Interesting I have an independents Nexus medical Opinion for Sleep Apnea that I am being treated for by the VA secondary to Depression Anxiety along with physical disabilities with Obesity that I am being treated for by the VA also which was filed as a supplemental claim after being denied and the medical evidence was deemed irrelevant by VA rater
With a BMI of 41% stated in the Nexus and in my VA medical records not only on file but summited Bi lateral ankles, knees Plantar faucitis, right groin, eft shoulder waiting on HLR
Hey question, I was obligated to leave the Army do to being over weight. Is over weight considered a medical condition??? If it is can I somit as service connection disability???

Finally received my C-File, I don’t know why but going through my old service records and seeing everything I claimed & have been denied for staring me in my face is jaw dropping. How can it be legal for a rater to state that they’ve reviewed a veterans records when they must have not….It literally makes me cry, the VA raters, C&P examiners will try to make you out of a liar, just to prevent veterans like myself from obtaining what’s lawful & equitable for having served. I’m so triggered, it makes me question the integrity of the process. I stopped going to any “free” mental health appointments offered by the VA, because it’s beginning to feel like the very ppl you’re asking for help are the very ppl that are trying to downplay what we have gone through and what we go through….how can one treat mental health when the process of claims and benefits is a total mind f@ck within itself…smh So so sad.
Hey Dewayne! I have a " friend" who went through BCT & was directly affected by a major scandal at his base that led to the death of one recruit & the maiming of another, both in his company. This scandal made national news, resulted in policy changes, and led to Congressional hearings, where his name is mentioned. He had a top-secret clearance & didn’t seek mental health treatment while serving out of fear of losing it. He only started seeing a private therapist six months after discharge. Would this be considered strong evidence for service-connection or not? Thanks!

The CP contractor gets paid for every CP exam, the CP examiner gets paid for every CP exam She/He does regardles of the quality of their exam and their outcome When a vet files a HLR after a CP examiner finds the vet's condition less likely than not caused by the vet's in service injury just because he is too lazy to assit the vet by finding the medical literature linking the injury to the disability, and the HLR adjudicator finds the duty to assist error and he takes the eazy way out and orders another CP exam to rectify the error. He dosen't care because he still gets points for doing the HLR and an additional 75 points for seting up a new CP exam. And the whole thing starts again! The only one frustrated and ready to just quit is the veteran. Everyone else gets paid for doing nothing and is happy as $hit. That is where the 15 billion dollarS OVERBUDGET WENT. Everybody is scaming the system but the truly hurting veteran. Nobody wants to fix it. Too much money involved at high places. Total B.S.
Why does it take so long to get a court date when you file a claims decision appeal?
I've got a bit of a head scratcher. I was awarded a 70% rating for PTSD in 2019, then somehow was also awarded a 10% rating for TBI in 2021. Earlier this year, my PTSD rating was increased to 100% and my TBI rating was reduced to 0% since mental health conditions can't be combined. I'm assuming someone screwed up by giving me a 10% rating for TBI in the first place, but they shouldn't have been able to reduce it after the fact per M21-1, Part III, Subpart iv, Chapter 8, Section B - Proposed Rating Decisions, correct?
The only Veterans who get this are ALS l, loss of use of all extremities, quadriplegics.
If you could look at the recent Barry vs McDonough cavc precendtial decision it changes the smc half step rule ..
Went to outside Dr back then n was told 50 percent nerve damage n both ears. Denied hearing loss turned this info to VA back then.
No c&p exam for hearing loss. This was over 20 yrs ago maybe. I came out 2004 n exit physical stated hearing n eyes needs to be checked. I was told to be sure n get eyes n hearing diagnosed. I was denied but medical records stated hearing fair to poor. Cue?

I’ll be going in for open heart surgery and kept in the hospital for recovery can I get SMC for my time there.

In March I submitted for GERD, Gastritis, Functional Dyspepsia -Submitted actionable and sufficient private DBQ -Submitted private nexus statement -Submitted private treatment records -Submitted VA published articles detailing these conditions as presumptives -Submitted 2 DD214s showing service in presumptive locations -Submitted lay statement After several months VA scheduled me for C&P exam -Because I submitted a FDC, I called VA and asked them to use the material I already submitted to decide my claim and said I did not need a C&P exam -VA rep said she’d put in a work order to cancel the exams and to push my claim through with the info already provided Not 2 weeks later received claim denial. -In evidence reviewed section it only said claim was denied because I failed to attend my C&P exam; nothing else. So, I filed a supplemental claim with everything I originally submitted. Sometimes it’s a true mystery how we are the most powerful military in the planet with these examples of beaurocratic hilarity.
I advocate for vets to get disability compensation, and that must be a VERY small percentage cuz I have seen 100% rated but they are certainly NOT getting that high of an amount at all.
Dewayne, should I refute each issue (argument) the VA made in a denial letter I received in 2007 in a separate statement included in my supplemental claim (in addition to the evidence I'm submitting)? Their arguments are not accurate (i.e. they mention my separation exam which wasn't even done, they used a physical competed 9 months previously and just signed and stamped it as if it was updated).

Under PTSD has this: Important: For a claim for service connection (SC) for posttraumatic stress disorder based upon a stressor related to the Veteran’s fear of hostile military or terrorist activity, 38 CFR 3.304(f)(3) directs that the examination must be conducted by a VA psychiatrist or psychologist, or a psychiatrist or psychologist with whom VA has contracted. 🤔🤔🤔
Yes, the VA changes the M21-1 from time to time. Also, I don't always copy the entire M21-1 due to it's size, that's why I tell veterans to use the name of the M21-1 and do additional research.

Dwayne, In my record it shows injuries to my eyes and now my eyes are 20/1000 I need to help on trying to figure out how to get an SMC or if I qualify for an SMC since I am legally blind any advice

Dewayne this video is spot on. Exceptional video that makes a lot of valid points. Don't just go hire any attorney or representative do your homework. A 1-hour Google search could be worth tens of thousands of dollars. Don't listen to hear say do your own research and make phone calls and have them return phone calls 📞. I asked my representative how am I going to feel after the claims process is over? Am I going to satisfied with the results? Put them on blast😮 that's what I did.
As a veteran, that been fighting agent orange for years, and not get anywhere with it. Under Presidential Trump I manage to get something from the VA. However, Joe Biden signs the Pack Act in 2022, after filing sever claimed from that listed one of the bases under Pact Act, nothing happens. The last time I filed that same claimed form again and sent the same claimed forms to my local representative, I finally got an answer from the VA. If I had not sent the claim forms to my local representative, I probably would not have heard anything from the VA. Just like anything else that the democratic party does, makes ruling about benefits, and then lie about it. This is nothing but lies to America Veterans to gain votes, then the democrats do nothing about it! If a Vet, with no knowledge at the time went to a VSO, submitted for compensation, received a % for some conditions. But received a letter stating 0% for sleep apnea and lower back. Having two sleep studies from a civilian doctor and spinal decompression for lower back and records show bulging disk. Member was member of National Guard with problems worsening during Guard service. Ignorant service member did not have C-file (but requested just now). Time-frame 2021 October. Is the service member SOL on getting compensation for sleep apnea and lowerback?

I filled paperwork for my disability with the VA and was given only 10 percent which was the lower of the two percent I was entitled to and now my hearing is even more bad also I useing breathing machine and I have talked to other VA claims people to no real help. I live in Sacramento CA where or who can I get to help or tell me what I qualify for.
I filed 3 claims at the same time hearing loss, sleep apnea and major depressive disorder. The hearing loss and sleep apnea were kicked back but the major depressive disorder was service-connected at 70 % since my sleep apnea is directly connected to my depressive disorder would it be advisable to resubmit for it now or should I wait for five years? The sleep apnea claim would take me to 90%.
I went to see a VSO and he couldn't tell the difference between the Sun and the Moon 🌞 🌙. I did an about face and went to a local VA accredited law firm that had attorneys from SSDI to SSI to social security and workman's comp etcetera. They had 3 attorneys that specialized only in VA Benefits and law. The attorney that was assigned to my case was superb. Jennifer and her paralegal are beyond professional. Kept me updated on each and every move they made and the VA made from sending video recordings to me, phone messages, text, and emails. One thing she did say is it's not written in stone but when you retain an attorney or representative it would behoove you to have your representative in close proximity meaning you live in Georgia and your attorney shouldn't live in Indiana. You need to be able to go and see your attorney if he or she calls you in to talk strategy and explain detail to you in close proximity meaning get a feel for your attorney. As she put it you wouldn't hire an attorney if you lived in South Carolina and your attorney is in Michigan in any legal matters if a local one is available now would you? 3 times the paralegal called me in to talk to me and explain things and show me paperwork and it just made everything so easy and simple where as I wasn't doing video chats all the time the real connection just wasn't there on 2 video chats that I had with the VSO. A good law firm with very capable attorneys locally is a hard representation to pass up. Not only did I get 100% but a few SMC's and the VA's automotive allowance benefit 🚗
Waiting on tdiu appeal, it's been 67 months ago. Had qtc exams Dr stated grant increase n had a telehealth exam, psychology Dr stated will go from 70 percent to 100 percent which one will be granted n will I get back pay
Someone would have to review the paperwork for the effective dates assigned.

Dewayne, I submitted my retirement letter today still pending approval for an April 1st 2025. I know I can start my retirement physical through the VA 180 days out. I have diagnosed depression, tinnitus and sleep apnea. Is this enough time not 100% clear exactly on the process. Any videos you can recommend? Appreciate any info. Thanks.

I'm fighting with the VA for SMC T. The VA doesn't like paying out SMC R nor SMC T. They will give you housebound not higher. My case is at the appeal level. The VA makes it hard to receive SMC R and T. Why do raters deny SMC claims when it should be granted. The VA is the cause of VA consulting agencies because of denying claims.
They only deny if the veteran doesn't not meet the criteria. Well suppose to, if you meet the criteria, they should.
