    This was super helpful for me. It's shocking that someone can just make up convincing lies about you and get a DA to file charges against you without your even knowing, and you are left with the aftermath of expense and clean up of your reputation. There is a real need to reform the Criminal Justice system so that evil and narcissistic people can't just jeopardize your life, reputation and well-being with no accountability or repercussions. When the accused is actually the victim, how can you get relief from this unjust persecution in your life without having a chance to prove that you are "innocent until proven guilty".

    It a travesty that a truly innocent defendant should take a class or program to patronize the ego or insecurities of a prosecutor's confidence. That is not what our constitution stands for. If you are innocent but must succumb to such nonsense than everyone who has died in any American war would be for nothing. Either you stand for what is right or you do not. A Procecutor takes an oath. A inoccnt person doing penance, that of the guilty is not JUSTICE!

    @@tre_4 honestly, i will never recover, this corrupt system we call our justice system has turned me completely against them, until every single one of them are replaced, i will always know their criminals, rite down to our police, they violated me and i was completely innocent, i had an ex police of 50yrs on the force testify as their reason to stop me was not legal, and the judge said " do to the officer having him under arrest before he varified if the reason for the stop was legal or not i let all the charges stand " i was sentenced to a yr and half in jail for their made up charges, i appealed it and gotten out of jail but it cost me over $7K, the prosecutor doesnt have an oath on file with court or secretary of state, he is an imposter.

    This is exacytly what my son and I are going through. My son is totally innocent and he has been locked up for a year and a half waiting to go to trial. They have gotten 22 continuances against our objections. This system is FAULTY AND NOT RIGHT!!!

    This is what I am experiencing. I'm bearing the cost of lawyer, driving 7 hours to the County that took it up. AirBB, lost work, stress, etc. Mine has been going on for 11+ years. All because a DA has no interest in the truth or justice or that someone is being victimized. Wait until she or someone she knows experiences this.

    90 thousand people can tell you. My dad was almost one of them no thanks to the asshole detectives that took the word over a witness but not my dad's air tight alibi. He plays bass in a band and was 3 hours away the very second the crime happened. They never checked his alibi CPS checked it. My favorite question, What if my dad was home at that time?

    I'm going through it now. I'm being prosecuted for taking a car that was titled,insured,registered in my name as well as the loan. Their using a video that shows a vehicle leaving their lot 4 days after it was repoed from their front line up. I was told the tow records don't matter for that don't matter. If the dealer says it was there out, paperwork, videos, and pictures don't matter even if it shows otherwise. A judge has already removed himself from the case. The county senior probation officer is relates to the dealership owner. I can't wait to goto trial and all this comes out.

    Mostly an attorney tries to get you to plea bargain, so he gets paid and the courts get paid, also a plea deal keeps you from being able to sue the public servants, if you are innocent do not take a plea deal, demand a jury trial and be ready to show how you are innocent.

    The truth might not matter to the lawyers and the judges, but it matters to God, the people and communities who are harmed by injustice. When the real victims are injured and falsely accused and the truth is hidden and lies are allowed to be written down because of liars/perjury and the people and communities know the truth, they will no longer trust the justice system or government. Then the justice system/government will have much bigger problems. They need to make damn sure they are not falsely accusing innocent citizens. The same applies to countries and sometimes it causes Wars that are costly and cause a lot of death/destruction that could be prevented. It is written, You shall know the truth and the truth shall set you free.

    My GOD I'm so scared! The landlord wants me out. The only other tenant here lied and got a restraining order against me! I'm 61 i mind my own business I can't go to jail bc I have CATS & no friends & the landlord will either rob me blind or throw my cats & me out while I'm not there! I just wanna die.     In some places, elderly are a protected minority, mostly age, but if you have a disease, or handicap, you may be an affected person. According to the judicial system, you do have rights. But maybe it's time to move on.

    *We who labor here only seek truth* … with the purpose of getting Justice. The truth also needs to be relevant information, because someone could speak true facts about something unrelated to the question. In a discussion between facts, common sense wins.

    While I think your perspective describes how robs really are accurately, what you described is a perverse set of incentives for the prosecutor. Prosecutors seem to think their proper role is to work for the government (ergo usually police or complaining bureaucracy), or perhaps to be direct adversaries for the defense and thus work against the defendant. This is wrong. They're job is to work for the people and society. They includes the victim and potential victims, but only if the victim is truly a victim. Perusing truth should be foremost in their minds, else prosecutorial discretion becomes an avenue for corruption, as we've seen happen more and more over the last century. There's really only one avenue to correct this set of perverse incentives, and that's the elimination of prosecutorial immunity. Prosecutors currently have no desire to persue the truth unless, as you say, they are exceptional because they face no consequences for vigorous prosecution of the innocent or failing to prosecute the powerful guilty, but they do often face consequences for the opposite of those things (such as fallout with police or political pressures from powerful connections). Some ethical prosecutors think that giving them liability for obviously bad prosecutions will place them in an impossible situation where they must face those same perverse pressures while also being liable for doing so, but I think that's short sighted. Police went blame a prosecutor for dropping a bad charge they wanted if the prosecutor is protecting himself, but they will if they know he merely wanted to. If course frivolous suits always become a risk, but so what? That's something the rest of us have to live with daily, and it's perverse, even unethical, that the elite political classes immunize themselves in special ways.

    Thank you for the bad news, what a blow! Aspergers is not the right problem to have with the court system. What when all my attorney did for me, was to contradict guardianship, but did nothing to defend me, as well as telling me to say as little as possible in there, please? I presumed he had prepared defense, but now realize he did not want it to show that Guardianship was unjustified. Can I get damages from that attorney? He did nothing to help me get stress help + sleep, and wasted 1 year, letting me study US law online at night, instead of him providing support/ preparing me. I was withheld the chance to choose attorney , he was employed by Social (in)Security who have been withholding me the Personal Assistence had been approved for. I am slowly being killed by massive abuse, being withheld healthcare, therapy, they stole my money and home, and undermined my compromised health. And nobody informed me that truth, details and circumstances were unwanted..

    wait what? i have aspergers and i am about to make a declaration in order to clarify a case i tried to motion to dismiss as prosecutor, but for being criminal case and doing so makes me get a misdemeanor, the thruth and my ethics will stay clean at least, but at least no one would be in there with false accusations and the rule of law would be ruling as its supposed to, is me doing the right thing something bad bc it puts me in there and free the inocent? i think not

    Hey I have a question. I was at my local casino for new years... As I was ready to leave my wallet was missing from my pocket.. I asked if they found it. PD was called because a dollar bill with cocaine was found inside. I got a summons to appear in court. Is their any way I may qualify for diversion

    Ask for injured party or to see a valid contract with your autograph that was breached. If none exists they must dismiss. It’s not about the facts of the case and don’t identify as the all caps name, it’s the name of the trust the judge as trustee and administrator is administrating on your behalf. You are beneficiary. Ask them to balance the books and settle the charges.

    Not really, i was found guilty by the judges personal opinion, yet the trooper never had probable cause to stop me, he then made up interfearing with government operations, resisting arrest. Led violation and no d.l., all of it was under color of law, they are all criminals stealing from The people.

    That’s the problem though, by the time you get an opportunity to tell your side against the prosecution you have to go to trial. If you are innocent do you take a plea that guarantees you don’t get jail time or do you risk going to trial on the slim chance that a jury will believe you over the other person? If they don’t believe you then you get jail time, way more than was offered in a plea, then you get to lose your job, your family, your reputation. . I find juries to be very unreliable, the simple fact that you were arrested and accused is enough to create enough bias against you that you hardly stand a chance.

    @@SewFloSewingThe judge will inform the jury that the arrest isn’t proof or evidence that you are guilty and also tell them that at that point you are innocent.

    What are you saying it’s so corrupt that if you say something you’re gonna go to jail… if you lose your case you’re gonna go to jail? You’re just gonna let the criminals go free? It’s not about justice it’s about putting criminals away so they don’t hurt other people

    This guy is hilarious. Basically justifying the need for attorneys in a way which eliminates a need for truth? Haha. "Qui Pro Domina Justitia Sequitur", justice, "veritas" = truth. There is no justice without it. More lawyer speak for, "we like to inflate a system which requires our services by increasing the number of laws necessary for citizens to follow, and taking their money when laws are broken. There are 32,177 laws regarding the operation of a motor vehicle. Chances are, you break 200 before you even put your car in reverse. It's about revenue stream. So just say that.

    Same with felonies. Here in California it used to be only serious things like murde, rape, arson that are felonies. But now they have expanded that scope of what a felony can be a whole list of them too long to even mention

    This is America... so reality is more guilty till proven innocent by bench or jury trial. That's why so many people remain in jail pending trial where it's not warranted for public safety.

    But....the prosecutor has to prove your guilt beyond reasonable doubt, and when the evidence is so powerfully against a false accuser and they get impeached emphatically, the truth makes all the difference. If a witness has poor credibility and is exposed as a liar, the prosecution will want to quit because they are not going to win the case. I understand your many valid points Lance, but if the truth isn't so important, then the conviction rate would be far higher than it is.

    What you have to remember is that "Proof" is in the eyes of the jury. Unfortunately, many innocent people have had cases "proven" against them due to they way humans work. In our estimation it is best to get a dismissal or other positive outcome by avoiding subjecting an accused to the bias of others simply because they are accused. Great points.     So basically avoiding trial is really the ideal... damn. My situation is the situation you've stated. I've got a bunch of texts proving they're unstable and abuse me, now we await deposition. And I guess prosecutor wants a meeting before the deposition now hope it's a good thing
