With all of the talk about expanding the number of Supreme Court justices, what exactly does the Constitution say? Past presidents have faced the same tricky dynamic of a Court that is hostile to their policies, and efforts to dilute their strength don't always end well. In this video, featuring Harvard Law School professor Noah Feldman, Bloomberg Law examines what the Framers envisioned for the high court and the long history of presidents and Congress attempting to shape the Court to fit their political needs.     i think it's crazy that this video has only 624 views when it is a great video and tries to be as unbiased as possible. meanwhile other hyper partisan videos have hundreds of thousands if not millions of views.

    Why is the number of Supreme Court Justices not tied to the number of District Court of Appeals as it was before FDR? What reasoning was used to not re-establish

    Maintaining "Checks and Balances" was the reason that Members of Congress used to prevent FDR from Court Packing. However, what wasn't mentioned was that there were elements of the Democratic Party that felt that FDR was going too far with the New Deal. The most notable opponents within the Democratic coalition were Southern Democrats who controlled some of the key committees in the Congress. They were reluctant to challenge FDR, because of his personal popularity and because The Democratic Party he led had supermajorities in Congress. (76 Senators and 300+ Members in the House). The Court packing scheme was their excuse to break with FDR on policy without losing popularity with their constituencies. In 2020, the two major parties are more polarized. The Democratic Party as a whole is far-more liberal than the 1937. The Republicans are far-more conservative than their 1937 counterparts.

    I disagree with adding any more justices. And what they don't talk about in this video is how important the checks and balances are. The judiciary's job is to unbiasedly interpret the written law. Democrats seek to use it to enact change and that is absolutely not the job of the judiciary. If the senate were to somehow have more democratic leaning then it would only be fair for the Republicans to have more influence in the house. That is the check and balance. It was settup this way to give the governtment enough power to protect your constitutional rights but not enough power to remove them or redefine them. By giving power of the house, senate and presidency to 1 party you essentially create a dictatorship. You give 1 party the full power to enact changes how they see fit. Instead the two parties should be meeting in the middle under checks and balances as intended. This keeps the government from radically changing too fast overnight. You give the government an inch and it will take a mile. I can't believe people are wanting to rely on the government for supplemental income. Have you seen those children fight in congress? You really want to give them the power to hand you just the basics for survival. It didn't turn out so well for venezuela. The purpose of the constitution was to ensure that the government didn't become to powerful. Its no secret Biden and Kamala wish to uproot the 2nd amendment. What more will they do after they redefine our rights?

Trump has no checks and no balances. If yall had it you way there would be one party, the Republican Party. Most centrists are just closet conservatives. And the government gives plenty of welfare to big corporations, why not the working people? Then it is your duty to rally your boys and fight back. If you think you wouldn’t be able to garner enough support, it is probably because we are objectively freer than any time in history. While you liberals were focusing on winning over the culture through theater and emotions, conservatives for decades have been arming themselves to the teeth, joining the military, and getting actual worst case experience.     I really hope US politicians do not let the Court to be packed. This is an actual slippery slope and it means that future judges will always be picked with regards about ideology and not necessary the ones who respect the consitution above all, first and foremost. So not only could the court numbers swell but also the quality of the picks could go down drastically. Since the court is 6-3 we haven't yet seen any rulings that would show that the court is pushing an agenda, without regard for upholding the constitution. I would prefer if during election year presidents would abstain from nominations and if the nuclear option (Democrat idea once again, adopted by Republicans later) would be reverted. I say this as a citizen of EU, who believes USA should uphold their democracy above all as it's role model for all western countries.

    Unlike FDR, Trump isn’t adding seats to the SC. He’s simply filling in seats that became open. 3 seats became available under his administration. He’s following his constitutional duty to fill the open seat whether you like it or not.

Originalist interpret the constitution using the definition of the word when it was written not today’s definition of that word.
