"Arvind P.Datar" Senior Advocate Supreme Court of India

Arvind P. Datar is a Senior Advocate and a Cost & Works Accountant. He practices before the Supreme Court and various High Courts and has also appeared in a Bilateral Investment Treaty Arbitration, which was held at the International Court of Justice, The Hague. Apart from his practice, he is the author of several commentaries and books: Guide to Central Excise-Law and Practice, Guide to Central Excise Procedure, Commentary on the Constitution of India, and Nani Palkhivala: The Courtroom Genius ( co-authored with Soli J. Sorabjee). He is also the Chief Editor of Kanga & Palkhivala’s The Law and Practice of Income Tax, Editor-in-Chief of Ramaiya's Guide to the Companies Act and the General Editor of the recently published Essays and Reminiscences: A Festschrift in Honour of Nani He is the founder trustee of the Palkhivala Foundation and a founder director of the Nani Palkhivala Arbitration Centre. He was the former Joint Secretary of the Tamil Nadu Mediation Center, Madras High Court.

    SIR, BRITAIN DOES NOT HAVE A WRITTEN CONSTITUTION IN THE FIRST PLACE. BRITAIN IS GOVERNED BY CONSTITUTIONALISM WHICH HAS EVOLVED THROUGH A LABORIOUS PROCESS AND PRECEDENTS OVER THE YEARS.

    Seervai put his entire life on his book but they publish it in the very bad paper sheets. Let it cost say 1000-2000 more for the quality clothes his words wear. Students will pay who crave for his philosophy and concepts, what he has added or grinned to fill the gaps/voids if there is any.

    Dear, Arvind, something a little out of context I’ll try to elaborate I am a constitutional law student and always wanted to read it with blade like precision because I love the philosophy behind liberty, fraternity, duty and equality and firmly believe that my constitution has the best of it as other countries and the divine has given/gifted us”Indians”best of their concepts “as I always hear and read that we borrowed (I don’t feel it’s the perfect word experts should use. Sounds to me of kind of setback just like the word reservation sounds). What I want to request you sir please get a beautiful book printed of Constitution of India in a kind of Moleskin or my paper book kind of diary format with a soft cover and the pages should be like used by Anson’s contract book published by Oxford university press the old one(what an amazing paper sheets smells really amazing with age) there is a copy of it in the library near canteen of the corridor where portraits of legal luminaries are hung 😅,. Sir I feel that the kind of fonts and paper sheets used in our books are of very very bad quality chemically washed in the name of recycled and eco friendly just like electric vehicle which uses fossil fuel indirectly (thermal energy, silicon ,lithium) the cover pages too are not good or pleasant to look at with a plastic foil over it hard cover too has kind of cheep with glittery golden silver coloured. I love to read on books Everyman classics they have got some amazing taste for paper sheets and it’s cover with pleasing fonts and architecture little expensive but very very cheep compared to our obesity and inflation standards. I love you and your lectures.

    27/6/2024 11:11 am सर, परंपरागत चलती आयी चुनाव प्रक्रिया और गंदी राजकीय खेली सामान्य नागरिकों के लिए कुछ भी काम कि नहीं बल्की एक दिन कि छुट्टी का भी सम्मान नहीं ठहरता ! चुनाव तो सदीयोंसे चलते आ रहे है मगर सामान्य नागरिकों को हर समस्याओं में मजबूर रखते बस्स एक गुलामों कि तरह मिसयुज करते रहते है इससे चुनाव का कोई महत्त्व ही नही बचता ! लोग हर परेशानी में जीते जी मृतक कि तरह जिंदगी जीने के लिए मजबूर अवस्था में है क्या यही राजकीय नेतागिरी है ? चुनाव आयोग इन सभीपर जबरदस्त पारदर्शी नियंत्रण कब ला सकेंगे ? जो इमानदार निरपराध व्यक्तीत्व होते है उनकी ऍलर्जी बहुत पदस्थों को है क्या यह सत्यमेव जयते ब्रीद के देश के लिए जबरदस्त गंभीर चिंताओं का विषय नहीं है ??? धन्यवाद

    Defectors did not stop defecting just because Rajiv Gandhi government inserted Schedule X. It is just that defection became more complicated. It is best that this Schedule X is removed. Monetary cost should be imposed if an elected representative changes his party. Recover the cost of election from him. Pecuniary liability is a great leveller.

    I had read about Nani Palkhiwala giving a brief of the Budget immediately after the finance minister gave an official budget to the nation.     Leave and licence agreement which is unstamped, unregistered is admissible in arbitration, can I take a plea that no law in karnataka or in easement act no such requirement of registration hence just because it is not registered doesn't render it inadmissible.

    whatever we study, learn, and present or beg before the Hon'ble courts, it's not easy to get the results/appreciation from present judges, judges are not ready to accept young advocates specifically in lower courts.
