This ignores the fact that the commerce clause was to prevent states from raising tariffs on each other- not to override the rest of the constitution and grant congress nearly unlimited power. FDR threatened to continually add justices to the supreme court until this power was approved.

@@david52875 It didn’t really give congress unlimited power. They reached a conclusion based on whether the farmers decision had any effect interstate commerce. And it technically did.

@@Rocky-fk3ol You can argue literally anything has an effect on interstate commerce. Even intrastate commerce. Even intrastate non-commercial activity. See Gonzalez v. Raich

@@david52875 I saw the case. Yes anything can technically count as interstate commerce, but the question is, what limit does congress have under the commerce clause? These cases may seem like congress has unlimited power. But congress is limited by the constitution. Schechter Poultry Corps. V. United States.

And thus the entire 10th Amendment was rendered moot. Why bother to even have states?

I wonder if corruption from larger commercial wheat farms had anything to do with the passing of the Agricultural Adjustment Act in congress.

Just because he couldnt grow his own wheat doesnt mean that he would necesarily buy wheat on the interstate market. I dont think that using the commerce clause like that is justified in this situation because at this point you arent regulating interstate commerce, you're just exploiting people financialy by requiring them to buy stuff.

The idea that Congress, or any branch of government, can tell us what to produce, how much to produce, or how to manage it, is light years from what the Founders intended. That is central planning in the Soviet style!

We’d have to literally restructure the entire legal framework of almost every single major law passed since this case was decided. It would throw the entire economy into utter and complete chaos and many federal agencies like the EPA, ATF, FDA, and DEA would lose almost all of their power completely. As most bans on goods would be lifted and people could make their own heroin or meth at home. This is one of the reasons that prohibition, the banning of the sale and production of alcohol, needed a full constitutional amendment to pass.

The courts decision was very controversial. But you gotta look at it from the supreme courts perspective. The courts had to look purely on the effects the farmers decision had on commerce.

Because Filburn was engaged in federally regulated commerce as a “farmer”, even his locally produced wheat was decided to be subject to their industry regulation😒🤔… If Filburn was not operating a business(the locally run dairy farm), then his activity would have fallen outside of congress’s control IMHO. Still the dumbest decision ever adjudicated legal, next to “the new deal” that started it…

It's worth it guys how else would we have really smooth roads?
