Women's Childcare Leave | Supreme Court | InNews | UPSC | Drishti IAS
Participation of women in the workforce is a constitutional entitlement and denying mothers childcare leave violates this, the Supreme Court said Monday. A bench of Chief Justice of India D Y Chandrachud and J B Pardiwala was hearing a plea by a woman, an assistant professor in the Government College, Nalagarh, who said the Himachal Pradesh government had denied her childcare leave to attend to her child who is suffering from a genetic condition. “Participation of women in the workforce is a matter not just of privilege but a constitutional entitlement protected by Article 15 of the Constitution. The state as a model employer cannot be oblivious to the special concerns which the provision of childcare leave to women sub-serves an important constitutional objective of ensuring that women are not deprived of their due participation as members of the workforce. Otherwise, in the absence of provision for childcare leave, a mother may be constrained to leave the workforce,” it said arise in the case of women who are part of the workforce,” the bench said in its order...

2 year child care leave me it’s impossible to take care the child that’s why most of the child now a days having autism and behavioural problems. Even for child care leave govt not give it easily. Ultimately future of country children are suffering. Working mothers are in stress, emotionally broken. Everyday thinking of quitting the job. Most of the central job far away from home town, even govt is not concerned for home posting for working mothers, working mother and their children are suffering ultimately.

सर आपको अवगत कराना चाहूंगा कि जितनी भी प्राइवेट कंपनीज है वो चाइल्ड केयर लीव से महिलाओं को वंचित रखा जाता है । जिससे उन्हें भी अपना वर्क जॉब छोड़ने के लिए विवश होना पड़ता है। कृपया इस पर भी अपना विचार रखे कि प्राइवेट कंपनीज द्वारा ऐसे भेदभाव क्यों किए जाते है और इसकी रूलिंग भी बताए क्या ये SC का नियम प्राइवेट कंपनी पर भी लागू होगा।।

नियम में सुधार की आवश्यकता है! प्रत्येक बच्चे पर कम से कम 2 वर्ष का CCL मिलना चाहिए तीसरा या चौथा बच्चा भी इसी देश का नागरिक होगा फिर उसके चहुंमुखी बिकास के साथ भेद भाव क्यों ! तीसरा या चौथा बच्चा होने में उसकी कोई गलती नहीं!

Even nationalised banks don't have this policy. They give 2 yr leave without pay.. sabbatical leave

Can a country afford to have a office with staff on leave, no matter what reason. Practically means keeping an adhoc and also paying a main employee, when we have so many unemployed, who can do the work religiously. We are now understanding the practical difficulties but running a economy is different from welfare at the cost of others. It is akin saying, if theree are childrens to study, employee is on these leave that too in private organization in time to come. Thrn there will be period leave. Why no better employ the individuals already having child and will be having higher professional experience also. Forget this, in time to come, machine is going to override humans, thus all these issues will change their character, as practically we are moving toward 24 hour job.
