Except for the moment, Trump is the only defendant in the election interference case pending in federal court. Your idea is more appropriate for the Georgia case though.

I've wondered the same: Cut Trump loose for now and shift to prosecuting the unnamed co-conspirators in Smiths Jan6 indictment. They do not have immunity. There are several problems, though. I don't know if they have already been offered deals. I don't know if you can do that with the existing indictment and not need to return to the grand jury. It could be argued that this would be a new case and one that could affect the election, so the DOJ won't start it within 60d of the election. Finally, and this is the worst, as soon as they get this going, someone is going to move that Smith isn't properly appointed and we'll end up stuck waiting for SCOTUS to hear that since (I think?) this would be an interlocutory appeal.

Harry---- The Court said evidence couldn't be introduced AT TRIAL----- these are PRE trial hearings. Chutkin could absolutely allow the evidence to be evaluated because no jeopardy is in play yet.

because this kind of ruling is what the republican party and its wealthy owners have been working toward for decades. they've been trying to get a majority of obedient judges on the supreme court for many years, and they've finally achieved it. the fact that the ruling does violence to the plain text of the Constitution has zero importance to any of them, because the only thing they care about is exercising unrestrained power
