Woman Texting Walks Right In To CSX Train In No Train Horn Zone

This is a video I made in Lakeland Florida on the Kentucky Avenue railroad crossing in the no train horn town of a woman texting and walks right in to a CSX intermodal train. This video shows that Lakeland Florida has dangerous crossings due to the no train horn and no pedestrian gates in place. If there were a pedestrian gate this woman would never have been injured or possibly killed. This video will show you I have caught on several occasions people walking right through the crossing while a train is coming at the same location this woman had the accident. Lakeland needs to lift the horn ordinance or put pedestrian crossing gates at all of it's no train horn sidewalks.

    How about people just pay attention where they're going? Amtrak and Uncle Sam shouldn't need to take extraordinary steps to protect all stupid people.

    Technically the woman was hit by a CSX freight train. CSX probably owns this particular rail line. Amtrak just happened to be using the track when this video was made. As far as I know, Amtrak doesn't own any tracks of its own, just contracts with other companies to use their tracks.

    +hung huge Well, it *IS* Florida. All jokes aside, I'd bet a paycheck that the woman tried to sue the railroad. That seems to be the modus operandi these days - be a complete, drooling idiot and then sue everyone else because you have no damned common sense. I see people do stupid shit like this all the damned time - and like the woman at the end of the video, most of the time their attention is on a damned cell phone. I don't care who you are, the world can live without your feedback for a few minutes. PUT THE DAMNED CELL PHONE DOWN AND PAY ATTENTION TO WHAT YOU'RE DOING.

    +hung huge I am with you. While I am so grateful this woman was not torn to bits and she is recovering could she not hear the train. Yes for the most part htere is no train horn in this particular area but did she not hear the engine? I really hope she learned her lesson.

    The sad thing is that CSX will likely payout a small settlement to avoid litigation and lawyer fees. It's cheaper just to give the woman $50k than to fight it in court.

    There is no chance you can't FEEL the train approaching if you are that close horn or not. The vibrations from that can easily be felt blocks away.

    Depends how big the train is and how fast it’s going but in this case for sure. It also depends whether it’s electric or fuel powered.

    Completely agree. The lights are flashing and the gates ring. There is a need for basic awareness in life...texting in the phone while walking is negligence. the train tracks don't move. And next question, was she local? Surely she has some obligation to understand the rules of the road and her county ordinances. The horn went away because too many of those residents/ pedestrians complained about the disruptive noise. If I were on the jury, I wouldn't award any damages to the pedestrian.

    TheSimulatorGuy the train has a bell as well, and the csx engines are pretty loud, especially if you get 2 or 3 or more on one train.

    yeah, no change needed. just because someone can blind themselves from the world with headphones or texting doesn't make it a good idea. the bells, gates, and flashing lights are PLENTY of warning. people don't seem to value their lives much these days, they're in too much of a rush and don't give a sh*t everywhere they go. walking across train tracks anywhere without checking for a train is exactly like crossing the street without looking, or cutting a truck off that can squash you like a bug. you really want to put your life at risk like that? not my problem. she chose to be careless and got accustomed to it, she paid for it by getting hurt.

    You don't need a pedestrian gate if you pay attention. What will it take for gates? A death? I ask you! What will it take for people to pay attention to what's going on around them? A death? She learned the hard way. She doesn't need a gate anymore. She'll remember this lesson.

    CSX should sue the woman for her carelessness and causing a situation that stopped the leagal transport of their freight in a timely manner, and caused financial liability for CSX by doing so... And if she has a problem with that, tell her to sue her city council and let them laugh at her...

    @@tuborgcarlsberg1184 In germany there are many Railroadcrossings without any gates or lights. Trains there can run up to 60 mph, while the only protection is the clear sight on the tracks and an "Andreaskreuz" (RR-Crossing sign), which in Germany says by law, that the Railway has the right of way. Setting up everything for the most stupid or to be more accurate the ones which do NOT care about wahts happening around them, is the wrong way to go, because such things encurage people to concentrate less on the environment around them.

    You think yhis is bad? Try driving a semi truck! At least the guy driving the train won't be liable. Put on your turn signal in a tractor trailer and IF anybody is paying attention they'll be sure to speed up because they don't want to be behind the truck! This is the result of baby-proofing the world and making everything someone else's fault. There will be consequences... one way or another. Do we really need more idiots in the world?

    I'll never understand what compels a person to pull in front of a semi and hit their brakes! How stupid can people be? I'm glad some states have laws saying trucks have to have dash cams. Seriously, If I'm walking and I receive a text, if it's really important, I'll STOP WALKING, THEN start texting. I mean, what's the worse that can happen if you don't reply RIGHT away.     Maybe YOU are careful, but many, many, people are not! It only takes one tiny distracted moment, maybe you're stopped, but maybe you are in a place where somebody or something else cannot stop so they hit you! This isn't a construction site or somewhere unpredictable things can happen. This is a railroad crossing. You can predict trains will cross there.

    also these are silent crossings notice how the bell stops once the gates are fully lowered an audible alarm such as a horn would be just what someone who's visually distracted on there phone needs

    Alan I love your videos but I must disagree with you on this one. You got to be blind and deaf to cross those tracks with a train approaching and then your guide dog would know better. The flashing lights and noise or the train should be more than enough warning. What happen to just stop, look and listen when crossing any railroad tracks?

    I doubt even that most deaf people would fail to be aware of a train with an engine of that size the explosions generated in the cylinders of a diesel engine of that scale are easily felt from a good couple of hundred meters away. And that is for a hearing individual that isn't particularly accustomed to relying on perceiving sound through their sense of touch. Maybe if it was a large electric engine I could get it as even really giant electric motors can be pretty quite but combustion engines are not.

    I strongly suspect guide dogs are smarter than some of the folks they try to take care of. I had two ordinary dogs, that only received commands to keep control of them. They both did things one or two times that was uncharacteristic of normal dogs. One grabbed a Penny's plastic bag that was blocking the door, so we could get out. The dog had never carried anything in her mouth for me. Didn't fetch the paper or anything . But she knew we were going walking, and wasn't about the let the bag prevent us from going. Just grabbed it and moved it, and went back to the door, with me just watching flabbergasted, and never saying a word.

    It seems very strange to me that a person could walk into the road while texting and get hit by a truck but somehow a train at the same speed is thought to be more dangerous and a physical barrier is needed to prevent it. Logic appears to be missing.

    The real victims here are the locomotive crew members. There was nothing more they could do to stop this idiot. Even without the horn blasting you can feel the massive sound waves from a train bouncing off your body two blocks away from it. The people living in this town carry some blame too, why do the citizens here think that they're too SPECIAL to have to hear a train horn. You're NOT SPECIAL!!! Deal with the sound of the horn like everybody else. The next person saved by a horn may be your own child. Train horns have saved thousands of lives and are the most basic piece of safety equipment on any moving vehicle.

    AK-104 Russian Carbine You probably hear it better than I did. I lived ONE block from a noisy Santa Fe track. Soon my brain tuned out everything but the horn. I'd here the horn and then I'd concentrate and hear the train if I wanted to. I'll bet our injured black lady lived close to the track. I hope she had a full recovery.

    737cfm56 - I agree. I've seen interviews with train drivers who have been put in similar situations, usually with far worse consequences. In each case it affected them severely and permanently (PTSD ?).

    so, she's walking along engrossed in something in her hand, and walked into a VERY loud train, but, somehow it's the fault of CSX or the city because there are no pedestrian crossing gates? PUHLEASE, it's her own stupid fault, no one elses. And crossing gates are in place in other places, but people just go around, or under, them. You can't fix stupid.

    Trains have horns for a good reason. No-horn zones are just plain stupid and should not be allowed. Trains make noise. If some people don't like it, they should not buy houses near tracks. I feel the same way about idiots who buy houses under the approach paths to an airport, then start whining that they should stop flying at night.

    I can hear the locomotive's bells the entire time. I could hear them get louder as the loco approached. Listen to it. You'll hear them too. The bells of the crossing gates were off, but the loco's bells were very loud and getting louder. Take a listen to it. There's no pill for stupidity. Anyone crossing with bells getting louder needs their hearing and/or brains checked.

    In all honesty, the train wasnt even in the frame when he crossed the tracks, so there was literally 0 danger. I like to think of it kinda like that scene from austin powers where the guy is there screaming and holding his hands up to shield from the forklift impact, and the forklift slowly inches its way toward him for 5 minutes before running him over.... its a train, just step 3-4 feet to the side and you'll be fine. no need for the nanny state bullshit.

    I've never made the mistake of being so engulfed in my own world that I got hit by a train, crashed into another car, etc. It's ironic that cell phone related crashes and fatalities are becoming so prominent that they now exceed alcohol related deaths. While we are talking about being the victim in the context of being hit by a train, it's pretty safe to assume that said person would be a pretty good candidate to drive doing the same thing.

    IMHO, the town should not be allowed to pass no-horn laws, unique to their town. The rules of the rail company should trump any local ordinances of a town that a train happens to run through. The horns should be sounded at any and all intersections that the engineer feels is appropriate. It should be his judgement call. He's in a better position to make that determination than anyone sitting on a city counsel.

    There are local warning horns that have been used at crossings in quiet zones for at least a decade, which are loud enough to be heard in the immediate area, but not nearly as far away as the train's own horn. Why didn't they at least install those in this town?

    My great great grandmother was killed when a train ran her over. This was about 150 years ago, so there weren't all the bells and whistles (literally) that are available today. It was at dusk, she was walking in the middle of the track, and apparently didn't hear the train coming down the track. By the time the train stopped, it was already over for her.

    Not familiar with that exact intersection, but the sound from a neighboring jurisdiction doesn't respect arbitrary legal boundaries; moreover, trains on tracks that aren't even parallel to the identified crossing could be what you're hearing.     Doesn't need pedestrian gates. Just needs smarter pedestrians. There are clear marker lights, bells when the gates go down, and you can HEAR THE TRAIN BELL. The woman got hit because she's stupid. As the saying goes, you can't fix stupid. In addition, a pedestrian gate isn't going to keep determined people from crossing the tracks. They'll go around the gate.

    I was taught how to cross the street when I was 5 years old. If adults are too stupid to look both ways before crossing a live railroad track, then the species will be a little smarter after they kill themselves. We have to stop blaming other people for our mistakes. I'm sorry if that feels harsh, but I get blamed for other people's mistakes all the time and I'm sick of it.

    The only time I saw a No train horn zone in person was in Atlanta, Georgia. When I was due to participate in an charity event, I was in elementary school in Savannah at the time and I got a small penny crushed by a train.

    I literally hate quiet zones. For that very reason. Some of the idiots how complained of the train horns being to loud need to see this. And you are right they need to either remove the quiet zone or but up pedestrian gates.

    there are no train horns zone up here to, and its by a quad crossing. CSX made the gates longer bc ppl are too impatient to wait for the train, why don't the play on their phone while they wait for the train.

    Where I live, there are quiet zones with gateless crossings, on busy fast 1 AND 2 lane roads!

    Had a bicyclist run the gates on me once, just missed him with the engine and he runs headlong into the crossing gates. I damn near pissed myself I laughed so hard.

    Pedestrian gates should not be needed here...I agree. But it is just stupid that the railroad chose not to install them when upgrading the crossing. They should AT LEAST have the bells keep ringing.

    Since there is a no horn ordinance, why don't the bells continue to ring after the gate is lowered (and not only while the gate is lowering)?

    Although I'm not in favor of quiet zones, this accident can't not be blamed on the fact that it happened at a quiet zone crossing. According to the news report, the train did blow the horn (they said whistle but that's ok). The engineer of a train is still allowed to blow the horn in emergency situations. So the "victim" ignored the flashing lights, the ringing bell, and THE TRAIN HORN. If they had the pedestrian gates, maybe she would have walked into it and bumped her head.

    They did blow there horn at the last minute which was to late. They blew there horn within feet of the crossing

    I'm not in favor of quiet zones either but if the engineer is allowed to blow the horn in an emergency situation only, it may be too late. They can't stop short or steer away from something like a vehicle. The town of Lakeland should not allow ambulance, police cars, fire trucks out of fear of noise, an they might as well remove the gates from the crossing period.

    Even the rural area I live which has a population 10 times lower than that of Lakelands has crossings that block both the road and the sidewalk, yet Lakeland doesn’t? That’s really odd.

    looking at that system a extra gate wouldn't make a bit of difference as people are just going to walk around it or just duck under it. You would need a Metal fence running up to crossings and bigger gate that goes all the way to the floor as we have in the UK.

    Very good video Alan. As you can probably guess by my screen name I'm a train nut. I worked in UP yard for almost twenty years intermodal freight and you wouldn't believe some of the things I saw truckers do in the yard. Among the hundreds one sticks out he parked his tractor on the track between two sections of train waiting for a container to be off loaded. Parked right on the rails like he was part of the train. You might want to checkout a video about Downer's Grove Il, a woman walking with her lawyer walked right across the tracks as train was sitting in the station and the express train came flying through her lawyer stopped unfortunately she did not ...the result a fatal accident.

    And these trains are SO quiet too! Who can hear them coming. Unless they blow their horn, nobody even knows they exist! OR maybe debases should be more aware of their surroundings. It's natural selection at work!

    The worst danger these days is joggers with headphones on so they don't hear approaching trains - or cars for that matter! A girl wearing earphones got hit by a train and killed at a crossing in our area even though people waiting on the other side called out a warning to her - she didn't hear them either.

    I had guy with his headphones on, step right in front of my van just the other day. I laughed, he didn't. Luckily for him I was not going very fast. A scare for him, which should make sure he looks next time. I look both ways crossing roads regardless of whether it being a one way or not.
