    Not to forget about their jail cesspool. The Sheriff responsible for those poor conditions in Fulton County Jail should be held for charges in one of her cells, I'm thinking the cell where a man was eaten alive by bugs would be a fine location. The family of the 35-year-old man who died inside of a jail cell after being eaten alive by bed bugs has reached a $4 million settlement with Fulton County Jail in Atlanta, Georgia. The Sheriff is responsible for the man's death and should be held for trial for holding suspects in such conditions.

    I can sort of explain it- The defense attorney (the white guy) is asking questions in a way that implies or suggests “facts that aren’t in evidence.” An over-simplified example is that the attorney asked a question like, “So when there was a meeting with a detective, did (and then the question)” …. But there is no proof or evidence that there was a meeting. This is a defense trick to imply or suggest to the jury that the police hid evidence, are corrupt, and are trying to railroad their client. -- In every trial, the defense has to put on a defense. When there is a lot of evidence against them, and they have no actual defense, defense attorneys will try and suggest the following 3 things- 1. You can’t trust DNA evidence 2. The police were rushed to arrest someone guilty or not 3. The police framed/hid evidence/it’s all a big plot. When they don’t have a defense, they try one or more of those.

I guess employees for the state of GA look out for each other and could care less about practicing law in the name of justice. It all about CYA for them. That Fulton jail condition will make anyone lie on others to get out. Today one defendant asked for an attorney and the cops kept questioning him. Lost tape recordings. Altered police reports. They just wanted a rapper to go down for this stuff. Before the trial started they tried to disqualify Steele from Jeffrey Williams' case. Strong arming of poor/uneducated people. Truly pathetic.

Thugs lawyer assume that there is some type of evidence about a conversation that had occurred that he can not prove that it did or didnt but want to proceed as if he has facts that it did. what the judge is saying to him which is simple, as long as he cant provide any evidence of whatever he thought that happened, happen, he can not talk about it. It isnt rocket science ! If he has the evidence, then he should present it to the court, but since he doesnt and he claims someone else does and he has never seen it from the people who he claim has the evidence then to the court it is not material facts and becomes hearsay.

    To me, the judge is being a little thick. The defense attorney says that two officers are on a recording, where one tells the other that he lied six days earlier. Presumably, he lied in making some official statement. The defense attorney wants that statement but the prosecution said that the defense concocted the statement out of thin air. The prosecution and judge says that since the defense attorney can’t prove the statement ever existed, then he can’t ask any questions regarding the statement unless he can find it to put in evidence. That doesn’t make sense since it would effectively allow the prosecution to destroy evidence and tell the defense “too bad for you because the evidence that would help exonerate you is gone.” If nobody can find the statement, then why can’t the defense play the recording for the jury and let them infer whatever they choose about the absence of the statement itself?

  • @robertrodes1546

    @robertrodes1546

    Sounds reasonable to me. Seems that the defense doesn't have the recording, though, and wants to introduce the officer's statement into the questioning without actually producing the recording? I can't say that I fully understand what's going on because there's too much yelling and not enough explanation of the arguments in question, but that's what it looks like to me.

    Defendant Attorney, stick to your ground. Someone destroyed the evidence. A reasonable court should request the attorneys to file motion for Reconstruction of the records being lost or destroyed as a matter of right. I had a similar situation, but I beat the court because I know how to obtain the record and consequences of unreasonable denial of the records against the court and the State. So, before the appeal, the judge lied to me in writing stated that Hurricane Irene-2008 destroyed the computer of the recordings. The reconstruction was ordered, and a hearing was scheduled for all the parties including the defendants. I demanded a request and permission from ARCHEVES Management for AUTHORIZATION to destroy the court proceedings recordings. The same judge asked the parties to file a motion for the reconstruction of the tampered evidence. I don't trust the prosecutor or even the judge. For the fact the prosecutor is asking the court to quash the request for the issues in dispute, clearly shown the prosecutor lied and guilty of the whereabout the discovery. Or the defendant attorney should swiftly move to file a motion to dismiss the complaint for willfully tampering with victim's own records and for lack of producing the victim’s own record when requested with prejudice and sanction against the Prosecutor. The burden of the proof lies with the state. The constitution states that a criminal defendant shall not be denied his own records and all other records for trial.

    I can't believe the divide of people siding with the judge or siding with the defense Attorney. It was a respectful hearing up to and until the judge acted unprofessional. Its blatantly obvious that the judge is bias from the beginning. It doesn't matter if i think hes innocent or guilty and of what crimes but this Entire case is Ridiculous. Its been a circus from the beginning. With defendant's and Lawyers being arrested during proceedings,both sides acting in bad faith. The amount of time and money blown on an over a year long case is Appalling and a kick in the teeth to American tax payers. Nothing about this whole case justifying spending 10+ million dollars prosecuting a Case where a majority of defendant's took sweetheart plea deals and aggressively prosecuting the few that didn't cop out. Its a Rico Case and a Case that shouldve originated or Referred to the Fed's. Atleast then it wouldn't be a circus 🎪
