Good to mention that the US embassy was occupied by the revolutionary extremists and the government was unable to control them due to the lack of will and management.

Did Harlan's newfound precedent of the 'presumption of constitutionality' to an extent abdicate the role of the Judiciary?

The closed captioning spells the Seila case incorrectly. If you are searching for the case, it is Seila Law LLC vs Consumer Financial Protection Bureau (2020). Also, they were right to bring up Presidential impeachment in the context of the independent counsel controversy because it implies a problem I have always had with Scalia's dissent. I think he is correct in his assessment of the separation of powers, but impeachment would change that calculation in a significant way. If the House of Representatives does explore articles of impeachment, surely the formal accusation would be preceded by a formal investigation. If the independent counsel is part of this investigation, then it would not make sense for the President to be able to interfere with that investigation by firiing the counsel at will. The House must be able to investigate the President in preparation for articles of impeachment in such a way that the President cannot simply destroy the investigation.

It's a shame that the Eleventh Amendment had to be skipped because it drives me crazy. Because of Hans v Louisiana, people repeatedly claim that the amendment prevents citizens from suing states in federal court. But the plain text of the amendment only forbids citizens from other states from suing; it does not forbid citizens from suing their own state. Of course, Justice Kennedy would later claim that states are protected from lawsuits because of their inherent sovereignty without relying on the Eleventh Amendment at all. I really wish there could have been a discussion on this important amendment and how it has been misinterpreted and misapplied.

At 19:08 the professor gives the answer he asked earlier about how the Judicial Branch could be described as the least dangerous branch since they seem to have the last word on these questions. Without Congress and President Eisenhower's actions, the Supreme Court's decision would not have been effective.

Thank you so much for making this available! You explained this better than Justia, Quora, and even the esteemed Cornell Law’s Encyclopedic Online Resources Page ! 🎉 ⭐You were BORN to teach!! “Substantive Due Process” was eating away at my soul. Everybody that tries to explain it only uses one example (i.e., Abortion) Most of the information out there is people's (hyper•polarized) OPINIONS on ‘SDP’ rather than a measured, collegial, unbiased, honest explanation of the issue. I now feel like I can explain it someone else. It's definitely a--somewhat oxymoronic--misnomer of a term. But for future students, what REALLY helped me was when you were wrapping everything up and rounding the corners: YOU LOGICALLY AND RATIONALLY MADE SURE TO DRAW THE CONNECTION BETWEEN HOW SEEMINGLY DISCRETE LEGAL TERMS MAKE MORE SENSE THROUGH THE LENS OF TWO PAIRS OR RELATED GROUPINGS OF LARGER IDEAS 💡 👇🏾 •|| »» FUNDAMENTAL RIGHTS »» STRICT SCRUNITY » ENDS vs MEANS»» = NO 🚫 (reasonable) 🚫alternative but to infringe on the F-Right with direct linear not circuitous causality (i.e., Pedophilia/Consensual Procreation-->Police Power to Save Children) 👇🏾💡 •|| »» RATIONAL BASIS »» “DEEMED” NON-FUNDAMENTAL RIGHTS (i.e. right to healthcare) »» NO JUDICIAL SCRUTINY »||• *The Crux is, just like in 1937, the court can shorten or increase list of ‘F-Rights’ 🎯🤷🏾‍♂️ ---» THE TWO-PRONG TEST ----» 👆🏾 The concept is unintelligible without understanding the concepts of “F-Rights” <<<<<<<<<<<<>>>>>>>> Anyways, I'm off to Law School next year but still retaking the LSAT. Hopefully, Antonin Scalia School of Law GOD BLESS !

Tyranny is by far the worst war crime...and if you take a man 2nd amendment rights away...We might as well go back to the 1770s or 1860s...it's 2023 defend your country Men against tyranny please God willing...
