Disgusting. Back in 2015 a guy in Denver received a 160 yr sentence for a car chase. There was a baby in one of the cars he stole, but he didn't kill anyone. So if we were to say she did it intentionally and it cannot be proven in court, what then? Should the court then "believe" someting that we think is likely? No, we can believe stuff, but court needs evidence. Police fault then. They shoulda done a better job and brought evidence to the court. Thats the police officers job.

The sentence was the average sentence for voluntary manslaughter. You need to look at the whole scene to understand why a plea bargain was offered. Witnesses (not Darla Jackson) testified that there was an exchange between the two of them (not just her getting mad and running him down). Same witnesses testified that he kicked the side of her car and mirror, causing damage, and then sped off. She pursued him. Her claim being that she WAS angry, but she did not want him to get away, without getting his insurance information to pay for her damages. She chased him, got too close, and the collision happened. I am pretty skeptical about this motivation (trying to get his insurance). I would guess that he kicked the side of her car and it enraged her and she went after him. Regardless, it gave here a plausible out, and they didn't want to see her walk on this, so they offered her a plea bargain (voluntary manslaughter as opposed to some variation of murder), she took it, and got the average sentence.

That's not what he said. Rather he stated there wasn't enough evidence to prove the crime was intentional. Meaning he decided evidence was insufficient-not beyond a reasonable doubt-to prove the defendant guilty to the fullest extent of the penalties on all charges. So, guilt couldn't be proven to such a degree that her ultimate intent was to murder the victim. Obviously there was intent, it existed of course - but to what degree and for what purpose specifically? That's what it comes down to, at the sentencing hearing.

I did some research as to why this happens, but do not take it at face value, I am not an attorney. It depends on the state the crime was committed in, but if we are talking California then the sentences can vary wildly as they look at the individual's criminal record, level of intoxication, circumstances surrounding the crime and many more factors can come into play when prosecuting them. Like repeat offenders get a harsher sentence than a first time offender, obviously. I'm not saying this Karen got the appropriate sentence, but since there was no (substantial) evidence other than eye witnesses i assume, they couldn't charge her with aggravated assault. If they would have, she might have gotten out scot free due to a mistrial. This is cause eye witnesses are solely used to established facts, and not taken at face value anymore. Of course this is just speculation cause I haven't reviewed this case, but it is how I think it went down
