Winnipeg business owner says overflowing bin that led to overcharge staged by garbage company

A Winnipeg business owner is fuming after being overcharged by a private garbage operation for something he says he didn’t do. Brad Wallin, president of Wallin Industries, a local metal fabrication business, told 680 CJOB’s 'The Start' that a recent bill for garbage pickup from Waste Management of Canada Corporation was a whopping six times higher than usual.
The company issued Wallin Industries an additional overage charge for what the company said was an overflowing bin, but Wallin alleged it was deliberately staged by the Waste Management employee - and Wallin said he has video evidence. Global News has obtained the security footage, which Wallin said shows the Waste Management driver altering the appearance of the bin for photo “proof” that it was overfilled.
“It shows the driver pulling up, he gets out of the truck, he unlocks the bin, he reaches into the dumpster, starts pulling out a little bit of cardboard, hangs it over the edges,” Wallin said.
Wallin said he contacted the company to complain, but was given the runaround until finally hearing from an executive at Waste Management’s Toronto headquarters. “In my eyes, it’s just not acceptable," Wallin said.

    All fingers lead back to one person, Justin Trudeau we all knew that trucking companies whether they’re garbage companies food distributors any type of company that has trucking would come up with schemes to replace the money lost in this carbon tax bull crap. Just admit his resignation or have his paycheque forfeited. He’s been nothing but a nuisance to this country.. it is horrible to see the company such as waste management. I’ve already caught on turning this country into a dog eat dog. Trudeau must go plain and simple. Unfortunate that waste management had to pull the scam but this is just the beginning very unfortunate.

    The news reporter didn't do their jobs properly. They should have contacted current truck drivers and former truck drivers through LinkedIn and asked them if there was an incentive structure for the driver from doing fines.

    Right. Its time to find a hungry lawyer. WM is a multi-billion dollar international business. Esp now that this story has received media attention, getting a willing lawyer involved should be easy.... He will have to move swiftly with a subpeona to obtain personnel records, for the purpose of gathering their firsthand witness testimony. Social media should make it easy for him to find more customers like this one though, with inflated bills in hand. And viola! Class action lawsuit 👩‍⚖️ WM's next move will of course be to clandestinely approach the prosecutor and/ or the judge involved with a secret offer.... Then a slap on the wrist in the form of an affordable fine. Let the heat cool down for a year or so, then back to business as usual! Same old story, different century

    I don't know Canadian law but I'd say go after the driver and sue him. Harassment for starters and any other creative charges. See if he rolls over on management or even corporate. It's unbelievable that management denied it after seeing the video. I believe they're encouraging this behavior.

    Branch mgmt & HQ execs will never admit wrongdoing, esp publically. Even when its shockingly obvious. Sound familiar?     They're the only garbage pickup you can get in a lot of places. I HATE this company because i've had an awful experience dealing with them, but there are no alternatives except taking all your garbage to the nearest dump yourself every week.

    We have been getting the same ridiculous overage charges at multiple properties for years now. We have to work with the account rep to get them reversed. For us what happens is that waste management fails to come on their designated pickup day. They've gone multiple weeks without picking up garbage, and then when they do come they take a picture of the overage and try to charge us for it. It's absolutely absurd and it continues to happen.

    Well, how was the employee individually rewarded, did he receive a bonus or commission for every overcharge he found? Even if so, the company should take responsibility for having a policy that rewards unprofessional behaviour. Should it just be the employee that's fired or his supervisor too and how far up the chain does responsibilities lie. I'd say that at the very least the supervisor and the employee but the entire company should pay some restitution not just waiving the fee.

    The only appropriate company response to avoid perceived complicity in the crime is "We apologize for the disgraceful action by our former employee, who has been suspended pending dismissal. We have refunded twice the amount overcharged, and will be investigating to ensure none of our other customers were affected."

    Scapegoats are a necessary evil at any poorly run business, it allows them to dodge blame and continue on. They may even claim to have dismissed the employee, but won't release their name due to legal/privacy reasons. The clients on the route won't see him again, because he will have gotten a promotion.

    WM "services" my area. My recycle bin is 64 gallons. I upgraded from 32 gallons because it is free (no upcharge on bin nor increase in bill). I usually don't fill a 32 gallon bin, but occassionally need more. I live in western Washington, which means it tends to rain in the winter. Before upgrading to the 64 gallon bin I called WM to ask how extra recycling works. I was told that I could place 1 cardboard box next to the recycling bin at no additional charge. I explained that it was the rainy season and how that the cardboard box wouldn't hold up well. I was told that that was the policy. That lead me to finding I could get the 64 gallon bin for free, which I did. Shortly after I got the larger bin I had a broke down cardboard box that pushed one corner of the lid up about 2 inches. The bin was about 1/4-1/3 full. I could have bent the box over but didn't think it was a big deal. My next bill I was charged for overage on recycling. I called WM and they said the fee was because the bin was over-filled. I explained that the bin was only 1/4-1/3 full and that it was a single broken down cardboard box that pushed one corner of the lid up about 2 inches. I was told that if the lid doesn't lay flat it is considered over-full and that I would be charged the overage. I asked if I could put a cardboard box next to the recycle bin and fill it with recycle. I was told "yes". I asked if there was a charge for that and was told "There is no charge for the first cardboard box". I said, "So I could have not broken down that box and just left it next to the recycle bin and I wouldn't be charged". The answer was "that is correct". I asked what happens if the cardboard box is soaked with rainwater and can't be lifted without falling apart. I was told that I would be responsible for the cardboard box. WM charges a set bi-weekly fee to pick up recycle, this is NOT optional. You get charged whether you put out 0 gallons or 64 gallons plus 1 cardboard box. If the recycle bin lid does not Kay flat you get charged an overage fee, even if this is the only time you use the service in a year or years. If you use a cardboard box and it causes litter, you are responsible. You can't use a plastic tote, perhaps with a lid. If you place a cardboard box and wind blows items out, or blows the box causing it to tip and empty, you are responsible for cleaning the mess. If you place a cardboard box and it rains, destroying the box, you are responsible to clean it up. If you place a cardboard box and WM drops it, you are responsible to clean it up. WM also has a policy where garbage bags are not allowed in recycle. This means that when they dump the recycle bin into their truck's Hopper it is likely (as in almost every time) that some items will fall on the road, the ditch, and/or your yard. Then there is how after it snows, they won't pick up garbage or recycling. All it takes is a couple inches of slush. They will inform you that they will pick up on next regular day. We've had winters were some customers didn't get garbage and recycle picked up for up to 6 weeks. I've gone 3 weeks with no garbage and 4 weeks with recycle pickup (recycle is scheduled every 2 weeks). WM had no plans to remove the charges until enough people complained to the state utility commission. A few years ago they weren't able to complete routes, which they said was due to a lack of employees when I called them. WM informed me that I could take my recycle to the dump for free. Ignoring the time and gas to drive to the dump and probably wait in long lines. There was no mention of free garbage dump. I called the state utility board to inform them what WM was doing. At first they thought there was nothing wrong. Then I explained that WM's employee shortage is not the customer's fault. We should not be charged for service we aren't receiving. All I got from that was a discount from the normal rate. Of course the state allowed WM to increase their rates, likely including the costs of those discounts.

    @@chris-_-3073 sure I could have. When I put the recycle bin out I never thought a 1/4-1/3 full bin would get charged for an overage simply because the lid was about 2 inch from closing. I didn't find out about the charge until I got the bill. WM sends brochures on the limited items they accept for recycle, but nothing about being charged an overage simply because the bin isn't fully closed. Another example. One day my dad was coming home and saw a garbage bin about a block from his home. It was destroyed. When he got home his garbage bin was missing. He drove back to the bin to find out it was his. He called WM and told them what happened. He was told "Yes we already know because someone saw the WM knock it over." WM dropped a new bin off a couple days later and never picked up the old destroyed bin. My 84 year old dad had to take it to the dump. Apparently the WM driver knocked the bin over and didn't bother to get out of his truck to fix it. The bin fell partially under his truck and he ran over it, then other cars and trucks hit it and pushed it down the street. His next bill included a charge for the new garbage bin. When he called about the charge he was told that he was charged because he didn't the old bin. Needless to say, my dad was pissed. They never told him that he had to return it, they never attempted to pick it up, he drove over 20 miles each way to take it to the WM dump where they could have collected it, and it wasn't his fault that WM destroyed the bin. Eventually a supervisor agreed to remove the charge.

    I used to drive for WM. There is a quota drivers have to attain in taking pictures of overloaded bins. If they don't make it they are reprimanded, also for every overloaded picture they take drivers are rewarded with gift cards.

    So your not smart...he did that because thats how you dump trash and not brake the trash lids.... The COMPANY, did it not the trash man (unknowingly). He was 100% doing his job and went the extra mile to prop open the lid for it not to snap. How I know? My family has worked for garbage company's, I've personally help garbage trucks at 2 work sites. They do the exact same thing and to make sure they don't damage the metal/plastic trash bins.

There is no way the guys who operate these trucks care whether the lids get broken or not. Equally, there is no way the guy in this video was doing it without malicious intent. It’s all a big scam, and he is clearly part of it!

    ​@@nboddie1036dash cams only have a limited amount of memory. My unit recycles the memory every 3 hours but it will save anything that I indicate to save by pushing a button. You can program my unit to tell it how much to save so it would be very easy for this image to be saved without saving the driver setting up the situation.

Normally $60 to dump the bin waste and getting charged $350 for an overflowing bin...Sounds like they only gotta defraud a few dozen people per month to make BIG returns.

    @@KayJay940 If the bins had a potential for becoming frozen, then merely opening the lid at the start should have been good enough. There was no need to proceed to prop the bins open. Additionally, the driver then took a photo as "evidence" for the overflow fine on the bill, so there was open deceit in those actions. And the fact that the driver would not directly benefit from this apparent fraudulent action means either they just have some malicious intent, like a personal vendetta, or they are on some kind of kick-back/"commission" system with upper management.

    we used to deal with this company. They were charging us 45 every month extra as an organic surcharge. We thought it was because staff was throwing their organics in there so we monitored it to make sure that was not happening. yet we still got a 45 surcharge. when we called to inquire they told us point blank that it was because we did not opt into their organic recycling program and unless we can prove where our organics are going the charges will continue. A MORALLY CORRPY COMPANY which largely stems from their CEO who in my opinion should be defecated on

    My family just switched from waste management in the US recently. They started only picking up or trash once a month due to "worker shortage". Once they got the trucks rolling again, still stayed at once a month. After we'd call and complained, the next couple weeks would be fine, then back to skipping. On the 3rd time complaining, nothing changed. We dropped them after not picking up after 4 weeks.

    Places I've worked at have had similar issues with recycling. To the point where every dumpster has to be locked is the fact of life. If they find one non recycle item in the bin they can and will fine you. So when random people drive by and dump a Microwave in your bin, you get in trouble.

    Bad move, trash and recycling are monopiles there are no other alternatives, unless your going to take your own trash to the local dump that may or may not be free to use. Even then the county will watch you for ways to charge you for trash being left around your property to try and force you to recontract with the corrupt trash company, this is called reigning in the wandering sheep, can't have a trend like that take hold while their collecting their bribe money.

    There is more to this story. There has to be an incentive for that truck driver to do what he did and that had to have come from management. My bet is the drivers are given bonuses for reporting over loaded bins. I have no doubt that WM made a conscious business decision to blatantly rip off their customers.

    I can’t say that I’ve had the same thing happen but after WM caught our local waste hauler ( in Montreal ) there was nothing but problems, overcharges and a practical impossibility to reach the local offices. It has been a terrible experience dealing with them. Prior to WM running the show our experience was great, even the driver lines his job. He has even given me his personal number in case I had any concerns or if I wanted him to arrange extra service with his office.

    WM charged me an additional fee because my can was "overfilled" when the lid was pushed up about 2". But weekly I see other people have their kids unable to close. It's insane what companies are doing

    One has to look at the incentives here. Those drivers do not get out of their trucks for nothing. This is either a poorly devised incentive plan to get these kinds of charges or a personal grudge between the driver and the business. Given the fact that the company used a very edited version of their on board cameras to stick the charges makes me think that this is being encouraged by WM.

    They really are in Canada look at the comments lots of people from Canada making excuses for them that why keep voting for same prime minister that is selling Canada's land to China.     I used to have WM for my residential pickup. After a few years of the price constantly going up due to added fees, getting the runaround on the phone, not being able to speak to someone local, I canceled and went with a local company for less than 1/2 the cost. Their business is just down the street from where I work.

    To claim that the driver did this independent of the company, they would have to show that they rewarded the drivers directly for each overcharge claim either as a bonus or a commission, but even then they would have promise to stop incentivizing crimes as well as take responsibility for a policy that rewards unprofessionalism.

    Attempted fraud is a crime in Canada is it not? Where I live if you get caught messing with a power meter, one punishment is you get charged a full year at the maximum rate of your box. Sounds like they need to make it up to him.

    That's a international company, they need to be under world wide investigation! If they are doing it in one location, all locations are now suspect!
