    Thank you for such an informative video. Question: If I am making 2 versions of a product..one with a metal buckle and one with plastic, does that require 2 separate patents? Thanks

  • @PatentToronto
    @PatentToronto3 ай бұрын

    Generally no. You can draft a patent application so that it covers minor variations of your invention. Hence, the patent will cover the same invention even if the parts of the invention are made of different materials. In your case, the patent would ideally specify that the buckle could be made of any suitable material such as metal, plastic, bone, tortoise shell or the like.

    What is your advice for people with smaller inventions? I have a number of ideas and even prototypes that may be worth hundreds of thousands or a few million in REVENUE if they could reach the right markets. The profits could be significant to myself, but Companies seem to only be searching for products worth millions in PROFITS. If an idea isn't big enough to start an entire company around, and I can't get an established company to buy it... is it just a worthless idea?

    Apple computers was started by Steve Jobs and Steve Wozniak out of a garage where they hand manufactured and sold a single board computer (Apple 1 computer) into a tiny market. The market for personal computers was minuscule at the time, but grew quickly. They could not license the product at the time because the market was too small, so they had to do it themselves. Sometimes, you have to do it yourself and become a manufacturer.

    True - the point is, at the time, they decided to become manufacturers because they couldn’t sell their idea any other way. Many inventions are very difficult to license or sell to a company because the market is perceived to be too small or insufficiently profitable, in which case the only option might be to go into production yourself.

    What an interesting video. I have done most everything suggested in this video and have found you to be correct in your analysis. Man, I have to say that you've done a hell of a job! These videos and the course you have are just beyond useful and informative... I would like to ask you: If you have a provisional patent, would that eliminate the necessary need for an NDA? And will just depend on the provisional? Or maybe provisional + the email agreement you mentioned? And how about recording every single call with them... that would be powerful evidence in case they stole the idea... right? Finally, I wanna thank you for your amazing job, and I've just subscribed and am looking forward to your next upcoming videos!

  • @PatentToronto
    @PatentToronto8 ай бұрын

    Yes! Building a good paper trail is a great way to reinforce your rights. The provisional application is necessary to secure your rights, but together with a NDA, you have as much protection as is legally possible.

  • @ElegantAstronaut
    @ElegantAstronaut8 ай бұрын

    @PatentToronto thanks for responding. I mean, in case they didn't agree to sign an NDA, recording every single call is powerful since any stupid move from them will lead to publishing everything online, and then later they lose reputation... which I think is far worse than a lawsuit.

    You need to have people sign a non-disclosure agreement (NDA - also called a confidentiality agreement). Make sure they sign the agreement before revealing details of your invention. I have a video on NDAs and a free online course on them. Check out the description of this video for more.

    How can a journal be evidence if you can just invented any date in the pages ? How do they know if a wrote that a year ago or yesterday ?

  • @PatentToronto
    @PatentToronto10 ай бұрын

    It’s evidence, but it’s not foolproof. Also, it helps you record when events happened, who you met with and when, and other important details. Judges tend to be impressed by that sort of evidence and they’re usually smart enough to spot a fake.

  • @PatentToronto
    @PatentToronto11 ай бұрын

    Thank you for your comment. There are no rules on how things must be negotiated, so it all depends on how things are discussed. I usually suggest that negotiating is followed up with written confirmation of what was discussed so that everyone is clear on what has or has not been agreed to. I personally think it’s best to be informative and flexible when talking with would be investors, licensees or purchasers. Always have a signed confidentiality agreement in place before disclosing details of your invention if there’s no patent.

    Thank you for this information! I watched your NDA course over and over! Is it important to apply for a provisional patent? After watching many videos i heard there are people who get into the patent website and look for, then steal new inventions by changing them just enough. Now i am scared to get a provisional patent, what do you think?

  • @PatentToronto
    @PatentToronto11 ай бұрын

    Provisional patent applications are secret. In 34 years of patent practice, I have never seen a case of someone having their provisional patent application stolen. However, if you tell someone what your invention is without either a strong confidentiality agreement or a patent application, then you run the risk of your invention being copied or stolen.
