  Can you please help us Shopify store owners whom I'm finding are experiencing similar situations? The Shopify platform recommends B2B apps from their app store, which has infringement policies for the app developers. When we install the app and a someone files a DCMA claim on content/photo (provided by that app) showing on our store, Shopify threatens the store owner with suspension instead of penalizing the app developer providing the content to the page(s). Shopify suggests the app then (even with the content removed) threatens to shut your store down when the APP is claiming to have the right to share the infringed content. Shopify support only directs you to the DMCA counterclaim form but I'm not trying to reinstate the content. If the app removes the content, it is automatically REMOVED from any store using the app. I have a few days till termination of my store after years of hard work and feel sabotaged by Shopify. The app is still available via the Shopify app store, providing the same illegal content to other unknowing store owners. Should I communicate and attempt to redirect the claimant to the app providing the content? Should I respond on the couterclaim form a particular way? Please help.

  For it to be a true holding company, the holding company needs to have majority ownership, so at least 51%.

  I just got one..... over something that is only talking about a company's product, no images, no secret information that isnt common knowledge for users...... I see they have sent DMCA to multiple other people who just talked about them aswell........ I'm mad they are doing this so I want to appeal, but at the same time I really don't want the trouble if they are willing to claim a review is not fair use. If I send a counter notice and the company is crazy enough about it to take it to court or send it again, what can I do if I don't have a ton of money? Can they be liable for wasting my time and money if it comes to that?

  The law does provide penalties if someone files a fraudulent DMCA takedown notice. That person can be sued for the damages caused, along with the costs and attorneys’ fees that were incurred in pursuing those damages.

  The notice should outline it or the service provider (Google, IG, Facebook, etc) that removes your content should tell you why the content was removed (violates their terms and conditions, copyright infringement, etc).

  I have an uncle that is having a hard time getting a job. I am considering buying lawn mowing equipment to start a company so that I can give him a job. How should I start this business, buy the equipment, and hire and pay him out of the business?I guess we'll be walking door to door to get sales. And I'll probably split the income with him on the yards that we cut together. I have 2 LLC structures, one in Wyoming and one in Texas, but I have not setup bank accounts for them yet, or a dba for the lawn mowing services...(for services provided directly to the public. ) how should I structure this?   Would this apply for clauses that forbid criticism/disparaging? As for instance a sales person being unable to criticise a competitor seems unworkable - it would essentially be like a non compete clause.

  It’s not considered the same as a noncompete clause - that is considered to be a non-disparagement clause.

  If the LLC was created on or after January 1st 2024 you have 90 days left, no 30. 30 days are for LLC created on or after 01/01/2025.
