Who OWN SABAH: Malaysia Wins Court Battle Over $15 Billion Sulu Heirs Award in French Court
A Paris court has upheld the Malaysian government’s challenge against enforcing a partial award to the heirs of a former sultan who won $15 billion in an arbitration over a colonial-era land deal, Malaysia said late on Tuesday.
The ruling by the French Court of Appeal, questioned the jurisdiction of Spanish arbitrator Gustavo Stampa, who ordered last year’s eye-watering payout.
The Malaysian government says a new ruling by a French court could overturn a $15 billion arbitration award handed to Filipino heirs of the 19th-century Sulu sultanate.
A French arbitration court in February last year, ordered the Malaysian government to pay $15 billion to eight self-declared descendants of the defunct Sulu sultanate. Who claimed losses after Malaysia stopped paying an annual stipend, in the aftermath of a deadly incursion in Sabah by another group of claimants of the Sultanate.
The Paris Court of Appeal, however, ruled on Tuesday that the arbitration court had no jurisdiction over the case. The judgment also implied that the Paris Court of Appeal will annul the $15 billion award handed down earlier.
Malaysia’s winning legal battle in French Court of Appeals is likely to lead to the annulment of an award of nearly $15 billion over territorial claims over what is now the state of Sabah on the island of Borneo.
As part of efforts to enforce the award, the Filipino claimants had previously tried to seize three properties owned by the Malaysian government in Paris as well as assets of the Malaysian state oil firm Petronas in Luxembourg and the Netherlands.
Malaysian Government described the latest ruling as final and binding. And said it was a decisive victory in Malaysia’s ongoing pursuit of legal remedies, which Malaysia is confident will result in comprehensive defeat for the claimants and their funders.
The French decision appears to have brought to an end the strange legal case involving eight Philippine citizens who claim to be the legal descendants of Jamalul Kiram II, the last Sultan of Sulu, who once ruled over large parts of what are now the southern Philippines and eastern Malaysia.
The claimants said they would consider their options before the French Supreme Court. The court only signifies the validity of the jurisdiction of the arbitration court but does not conclude the legality of the claims.
Last Tuesday Court decision had to do with technicalities around the appointment of the Spanish arbitrator Gonzalo Stampa, who delivered the multibillion-dollar award to the Sulu heirs last year.
The French judges upheld Malaysia’s challenge against a partial award made by Stampa on May 25, 2020, during which he dismissed Malaysia’s objections against the arbitration proceeding and ruled that he had the jurisdiction to arbitrate the Sulu claimants’ case in Madrid.
The partial award was subsequently nullified by the Spanish High Court of Justice in June 2021, when it ruled that Malaysia had not been properly served ahead of Stampa’s appointment in 2019. In September, however, Stampa took the seemingly unusual step of transferring the arbitration proceeding to Paris, where he would go on to render the final award.
A French arbitration court in February ordered Malaysia to pay the sum to the Descendants of the last Sultan of Sulu to settle a dispute over a colonial-era land deal. The claimants last February 2023 moved to seize worth $2 billion of two Luxembourg-based units of Malaysian state oil firm Petronas as part of efforts to enforce the award.
The Petronas Azerbaijan and Petronas South Caucasus units were first seized in July 2022, but the Malaysian government obtained a Stay order to temporarily set aside the court decision made by a Luxembourg district court.
On the last week of February 2023, Luxembourg court bailiffs issued a second seizure order on the units and related bank accounts, according to the court documents shared by the heirs' lawyer.
However, On June 6, 2023, the France Court of Appeal make the judgment and ruled that the arbitration court that ordered Malaysia to make the payment to eight self-claimed heirs of the defunct Sulu Sultanate, did not have jurisdiction to rule in the case.

    The french court said they have no jurisdiction over the sovereignty of the case but decided on the propriety of the land w/c the Kirams won. The $15B award is still enforced.

    That is a false narrative created by the self-proclaimed Sulu heirs. North Borneo (Sabah) previously belonged to Brunei before they ceded the entire territory to the British under the 1877 agreement, in the agreement it clearly states that North Borneo will be ceded to the British North Borneo Company (BNBC). However the Sultan of Sulu came along and falsely claims that North Borneo belongs to them, and to avoid a possible war in the region the British enter the 1878 agreement with the Sulu Sultanate which states that Sulu will grant and cede North Borneo to the BNBC which was the original meaning of “pajak” and was agreed as such by both the British and the Sulu Sultan however the Sulu heirs of the now defunct Sulu Sultanate then twisted the original meaning and claims that the word pajak actually means “lease and rent”. The British then agreed to pay 5,000 Mexican gold coins annually to the Sultan of Sulu as cession money for North Borneo but the self-proclaimed Sulu heirs twisted the narrative yet again and claims that the payment is “rent money”.

    If you say it is a rent, then where is the agreement between Sulu and Malaysia regarding the lease and payment? Why in the 1878 agreement do not mention Malaysia as a party to that agreement? Why in the receipts of payment (in Sulu possession) did not state the money is for the rent or related to the 1878 agreement? Giving away money is not an offence. The amount not the same as in the agreement. So much less. 5300 Malaysian dollar vs 5300 Mexican dollar ( Each dollar is in the form of gold coin weighing 1.7 grams each. Total: 5300 X 1.7/1000 = 9.01 kg of gold. You check what is the value.)

It is a special 37-page report by ICJ that was published in 2001 and easily accessible from the ICJ official website. It was a trial within a trial in the main court case between Malaysia and Indonesia over the ownership of the islands of Sipadan and Ligitan in Sabah. During the trial, Philippines which is not a party to the trial requested permission to intervene. To comply to Article 62 of the Statute of Court, Philippines stated 3 objects for the intervention (Section 7 & 84) namely to safeguard and preserve Philippines historical and legal rights over North Borneo, to inform the court the affect or effect of the court outcomes on its claim to the territories and on the procedural issues in the court.     I would suggest that everybody reads the Judgement in I think 2001. This was a case that Indonesia and Malaysia took to the international court over the jurisdiction of Sipadan Island. The Philippines intervened as an interested party due to its claim. It was dismissed by a 14 to 1 Judgement. Everybody should read the reasons. The most pertinent point was raised by a Justice by the name of Francke (?). He said that the jurisdiction had been decided in 1963 (I think) by the United Nations. Also the fact that people have the right to self determination. As an added point may I raise the incursion into Sabah by Kirams people. This is why they have been determined as a terrorist group. Some are in Malaysian prisons with a life sentence. A few with a death sentence. I would be more concerned in getting them out of prison and execution than chasing monetary gain. Remember that a few of the Malaysian army were killed. They are not going to forget that. This is going to be my last comment as an independent as some of the commentators are firmly entrenched in their views without appreciating the pertinent facts. May your God go with you.

The only connection of the 2021/2023 arbitral court decision in Europe and the 2001 trial at ICJ is that the 1878 agreement (PH primal reference) is of no interest of legal nature. Meaning that 1878 agreement is not valid and cannot support PH request for intervention at ICJ namely to safeguard her claim on Sabah based on historical and legal rights. It is well documented in the ICJ 37 page report and easily accessible on the ICJ official website. If you read the comment from Judge Franck (one of the ICJ judges), Sulu claim is no more acceptible and can be ignore. Mind you that this court decision will become ICJ reference. For Sulu, my advise is for you to find something else and NOT that 1878 agreement.

    Malaysia was paying the lease it means they recognize that the true owner of Sabah is no other than the Sultanate of Sulu. It was only after few years ago that they stopped paying, when the heirs try to get it back because the lease payment were too low as if the value has never change since the original contract was signed between the Sultanate and Malaysia. This is a clear oppression in the part of Malaysian government and a violation of international laws.     If you say it is a rent, then where is the agreement between Sulu and Malaysia regarding the lease and payment? Why in the 1878 agreement do not mention Malaysia as a party to that agreement? Why in the receipts of payment (in Sulu possession) did not state the money is for the rent or related to the 1878 agreement? Giving away money is not an offence.

    Sulu/PH need to resolve 2 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu need to show undisputable proof that earlier, Brunei Sultanate (original owner) give North Borneo (Sabah) to Sulu as a gift for assisting in the Brunei’s civil war. This is to rebuke the existence of 29/12/1877 agreement (consist of 4 agreements) signed by Brunei Sultanate that grant the whole of North Borneo to British North Borneo Company (BNBC). These agreements exist and keep in the National Archives in London. The word “grant” been used, and it has never been challenged or protest by Brunei, even when the British turned North Borneo into British Charter (1881), Protectorate (1888), Colony (1946) and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let assume North Borneo belongs to Sulu. Sultanate of Sulu signed many agreements to relinquish its territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and Carpenter Agreement on 22/3/1915 with the US. Later Spain and US relinquish North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. No such thing as first nor second party. At the end, Sulu has nothing as it does not own anything right from the start. They just play ignorant. Rebut with facts and references. Not hearsay.

    The $15B award is not stop. The French court said they have no jurisdiction abt the sovereignty of the case only on its propriety. The award is base on the propriety of the land.

How on earth the arbitration court ruling is final and binding if the decision is based on evident is invalid and unconstitutional (Final Award). That is why that decision been overide by a higher rank court. To be final and binding everything must be right from the start.     North Borneo from its name already known as part of sultanate of Brunei. If there any country want to claim, its only Brunei may have substances. Even it didn't clear how part of North Borneo under Sulu Sultanate if any. During Spain colonial until American came in, North Borneo never under their jurisdictions. The only we can see overwhelmed of refugees, so called warriors from south Philippines. After too long war between them, the numbers of refugees keep increasing. And now they start claimed North Borneo once under their sultanate. I'm not aware how their sultanate have any significant position in Philippines government nowadays. Or they also living like refugees, I don't know. 🤔

    There is a court case recorded by ICJ (International Court of Justice, The Hague) pertaining to the Philippines claims on North Borneo. It is a special 37-page report by ICJ that was published in 2001 and easily accessible from the ICJ official website. It was a trial within a trial in the main court case between Malaysia and Indonesia over the ownership of the islands of Sipadan and Ligitan in Sabah. During the main trial, Philippines which is not a party to the trial requested permission to intervene. To comply to Article 62 of the Statute of Court, Philippines stated the objectives for the intervention (Section 7 & 84) namely, to safeguard and preserve Philippines historical and legal rights over North Borneo and to inform the court the affect or effect of the court outcomes on its claim to the territories. In the trial within a trial, Philippines lawyers explained their case especially the Sulu-Ovenbeck 1878 agreement (primal reference) and related information to the court (Section 44 & 83). The same 15 main court judges were sitting at the bench and Malaysian and Indonesian lawyers too were involved in this trial. On 23 October 2001, by 14 to 1 vote, the court rejected Philippines request on the ground that there is “no interest of legal nature” (Section 93).     Any Filipino and Sulu supporters would point to the 1878 agreement and claim that Sabah was lease to the British North Borneo Company (BNBC). But there are numerous evidence to point that Sulu did not previously own Sabah as the self-proclaimed Sulu heirs would suggest, the claim that the Sultanate of Brunei gifted North Borneo (Sabah) to the Sultanate of Sulu as a gift can be disputed and debunked by the following evidence: - 1877 Agreement Prior to the 1878 Agreement which was signed between the British North Borneo Company (BNBC) and the Sultanate of Sulu, there was an agreement that was signed in 1877 between the Sultanate of Brunei and the British North Borneo Company. Within this agreement, the word “grant” has been used numerous times. It’s also stated within the agreement that the entirety of North Borneo (Sabah) will be ceded to the British North Borneo Company (BNBC) for 15,000 Mexican gold coins . With these statements, it’s clear that the Sulu Sultanate did not own North Borneo (Sabah) and that the 1878 agreement is redundant. I would also like to point out that within the 1878 agreement, the word “pajak” was meant to be stated a “grant and cede”, and within the receipts of the so-called “rent payments” are listed as cession payment. Cession means to give something away. With that this proves that the 1878 Agreement wasn’t a lease agreement but rather a cession agreement. But let’s say for the sake of argument that the Sultanate of Brunei gifted North Borneo (Sabah) to the Sultanate of Sulu and that the Sultanate of Sulu did indeed own Sabah and that the 1878 agreement was a lease agreement. Yet the Sultanate of Sulu has signed many agreements which relinquishes their rights over Sabah. These are the following: - 1878 Bases of Peace and Capitulation Agreement This agreement highlights the Sultanate of Sulu’s surrender of sovereignty to Spain. This means that anything happens whether internal or external affairs is under Spanish jurisdiction. - Article III of the Madrid Protocol of 1885 The Madrid Protocol of 1885 was an agreement between the United Kingdom, Germany, and Spain to recognise Spain’s rule over the Sulu Archipelago. There is a particular statement within Article III which states that Spain will relinquish all of their claims on Borneo. This alongside with the 1878 Bases of Peace and Capitulation Agreement as stated previously shows that the Sultanate of Sulu now no longer have any jurisdiction over North Borneo (Sabah). This also means that North Borneo (Sabah) is now under complete British jurisdiction. - 1903 Confirmation of Cession This agreement was signed between the Sultanate of Sulu and the British North Borneo Company (BNBC) in which it states that the Sultanate of Sulu will grant and cede North Borneo (Sabah) as well as additional islands which is how the payment of 5,000 Mexican gold coins which at this point has switched entirely to the Malayan dollar increased to 5,300 Malayan dollars. - 1915 Carpenter Agreement This agreement was signed between the Sultanate of Sulu and the United States. Within this agreement it states that any power that the Sultan of Sulu has over his land has been given to the Philippines which is under American-rule. -1930 Anglo-US Border Convention This agreement was signed between the United States and the United Kingdom. This agrement also define the border of North Borneo (Sabah) and the Philippines with the agreement being that North Borneo (Sabah) will remain under British jurisdiction and the Philippines being under American jurisdiction. -1963 Malaysia Agreement Finally this agreement was signed between the United Kingdom, Malaya, Singapore, Sarawak, and North Borneo (Sabah) to form a new country now known as Malaysia. Now that North Borneo (Sabah) has gained it’s independence from the UK, they opted to join this agreement and with the previous agreements signed, it means that North Borneo (Sabah) now have self-determination. And with the UK approving this agreement under the Malaysia Act of 1963 which has been passed in the British Parliament. This agreement has also been recognised by the United Nations and agreed on by the UN General Assembly and the UN Secretary-General himself. This means that Sabah is now rightful Malaysian territory. With all of these facts in place, it’s clear that Sabah rightfully belongs to Malaysia and neither the Philippines nor Sulu have any legal claims over Sabah.

    Why Sulu never own Sabah simplified Brunei went to war and asking Sulu for help. Brunei on the edge of winning the war was when the Sulu arrived to help. Brunei never ceded eastern Sabah to Sulu but Sulu proclaim the land is theirs. Basically,Sulu is just a pirate.

    Sulu/PH need to resolve 2 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu need to show undisputable proof that earlier, Brunei Sultanate (original owner) give North Borneo (Sabah) to Sulu as a gift for assisting in the Brunei’s civil war. This is to rebuke the existence of 29/12/1877 agreement (consist of 4 agreements) signed by Brunei Sultanate that grant the whole of North Borneo to British North Borneo Company (BNBC). These agreements exist and keep in the National Archives in London. The word “grant” been used, and it has never been challenged or protest by Brunei, even when the British turned North Borneo into British Charter (1881), Protectorate (1888), Colony (1946) and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let assume North Borneo belongs to Sulu. Sultanate of Sulu signed many agreements to relinquish its territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and Carpenter Agreement on 22/3/1915 with the US. Later Spain and US relinquish North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. At the end, Sulu has nothing.     MalAysia went to Paris to insist their 0:02 sovereignty over the land. Paris court said we don't have jurisdiction over the soverignty of the land, go to the proper court, the ICJ. What was decided in Paris was the propriety of the land w/c the Kirams won.😂🤣✌️

    The only country that the Sultanate of Sulu reliquished their territory is the USA. When the Sultanate of Sulu lost to the Americans in 1913 (Moro-US War). The Sultanate of Sulu gave their allegiance and domains (including North Borneo) to the US gov't of the Philippines😂🤣

    Ha ha ha ha. During the US colonization of PH, Carpenter Agreement (22/3/1915) was signed by the Sultanate of Sulu which relinquished its temporal sovereignty of Sulu and its dependencies (including North Borneo). Later, the 1930 Anglo-US border agreement acknowledge the boundary delimitation between PH and North Borneo that belongs to the British. It is the same, either way Sulu lost everything. If do not accept this statement, then PH do not exist as its existence depend on all these agreements.

Based on the context of attachment of UN General Assembly 1541 (XV), number 4 principal 9, and evaluation of UN Secretary General (at that time held by Bhutan); the three countries, Malaysia, Philippines, and Indonesia HAVE TO WAIT SABAH STATUS DECISION BASED ON TERRITORY OWNER VOICE (FROM SULU SULTANATE), OR RESULT OF LOCAL PEOPLE VOTES IF SULU SULTANATE WITHOUT BEING FORCED HANDED OVER THE DECISION OF SABAH STATUS TO LOCAL PEOPLE WHICH WOULD BE SUPERVISED BY UNITED NATION; because it is related to law order of territorial tenure or decolonization (on the basis of rent document as a proof, SABAH IS NOT BRITISH COLONY, or IS NOT OWNED BUT RENTED BY BRITISH, SO THAT SABAH IS OWNED BY SULU SULTANATE, and BRITISH HAS NO RIGHT TO HAND OVER SABAH TERITORY TO ANOTHER COUNTRY). BUT MALAYSIA DID NOT OBEY THE AGREEMENT and IGNORED UNITED NATION RULE ABOVE through DECISION TO ESTABLISH FEDERAL STATE OF MALAYSIA AT SEPTEMBER 16, 1963; ANNEX SABAH WITHOUT RESPECTING THE OWNER VOICE, OR LOCAL PEOPLE WILL (if Sulu Sultanate handed over the decision of Sabah status to local people) AND WITHOUT RESPECTING UNITED NATION RULE ABOVE THAT WAS COMMITTED IN THE AGREEMENT. This Malaysia’s decision ignite anger of two countries (Philippines and Indonesia), so that in 1963 Philippines and Indonesia cut off diplomatic relations to Malaysia, and was followed by conflict and confrontation by Indonesia that was called “Ganyang Malaysia” at that time. Generally, INTERNATIONAL LAW (based on attachment context of UN General Assembly 1541 (XV), number 4 principal 9), enforces rule that TAKING OVER A TERITORY TO BECOME A NEW COUNTRY MUST BE OBEY THE RULE BASED ON ASPIRATiON (VOICE) OF THE TERRITORY OWNER’S DECISION. IF NOT, THEN THAT TERITORY IS PERMANENT BELONG TO THE OWNER. Because British was not the owner (rent document as a proof), then SABAH IS STILL OWNED BY SULU SULTANATE (British only as a renter to Sulu Sultanate according to agreement). SULU SULTANATE AS THE SABAH TERRITORY OWNER HAS THE LAW RIGHT TO DO ANYTHING RELATED TO HIS OWN TERRITORY.

    ​@@segado1584 Ha ha ha ha. It all started in 2019 in Madrid Court. Sulu claimants make an arbitral claim at this court and the court agreed to appoint Dr Stampa as the arbitrator. Here are the mistakes. Firstly Sulu deal with a sovereign state and need to follow certain procedures. No notification and representation from Malaysia. Also appointment of arbitrator must be acceptable by both parties. Then the court do not adhere to the Spanish Arbitration Law 2003 whereby the claimants must produce an arbitration agreement or clause with Malaysia. This is also the requirement under New York Convention 1958. Read Article 2 & 5. When challenged in June 2021, the court reversed its earlier decision and invalidate Dr Stampa as an arbitrator and all his decision is null and void. Dr Stampa brought the claim to Paris and he granted the Final Award to Sulu for 14.92 billion. Paris Court upholds but later Malaysia appealed at Paris Court of Appeals and been imposed Stay Order. Meanwhile back in Spain, Sulu appeal to Spanish Constitutional Court on the annulment of Dr Stampa as an arbitrator but rejected on 2/2/2023. Thus this confirm Dr Stampa decision is invalid. Back in Paris, on 6/6/2023 Paris Court of Appeals rejected Sulu claim to revoke the Stay Order because the basis of Sulu claim, Final Award is not valid. Now Sulu has no more basis to support the claim with other courts too. This is my brief explanation.

    North Borneo was not rented by Mal Aysia. It was the British Company (BNBCC) who rented North Borneo. When the British left, it was land grabbed by MalAysia. MalAysia had nothing to do with North Borneo. MalAysia was just land grabbers and thieves. MalAysia is known land grabbers in Southeast Asia. Be it known to the world.

    PH has a lot of pirates, even today. The purported Sulu heirs are just a bunch of pirates without anyone knowing their true identity/lineage. Therium was just trying their luck - Therium is just another bunch of pirate lawyers, which instituted an illegal arbitration with the help of Stampa. Stampa arbitration was cancelled by Spain's court, but he refused to stop his unlawful action and jumped to France/Paris court, to illegally continue the arbitration that had already been cancelled in Spain. Stampa is now facing a criminal charge in Spain The Sulu kingdom was disbanded when they surrendered to Spain ie the kingdom *effectively ceased to exist* once the Sultan surrendered to Spain. Spain then gave Sabah to British. Madrid Protocol of 1885 clearly indicated Spain gave North Borneo to British. A defunct kingdom which no longer exist can never claim right to any land, but these are rogue pirates who understand not , nor respect for any law. The same goes for the supporters of rogue pirates, they are just a bunch of thugs

We can now conclude that setting up a trading post with an agreement to the rightful ruler of the land is another way of conquering land by the British. Why then they gave up Palestine ,Jordan and other territories in mid east. The Federation also ignore the the protest of Indonesia and Philippines. There must be something wrong here. The UN should settle this dispute and both parties should respect whatever is the outcome.

    The basis of Sulu claim for arbitral award in several courts in France, Luxembourg and Netherlands is based on the Final Award granted by Dr Stampa who was appointed as arbitrator by the Madrid Court in 2019. When the same court in June 2021 invalidate his appointment and later the Spanish Constitutional Court (2/2/2023) decided his appointment as unconstitutional, that Final Award is invalid. How on earth the French court to uphold Sulu claim based on the Final Award that is no more valid. In the future, Sulu need to produce an arbitral agreement or clause with Malaysia if ever to open a new case in court in any country. Do Sulu, have it?

    Sulu/PH needs to resolve 3 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu needs to show undisputable proof that earlier, the Brunei Sultanate (original owner) gave North Borneo (Sabah) to Sulu as a gift for assisting in Brunei’s civil war. This is to rebuke the existence of the 29/12/1877 agreement (consisting of 4 agreements) signed by the Brunei Sultanate that grants the whole of North Borneo to the British North Borneo Company (BNBC). These agreements exist and are kept at the National Archives in London. The word “grant” has been used, and it has never been challenged or protested by Brunei, even when the British turned North Borneo into a British Charter (1881), Protectorate (1888), Colony (1946), and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let's assume North Borneo belongs to Sulu. The Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and the Carpenter Agreement on 22/3/1915 with the US. Later Spain and the US relinquished North Borneo under the Madrid Protocol 1885 and Anglo-US Border Convention 1930 to the British respectively. In the end, Sulu has nothing. Thirdly, after the second point above, PH claims North Borneo (Sabah) is null and void. For any colonized colony that seeks independence, the territory (sovereignty) is based on what has been given by their colonizer. In this regard, the principle of uti posseditis juris is applicable, acceptable, and recognized internationally. PH got their independence from the US in 1946 and under this principle, there is NO North Borneo. Rebut with facts and references. Not hearsay. UN has recognized Sabah in Malaysia since 1963.

    If you say it is a rent, then where is the agreement between Sulu and Malaysia regarding the lease and payment? Why in the 1878 agreement do not mention Malaysia as a party to that agreement? Why in the receipts of payment (in Sulu possession) did not state the money is for the rent or related to the 1878 agreement? Giving away money is not an offence.

    Ha ha ha ha. The case is based on the Final Award granted by Dr Stampa to Sulu. In the French Court of Appeals, Sulu appeal to revoke the Stay Order imposed earlier by the court. Now with the unconstitutionality of the appointment of Dr Stampa and his decision by the Spanish court, that Final Award is invalid. So with other court cases in Luxembourg and Netherlands will collapse as the "foundation (Final Award)": of the case is gone.

    A visit in Paris that influenced and change the decision??? A week before the Paris Court of Appeals give their decision, a Malaysian lawyer Azalina went to Paris. Her visits was coincide on the time when Paris Court of Appeals is about to announce their decision. This visit was Very Suspicious!!! Hmmmmm...something smell fishy! We don't know what she's doing there. Maybe: Negotiations ? Under the table ? Inducement ? Arrangements? Etc!!! Only God knows her intentions in her sudden trip to Paris!!! What we always know, that Malaysia has no credibility, and always making lies!!! Play fair, please Don't play the dirty games!!!

    The Sultanate of Sulu is the rightful owner. The British can't transfer the rent to Malaysian. Because it is not in contract with Malaysia or malaya at that time. The cobbold referendum was done in bad faith. Because it does not have the consent of the Sultanate of Sulu. They gather people to vote. We even don't know if those people are influence by the British.. to side with malaya at that time , They also make the u.n. notice the referendum. And agreed to it that it's the people. Who voted to be part of Malaysia.,,Malaysia has no historical ownership of sabah. The only ownership they have is the cobolt referendum and the British who sided with their crown colony..,,

    What undisputable proof do you have that Brunei give Sabah to Sulu as a gift? But Brunei Sultanate (original owner) grant and cede North Borneo to British North Borneo Company on 29/12/1877. If you say it is a rent, then where is the agreement between Sulu and Malaysia regarding the lease and payment? Why in the 1878 agreement do not mention Malaysia as a party to that agreement? Why in the receipts of payment (in Sulu possession) did not state the money is for the rent or related to the 1878 agreement? Giving away money is not an offence.
