    These are helpful but beware of the lemon test mistake. The test is neutrality and general applicability now. Lemon test no longer used in federal court

    Super helpful for studying on the go. But USER BEWARE, the content clearly hasn't been updated to incorporate SCOTUS decisions from at least 2022 forward. E.g., at 28:42, it asks about the relevant test for the Establishment Clause and then provides the Lemon Test as the answer. The Lemon Test was effectively overruled by Kennedy v. Bremerton School District (2022). It has been replaced with a "history and tradition" approach.

    Thank you for your comment, Laura. You are correct that the Supreme Court's decision in Kennedy confirmed that it had abandoned the Lemon test. The Court did not announce a specific, new test to evaluate potential violations of the Establishment Clause. Instead, it endorsed the view that "the Establishment Clause must be interpreted by reference to historical practices and understandings." According to the Kennedy opinion, when determining whether a government actor "coerces" an individual to observe a particular religion, courts and governments must take care that the line between impermissible and permissible conduct "accord[s] with history and faithfully reflect the understanding of the Founding Fathers." If you are tasked with analyzing an Establishment Clause issue on the MBE, remember that government actors have wider latitude to display religious iconography and to worship publicly under Kennedy than they did previously.

    Please excuse my Candor, but this is neither a solicitation nor an invitation, this Is the truth. I am and have been completely abstinent for what will be eight years (excluding one day now in 2016) here in Philadelphia PA USA almost eight years, (with the exception of one day over all in early 2018 not in Pennsylvania), and never left America). My eldest son (who is diagnosed with a disability, but who I am teaching) is still a virgin (to my absolute very, very, very, very, very,very, very, very, very, best knowledge), and my youngest son is married and had a baby girl with his wife a month ago. 05-23-2016 (while I was running for Congress)-04-01-2024 or whenever this stops, nor do we have STI's or STD's, no Cancer, no COVID-19, not LGBTQIA and do not have sex, do not have a menstrual cycle at all, nor have been sexually active in years, am not cheating, not microcheating , not having any affairs, did not sleep with my brother, sister, or children (sexually) just shared a bed years ago , nor my brother in law, nor exposed our father. I don't have sex at all.

    So about 1 in 4 pass DESPITE being smart enough to get into law school, not flunk out AND doing a bar review? I think the reason is law school doesn’t teach you how to pass the bar and most law school graduates’ hubris makes them believe that they can beat the bar so they don’t take bar review seriously. Also, most who fail are older people who have jobs / spouses and / or children so they have less time to study. When I passed, I had no kids, no job and lived with my parents. I had lots of time to study and had no distractions.

    A district court can certify a question for appeal, but they cannot ORDER an appeal. Certified questions can be denied appeal by the appellate court.

    I think seizure means “when the government or its agent removes property from an individual's possession as a result of unlawful activity or to satisfy a judgment entered by the court.” It points to movable property, rather than the citizen

    rise to y o u r challenge yes. took me 59 years to find that challenge ! I used to work on a tough award winning hospital ward where it was easy to forget that you were probably learning more than on some of the less emotionally demanding medical wards. thanks.
