  The current media about dr Hlophe is grossly unfair and has malicious intent; Please consider the following: His appeal for for charges has not been heard,which means that the case is still subjudicate Secondly,both parliament and the presidency have defeated the ends of justice because,why whilst his,appeal has not been finalised,both went ahead Secondly,an appeal is an inherently human right in all judicial and administrative justice,it is only in mob justice that one is denied the right to appeal The JSC cannot comment on dr Hlophe's case mainly because he is taking their appeal on review by the constitutional court,interfering with this process formally or informerly is unlawful In terms of Batho Pele principles White Paper on Transformation of Publicn Service: Redress as one of the 8 priniciples relates to Appeal and complaint if one is not happy of services one received The issue of appeal is referrred to differently by different discipline In academia scientific researches,it is called academic reviews,irrespective how qualified the researcher and or a team of researchers are in coming up with a research paper,for it to be accepted,it must undergo a review.This is similar to the process dr Hlophe is persuing The JSC,even if it can develop adminision criteria,they are not a law unto themselves,those criteria must still undergo National Assemby reviews Lastly,JSC is not above parliament and stakeholders are not elected public representatives Lastly,after developing inclusion criteria there criteria must firstly be presented to DPSA as the overal custodian for facilitation and coordinatio of judicial service standards development before they can be presented to parliament for debate and finally for adoption The service standards are never developed for a particular individual and are never applied retrospectively
