It should be really easy to comment from Denmark about how Turkeys social, civil and political structure works. I agree on army’s interference on politics is not the most desirable thing for a democracy. But unfortunately we are not talking about a Scandinavian country here. If there was no army to cast a shadow on civil politics on Turkey for decades I believe we couldn’t talk about a “modern” Turkey as it is today. On theory full democracy is what we want aswell but the reality of our conditions are way more different. There is a reason why Turkey didn’t end up like Iran. And that reason is simply Kemalism.

It seems this is not a so called arbitration. Arbitration is a procedure in which a dispute is submitted, BY AGREEMENT OF THE PARTIES, to one or more arbitrators who make a binding decision on the dispute. If one party never agreed to go to the process, then no ruling should be followed. Not sure if all 8 minutes of blah blah means anything.

The Convention, however, expressly acknowledges the possibility of non-participation by one of the parties to a dispute and confirms that such non-participation does not constitute a bar to the proceedings. Article 9 of Annex VII provides: Article 9 Default of Appearance If one of the parties to the dispute does not appear before the arbitral tribunal or fails to defend its case, the other party may request the tribunal to continue the proceedings and to make its award. Absence of a party or failure of a party to defend its case shall not constitute a bar to the proceedings. Before making its award, the arbitral tribunal must satisfy itself not only that it has jurisdiction over the dispute but also that the claim is well founded in fact and law.

It depends if the award is given against a private party or a state. there are enforcement mechanisms. more complicated in case of states. also the award is local or foreign.

2003 Coup d'état allegations were utilized by the alliance of Gulen(FETO) and Erdogan to break the power of T.S.K. and the principles they stood for. The system of justice and rule of law was torn down by these bunch of CIA-controlled "mild-Islamists" aka. Gulenists, for prosecuting officers who did not have any "crime" other than not being CIA-controlled and being anti-imperialist. Having counseled clients on many hundreds of international deals, I have never ONCE seen a dispute resolution clause that specifies ICSID as the dispute resolution forum selected by the Parties. Nor, I have a ever had a client (or counterparty) request ICSID as the forum for ADR. It is not clear to me WHEN, WHY and under what circumstances a party SHOULD specify ICSID (versus ICC, SAIC, BANI or some other ADR system). As it relates to Indonesia specifically, I have not seen ONE case where a private party WON a dispute at ICSID. Leads to the question: WHY? If ICSID is believed to be fair, and lead to a predictable process and defensible (and enforceable) Award, then WHY ISN"T ICSID more requested and utilized?

Truth of the matter is that ICSID is a predatory institution so much that US, Canada, Europe, India etc have made special laws to avoid any contact with ICSID. I Have shared a link about Pakistan's case. Find others as such, might help.

By the way, a lot of private party disputes are resolved after a submission, but before formal arbitration through settlement.
