    My brother is a mechanic. He amputated his hand and it was reattached. Workers comp is offering light duty as Customer Serivce. Which he cant do nor interested in doing. Is he supposed to accept it? Fearing his benefits could be cut off?

    I am sorry to hear about your brother's work injury. Unfortunately in Georgia they only have to return the injured worker back to "some form" of work not necessairly what they were doing and as long as a doctor (usually the ATP) returnes them back to some form of work and the employer files a WC 240 return to work signed off by the employer then you must attempt the light duty job. If they have not jumped through the hoops of getting a WC240 signed off, then you arguably you may not need to attempt that job. You brother is at a critical point in his claim, he needs to reach out to a Georgia WC attorney if he does not have one ASAP. To explore his rights and what can and can not be done moving forward. Act fast and stay safe. Ty

    I have been on Workers Comp from Fedex Express since late August 2023. it took my manager over a month to let me see a doctor even though I reported the injury in good time. They sent me to a Reddy Urgent care who diagnosed me with "tennis elbow" and I was put on light duty which I stayed on till the week before Thanksgiving 2023. What I actually had was a major tendon tear which required sugery. Fedex finally got me to see a specialist who made the correct evaluation and I was put on family leave and had surgery the first week of january 2024. (coincided with running out of Fedex light duty time). It required the Dr to drill small holes into my elbow bone and reattach the ends of the tendon. Standard recovery time is 5-6 months. I have been getting weekly checks since then with no complaints, doctor visits and physical therapy, but now I am going to see my doctor the first week of July and will likely get cleared to go back to work as a courier full duty no limitations. What I am getting from my HR advisor is that they have nothing for me and would I be willing to relocate (no). I am going into work tomorrow to talk with my manager to see what's up and if they have a job for me. I have been a courier for 26 years. What options do I have?

    If your license is suspended you may want to speak with a traffic ticket lawyer. Suspensions occur for many reasons, and points are only one of them. Some charges will automatically suspend your license depending on if you plead guilty or not.

    That is very unusual. That is not a legitimate reason to fire an employee. Is your state a right-to-work state? If it is a right-to-work state they can fire you for cause or for no cause at all. Firing you for not being able to get in contact with your attorney is one I have not heard of before and has nothing to do with your employment. In Georgia they provide a separation notice and that is where the Employer puts the reason for the termination/separation. Ultimately you may qualify for unemployment if they are terminating you for reasons unrelated to your employment. Speak with your attorney about what is in your best interest based on their actions.

    They didn’t follow me they followed my mother I didn’t know until 3 years ago when I received a copy of my File. So this evidence was giving for court proceedings. I didn’t get to go to Court lawyers said I was a risk attempting to suicide spent a week in ICU I’ve been receiving medical expenses and they are beating me down after 21 years. Karen from Australia

    It is not about winning, it is about maneuvering through a system designed to get you back to work. That is the system’s goal. There are no doubts the system has its problems and issues. Remember it was created and past through the legislature of each state. No question the insurance companies had their say and the laws are written for the Employer/Insurers. They often get to control your medical care. That said you can be successful in getting the care you need paid for by the system and get back to some form of work, sometimes it takes a little luck. Stay positive in light of your situation. Your loved ones are counting on you.

    If you have an attorney for your claim they should be making sure it is in the settlement agreement. If you Google search what is hartman language in georgia workers comp it will give you more information. In short it will protect you as the employee from losing SSDI benefits. It basically a breakdown your settlement over your life expectancy. That is the important part. I hope that helps. Ty

Because I was dismissed and have not received TTD benefits can I apply and collect unemployment benefits. I asked my attorney and she said no. How is that ok if I was dismissed and I dint have any cash flow,

    ⁠@@michaelkreisel3573I am not sure it is illegal it depends on many things. Like are you out of work completely? If so you will have a difficult time qualifying for Unemployment. To obtain unemployment in Georgia you must be ready, willing and most importantly able to work meaning your doctor should have released you to some form of work. WC may also get a credit on their benefits so always good to speak with a workers comp attorney. It is good that you were able to get income benefits started. As far as the 20% from the attorney is concerned, in Georgia you must show that you did something to earn those atty fees. Sounds different where you are. Good luck moving forward. Stay safe. Ty

    @@TyWilsonLaw Illinois different than Georgia fir sure. And yeah I did ask my lawyer for a receipt what she filed. Her response “I filed electronically” as if there is no receipt. I won’t push it kinda at her mercy but she knows I’m paying attention. Because I was fired while on this claim I should be paid till I get a new job. Right now I haven’t been released to work and I have at least 6 more weeks as I’m on PT and still waiting to be approved for surgery which will take more time to recover

    How long does a MSA usually take . I settled my WC on 12/21/23 and the same day I received a approval letter for SSDI , I’m 62 and won’t get a Medicare blue card until 4/25 .. just wondering if it’s normal for a MSA to take a while ?? Thank you

    Unfortunately the answer is it depends on the company who is performing the MSA and Medicare as they are attempting to have Medicare agree to pick up your medical care once you have exhausted the MSA for the year. Hopefully you will hear something soon. Good luck. Ty

    @@TyWilsonLaw What if they won't accommodate it? I was prepared to go back to work. I received a message not to come in. I build fiber optic cables. Some weighting 800 lbs to over 1000 lbs. I have to push them and turn them on a skate. The doctor told me I have degenerative back disease that will turn into arthritis if I don't slow down. I'm 52 years old and 5'4".

    @@anniealexander9616 If your employer can not accommodate your light-duty restrictions they can either create a job that has never existed just to get you back to work or they can keep you at home. If they keep you at home, they should continue to pay you weekly checks. The question then is what does the future hold? You are in limbo. The law requires that you look for light-duty work within your restrictions if your employer can not accommodate your light-duty restrictions, especially if they are paying weekly checks. It would probably be in your best interest to discuss with a work injury attorney and discuss your legal options, you have options and there are things to think about moving forward with your claim.

Can I do work around my house as long as I don't pick up anything over 25 lbs? That's the only restriction the doctor gave me. I was sent to a nurse practitioner......I've received nsaid shots and 1 steroid shot.

    @@anniealexander9616The employer has a choice, they can bring you back or they can choose not to bring you back. If you are receiving income benefits paid for by the insurance company, I can assure you that will not last forever. If the insurance company can, they will file a hearing to suspend your income benefits stating you are capable of working and request a list of employers you have applied for work with. If they catch you doing things around the house, they will try to make it look like you can lift more than 25lbs and then take the video to the doctor in an effort to get you released to full duty, with which then they can terminate you and end your claim. Be careful.

    I went out of work 2021 i was having sever back pain. I took some short term disability. I had back surgery june 2021 felt worse than before. Oct 2021 i went to a rheumatologist she did blood work and more imaging. HLA-B27 positive ankylosing spondylitis diagnosis. Today i had independent medical examination afterwards i was followed and the car was parked in front of my home. I looked at my home surveillance and i can see he was 30 seconds ahead of me parking. So he wanted to position himself to watch me as i exited the car. He stayed parked. Since i am a paranoid person by nature my wife drove by just to let him know we are on to you. 10 mins later he was gone.

    I can only speak about injuries in Georgia. This is where WC can be difficult. Your employer does not care about you and does not feel your pain. If what you are doing is causing you pain or discomfort you have to tell your employer and then go back to your doctor as quickly as you can. You need to explain to your doctor what you were doing that caused pain. He should make that a restriction. Here comes the difficult part when you have to do the task that you are restricted from doing you inform your employer you are not able to do that task. You should carry your restrictions with you. The employer will either have someone else do that task or they will send you home. They may also let you go so this must be something you cannot do. If this does not make sense you should reach out to a Workers compensation lawyer in the state you were hurt in for a free consultation to find out what your rights are in your state. Good luck.

    Thank you for your comment I completely agree, anyone that is a fraud makes me sick. That said if you speak with workers' compensation insurance adjusters everyone hurt is a fraud. You can not say all injured workers are a fraud, if you do then you are not telling the truth. They system is designed to weed out the frauds. They sure will not be receiving anything long-term.

    Fraud is one thing. The system is designed to eliminate fraud so that should not last long term. You should not let others' actions make you feel guilty, if you feel like you need to report the fraud do it. However, remember what we think we know is not always accurate, so you really want to be sure. Again, would it not be better for your guilt to let it go?     @@blackfa5823 I am not familiar with WC cards. I would call the workers' compensation board or commission in the state you are in. If they can not find you, you may need to speak with an attorney about getting the case started properly as the insurance adjuster may not have filed what they are supposed to file with the board/commission.     i have not worked there in years, why are they still in my home life and destroy every aspect of my life , and it is so bad i need fcc to stop them now fro listening to my phone calls and isp allowing them on my home personal network, nothing work related on any of these. Please tell them to sue them
