  W.r.t. first question sir, The first wife (aggrieved person) has the right to file a complaint within India against the husband u/s 198(1) CrPC. The court mentioned u/s 182(2) CrPC would have the jurisdiction to try. Finally, S. 3 of IPC makes him liable to be prosecuted within India as he is a 'person liable by any Indian law to be tried....as if such act had been committed within India'. If you don't want to apply S. 3 of IPC, then S. 2 IPC can also be applied bcs it also applies on non citizens committing an offence beyond India if the consequences are ensued in India (bcs the wife in India is getting affected). Refer S. 2 of IPC r/w S. 179, 182(2) & 198(1) of CrPC.

That's why I'm saying that in this particular situation S. 4 IPC will not apply... reason being that this is an offence committed against a citizen of India while the victim was in India.... there's no question of Sec 4 being applied here. Sec. 3 IPC will apply here..as it applies where offence is committed beyond India but by a person liable by any Indian law. Would you take away the right of the first wife given u/s 198(1) crpc merely because the perpetrator is not a citizen anymore? She will still have her right. That makes the husband a 'person liable by Indian law'. This situation squarely falls within the four corners of Sec 3 IPC.
