There was no proper evidence. When the treasure was stolen, all the lights were out for the fireworks show. Not to mention, that society was strictly hierarchal. There was only one witness, a low-ranked maid, and the thief was the daughter of an upper class citizen and a favored member of the emperor's harem. People would have believed the concubine over the maid. Once word got out that the treasure was stolen, the empress herself would have gotten in trouble due to negligence as she put her personal servants in charge of keeping it safe.
