@@ryanyeethegifted Sulu’s ownership of Sabah can be disputed. Because Brunei Sultanate (original owner) granted North Borneo (Sabah) to BNBC dated 29/12/1877. Much earlier than the 1878 agreement. How can it belong to Sulu if Brunei can give it away? Sulu Sultanate relinquished its territories to the Spanish under the Bases of Peace and Capitulation Agreement on 22/7/1878. Sulu has nothing left. Thus the 1878 Sulu-BNBC Agreement dated 22/1/1878 is null and void. The cession of Sabah from Sulu to PH in 1962 is invalid. Try reading what is uti posseditis juris. PH can only claim territories given by the US (PH colonizer) under the Manila Treaty of 1946. No Sabah.

Based on previous territorial dispute cases, if a country has been controlling and governing a territory for decades and had managed it successfully it is entitled to the land. Besides, the native Sabahans have chosen Malaysia. It is the people's right to determine their future. Why would the prosperous Sabahans want a flood of impoverished Filipinos from the south to flood their state and bring crime and the standards of living down? Look at the Taiwan case: Taiwan claimed the Taiping island (the largest island in the South China Seas) as theirs on the basis of having governed and 'lived' on it for decades. Nobody is challenging their claims.

If you called it rent, where is the agreement between Sulu and Malaysia? If none, it is just like what pirates and mafia do for a living. Why in the 1878 agreement, was Malaysia not mentioned? Is there any clause in the 1878 agreement that Malaysia has the responsibility to continue paying Sulu? Why do the receipts in Sulu's possession not mention the money is for the rent? Why is the amount so small and not what has been stipulated in the agreement? One Mexican gold dollar (coins) in 1878 weighed 1.7 grams of gold. So, 5300 X 1.7/1000 = 9.01 kg of gold. Compare the value of 5300 Malaysian dollars to 9 kg of gold. Giving away money is not an offense. Can give or stop giving any time.

Sulu/PH needs to resolve 3 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu needs to show undisputable proof that earlier, the Brunei Sultanate (original owner) gave North Borneo (Sabah) to Sulu as a gift for assisting in Brunei’s civil war. This is to rebuke the existence of the 29/12/1877 agreement (consisting of 4 agreements) signed by the Brunei Sultanate that grants the whole of North Borneo to the British North Borneo Company (BNBC). These agreements exist and are kept at the National Archives in London. The word “grant” has been used, and it has never been challenged or protested by Brunei, even when the British turned North Borneo into a British Charter (1881), Protectorate (1888), Colony (1946), and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let's assume North Borneo belongs to Sulu. The Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and the Carpenter Agreement on 22/3/1915 with the US. Later Spain and the US relinquished North Borneo under the Madrid Protocol of 1885 and Anglo-US Border Convention 1930 to the British respectively. In the end, Sulu has nothing. Thirdly, PH claims North Borneo (Sabah) is null and void. For any colonized colony that seeks independence, the territory (sovereignty) is based on what has been given by their colonizer. In this regard, the principle of uti posseditis juris is applicable, acceptable, and recognized internationally. PH got their independence from the US in 1946 and under this principle, there is NO North Borneo. Rebut with facts and references. Not hearsay. The UN has recognized Sabah in Malaysia since 1963.

Why is the amount so small in value and not what has been stipulated in the agreement? Why did Malaysia give the money from 1963 until 2013? But the agreement was dated 22/1/1878. When Sulu relinquished its territories and dependencies to Spain on 22/7/1878, it left Sulu with nothing. That 1878 Sulu-BNBC agreement automatically became invalid as Sulu lost its ownership. Why must we pay when Sulu is no longer the owner? Why did Sulu never complain about Malaysia not adhering to the above agreement? In 2013, when Malaysia stopped giving the money, why did Sulu never bring the matter to court? Giving away money is not an offense. Can give or stop giving any time Regarding your accusation that Malaysia supports MILF and MNLF, where is your evidence? Why not PH make a complaint to the UN?

How can it belong to Sulu if Brunei can give it away? Sulu Sultanate relinquished its territories to the Spanish under the Bases of Peace and Capitulation Agreement on 22/7/1878. Sulu has nothing left. Thus the 1878 Sulu-BNBC Agreement dated 22/1/1878 is null and void. The cession of Sabah from Sulu to PH in 1962 is invalid.

@@brandenburg2388 Sulu/PH needs to resolve 3 legal aspects before making any claim on Sabah from Malaysia.

It is a special 37-page report by ICJ that was published in 2001 and is easily accessible from the ICJ official website. It was a trial within a trial in the main court case between Malaysia and Indonesia over the ownership of the islands of Sipadan and Ligitan in Sabah. Philippines which is not a party to the trial requested permission to intervene. To comply with Article 62 of the Statute of the Court, the Philippines stated the objectives for the intervention (Section 7 & 84) namely, to safeguard and preserve the Philippines' historical and legal rights (only found in the 1973 PH Constitution) over North Borneo and to inform the court of the effect or effect of the court outcomes of the trial on its claim to the territories. In that trial, Philippines lawyers explained their case especially the Sulu-Ovenbeck 1878 agreement (primal reference) and related information to the court (Section 44 & 83). The same 15 main court judges were sitting at the bench and Malaysian and Indonesian lawyers too were present. On 23 October 2001, by a 14 to 1 vote, the court rejected the Philippine's request on the ground that there is “no interest of legal nature” (Section 93). If you called it rent, where is the agreement between Sulu and Malaysia? Why in the 1878 agreement, was Malaysia not mentioned as one of the parties? Is there any clause in the 1878 agreement that Malaysia has the responsibility to continue paying Sulu? Why do the receipts in Sulu's possession not mention the money is for the rent? Can give or stop giving any time

The ownership of Sabah by Sulu can be disputable.

How do you explain the existence of two agreements related to the ownership of North Borneo (Sabah) namely between Brunei Sultanate & BNBC (29/12/1877) and Sulu & BNBC (22/17/1878)? The only existing agreement involving the Sultanate of Brunei (original owner) is that agreement that Brunei granted and ceded North Borneo to BNBC on 29/12/1877. If the Brunei Sultanate had given North Borneo to Sulu much earlier, his majesty would not have signed that 1877 agreement. The signing confirms North Borneo belongs to Brunei and not Sulu. Why is there no protest from Sulu to Brunei for signing the 1877 agreement? Why was the Sulu & BNBC agreement not signed earlier in 1877 but 3 weeks later (1878) after the signing of the 1877 agreement. The original agreement in Tausug is missing during His Majesty's trip to Singapore, Thus, the validity of Sulu ownership of North Borneo is doubtful. How on earth can Sulu own North Borneo if there is no undisputable proof that the Brunei Sultanate gave it to them earlier? Unless there is a possibility the British had been scammed, deceived, or intimidated by Sulu into signing that 1878 agreement? The first agreement (1877) with the original owner is more valid in court.

Sabah is for Sabah. Sabah has greater autonomy than any Philippines state. And I don't think Sabahan want to lose it. this latest move by the Philippines could be viewed as an unexpected collateral outcome in its fight over the Palawan sea with China … the Philippines need to assert their claim thus they put a note to the UN … however if they assert formalnya that their continental shelf line without taking into account Sabah, they would inadvertently recognised that Sabah is not part of the Philippines … its a catch 22 for them … i think their bone is with China and not Malaysia or Vietnam … and perhaps the Philippines have made known this to the Malaysian Foreign Minister during his courtesy visit to Manila … and Malaysia’s response was quite calm to say the least … just a counter note to the UN and some political speeches to the public to divert the masses attention from the local political wrangling …

The issue of Sabah's ownership is a complex and contentious matter involving historical, legal, and political dimensions. Here are the key points regarding the claim that Sabah is part of the Philippines and was Philippine territory before the formation of Malaysia in 1963: 1. Historical Context: - The claim that Sabah is part of the Philippines is based on historical events, including the lease of Sabah by the Sultan of Sulu to the British North Borneo Company in the 19th century. The Philippines argues that this lease was not a transfer of sovereignty, and thus, the territory remains part of the Sultanate of Sulu and, by extension, the Philippines. 2. Philippine Claim: - The Philippines claims Sabah based on the historical rights of the Sultanate of Sulu over the territory. The Philippine government has maintained that Sabah is part of the country's territory and has pursued diplomatic and legal avenues to assert this claim. 3. Formation of Malaysia: - Sabah, along with Sarawak, Singapore, and the Federation of Malaya, formed Malaysia in 1963. The inclusion of Sabah in Malaysia was a result of agreements and negotiations between the British, Malayan, and Bornean authorities. 4. Legal Disputes: - The Philippines and Malaysia have had ongoing disputes over the sovereignty of Sabah. The matter has been brought to international forums and courts, although a resolution has not been reached. 5. Current Status: - Sabah is currently part of Malaysia and is known as the Sabah state within the Malaysian federation. It is administered as an autonomous region within Malaysia. In summary, while the claim that Sabah is part of the Philippines has historical roots, the territory is currently under Malaysian sovereignty. The complexities of the historical lease agreements, the formation of Malaysia, and the legal disputes between the Philippines and Malaysia contribute to the ongoing debate over the ownership of Sabah.

There is a court case recorded in 2001 by ICJ (International Court of Justice, The Hague) about the Philippines' claims on North Borneo. (Meaning Sulu/PH claim on Sabah is null and void) Type the statement below and go to the official ICJ website (a 37-page report): INTIZRNATIONAL COURT OF JUSTICE REPORTS OF JUDGMENTS, ADVISORY OPINIONS AND ORDERS CASE CONCERNING SOVEREIGNTY OVER PULAU LIGITAN AND PULAU SIPADAN APPLICATION BY THE PHILIPPINES FOR PERMISSION TO INTERVENE JUDGMENT OF 23 OCTOBER 2001 Notice the PH objectives in the intervention, its primal reference, and the verdict by the court.
