area. If the user of the handle is competing with your business and the handle is the same as you registered trademark, then there might be a claim.
