There is so much confusion about Power of Attorney vs Conservatorship vs Guardianship.     Video was very informative!!! Its extremely important to have one of these three things when it comes to your love ones. Cause if you don't have one of those three things then the state comes in and takes over.

    I have been helping my aunt out for years, she’s 87, I’m the one that has taken her to her Dr appointments, grocery store, bank, run errands,?she never learned to drive or had a drivers license, so most of my life I’m the one doing everything for her. She has 3 adult children, one lives out of state for over 20 years, the other one lives close, but she won’t see her mom, won’t talk to her, basically disowned her mom, hasn’t seen or talked to her for over 30 years, and my other cousin committed suicide 21 years ago, which had a lot to do with her abusive ex. All these years later, out of anger and spite, my cousin decides she’s giving authority to my cousins ex husband to care for my aunt knowing how abusive he is and how scared my aunt is of him. She took my aunts apartment away, gave notice of moving, cancelled her section 8 that she’s had for decades, won’t let anyone in the family see her or talk to her, and weird thing is no one packed up her stuff, everything of hers, clothes, shoes, everything is still in the apartment . There’s so much more to this. I haven’t seen my aunt in 2 months, I know she’s sad being taken away from her comfort zone. She has early onset dementia, all this has happened without even my aunt going to the doctors to be diagnosed, and she is still aware and competent to make decisions. Do I start a petition?

    Something I didn't know, my father's attorney informed that I could have used the Durable POA even when my father was competent. For example, if he had been out of country and needed me to sign forms for him. I have been giving banks the letter stating that he is no longer competent, but was informed by his attorney that it was not necessary. We are in California. Thanks for this informative talk.

    Hiw well does a DPOA hold up in a conservetorship petition? I have a DPOA on my partner when he started showing signs of dementia . Ive been caring fir him goin on 8years.

    What happens when the person with POA is abusing their position and not allowing family members to see the elder person? What recourse is there when the person has dementia? According to this video no POA changes can be made once mental capacity weans. Can anything be done?

    Isolating a senior from family who can be supportive maybe seen as a form of abuse. I’d run it by your local Adult Protective Service agency and see what they say. The POA may be told they need to grant you visitation. Good luck.

    My grandma is worried my aunts will try and make decisions for her if she is ever disabled or incapacitated. If she assigned me as a durable POA will this prevent them from trying to get conservatorship of her?

    In order to petition the court for a conservatorship of a parent, do you need to have signed authorization from your other siblings before filing with the court?

    You don't need permission to file, however, in my experience, during the court process, all interested parties, such as sibs, will be notified that you are filing and of the hearing date. They will be provided instructions on what to do if they don't agree.
