    I wish police would enforce that more I had the mother of my child violate custody order yesterday and did not show up to the location for the exchange and all police told me to do was make a report.

    @@rogelioromero7762 do you have a parenting plan? If yes file a motion for contempt. If not file a parenting plan and request a hearing. Do not wait.

    @@rogelioromero7762 my ex did that to me. Luckily I made friends with the right ppl and a lady that is a family law attorney did me a favor and called a sheriff. Next exchange my ex didn't show up again and she was arrested for kidnapping and contempt. I got full custody and make my ex come to my home to visit and she is upset that I won't let her be alone w/my daughter. I have a new family court judge who refuses to put up with her bad behavior. The old judge wasn't happy when she heard what I'd done. I gave her the finger and told her to kindly buzz off.

    My daughter was awarded full custody last May. She recently broke up with her partner and moved back to where her family is. The father of the children deemed this to be unstable, and when the disgruntled ex decided to get revenge and feed the father and his wife a few lies , they didn't talk to their mother or get any legal advice, but instead used these lies to frighten the children. My daughter went to the home and calmly knocked on the door, the wife answered the door and loudly slammed the door in her face and was heard exclaiming to the children ," haha I slammed the door in her face". My daughter next went with the police to get the children and the father refused to turn them over. He said the children didn't want to go. He brought the children out and they agreed but when she asked can I just talk to them he replied "only with me standing with them". Her 11 year old daughter started to cry and hugged her mommy. She then whispered quietly in my daughter's ear " they said your going to hurt yourself". It's been 5 days now and her lawyer still can't get the kids for her. My daughter has a spotless record. She's never even been on any medication or ever shown signs of mental instability. They have no proof of anything like this. They have not taken any legal steps but have instead taken matters into their own hands and refuse to obey the court. This is all due to the fact that the father and his wife have contested the custody arrangement and the court date for trial is in 2 weeks. It should be noted that at the custody hearing when the magistrate announced that my daughter would have full custody, the father's wife shouted " I'm not paying her child support."

    My ex kept my kid from me the VERY first day I was supposed to get custody, then the next, I missed the first 3 weekends it was my time, my attorney filed to have the temporary order put back in place where I had full sole and full legal. We have court dec 28

    In my experience, the place to win on custody/visitation issues is with the family court counsels, people who have therapy background, not legal background. In a sense, do their work for them, make their life easy. The legal system everywhere operates on paper. First give a short factual summary of each of the parties. When and where born, educational history, interests, biases, etc, When and how the parties met. Family history, conflicts, differences of opinions. Current incidents. Keep it factual, no persuasion or rationalizing, no arm twisting. If you have some skeletons, better to admit up front. Yes, I was an alcoholic, but attend AA every week and have been clean for …. It is far better for the counselors to discover a pattern in the facts, (then they own it), verses you telling them the obvious. Declarations written by others who know both parties well can sometimes be a big help here. Most family court judges like to take the middle ground, often on the theory that both parents are somewhat equal contributors to the conflict. However, many family court judges realizing they know little to nothing about family dynamics and thus like to follow the recommendations of the court counselors. Most attorneys like to operate in their forum, the courtroom. Declarations in the legal forum are considered the lowest form of evidence and often dismissed as hearsay.

    My 15 and 14 year old daughters did not want to go to there moms due to documented violence in the home, so I told them if they don’t feel safe going there I will support there discussion. My 15 year old daughter chose to stay with me for several months visiting her mom only a couple times a month while trying to repair there relationship. Mom then filed rule to show cause with the court because I am not enforcing visitation. Did I do the right thing? Felt I was protecting my children.

    What you do if both parents live in two different states and the mother is award Joint legal custody and the father has legal Visitation rights. The father refuses to disclose his current living address and demands the mother to drop off the kids or he is calling the police and constantly threatens the mother verbally via text messages. The father disobeys the court every time and the mother stills let him see his kids because she doesn't want to go back to court.

    i have an established court order and it is 50/50 with my daughters mom since 2015 . for years she has not complied and i know i should have took legal action sooner . but she moved out of riverside county to san diego county without a 45 day notice which is required in our orders.. she wants to switch her schools also and i do not agree . we both agreed on where she would go to school back in 2018.. i have now filed for modification of child custody and visitation and put in my stipulation that i would want to have our daughter majority of the time and put in it as well each violation of non compliance in our agreement and provided proof through text messages. i hope this works . i have majority custody not through court for a month now which is m-f and mother has her on the weekends only ..

    Very helpful. My son has full custody of his children the mom had them picked up for a visit did not return but ran out and got a restraining order on flash statements. The mom has lost her children 5 times and keep getting them back??

    I've been there done that. Bad parents abuse this all the time. They often get away with it too. I actually l know a really good tip though. Don't waste time filing contempt, unless you do this one thing first. Otherwise they just get away with it. Some people have to take them to court like, six times before the judge finally does anything.

    @@estebanferreira8726 You Have To File For Contempt. The More She Violates The More It Makes Her Look Bad The More You Access You Get With Your Kids. It Can Also Lead Winning Full Custody.

    I have a question. I obtained custody of our daughter due to different forms of abuse by my ex. My ex has not tried to see our daughter, per court ordered parenting time, for a year and a half. My ex sends an occasional text to our daughter, but our daughter appears to just be done and trying to move forward, even though I promote reconciliation and therapy. Neither my ex or our child agreed to do therapy together the past two years. Our child was in therapy throughout our time in court, and post trial for a few additional months. Our child no will no longer talk to the other parent via text, she is 15 now. Our child is thriving and doing well. It took almost a year from the trial for the magistrate to finally make her decision. The judge ordered family therapy if my ex was to come back into the picture, and there is a certain ordered path back to visitation( therapy is required for this to begin). The judge ordered that I obtain a list of therapists from the child’s “ current therapist” then give the names to my ex for her to set up the initial appointment. Our child’s therapist agreed that Taelor was doing well snd until she was ready to deal with our ex ir discuss the void feelings for her other parent, she was fine to be fine with therapy. I did reach out to our child’s previous therapist, but at this time she had no suggestions, she will look in to it. I gave my ex a list of therapist names / companies, but she want something on letterhead from our child’s therapist. I know the magistrate didn’t expect the order to take almost a year, but can I legally just give a list of therapists to my ex snd not be held in contempt. I am currently seeking a new therapist since her other parent is trying to come back into her life( our daughter does not want to do therapy or see the other parent😢..ever). What can I do because my ex can be not very nice.. and I know she will try to get me for contempt, even though I gave her biweekly updates and tried to get her to go to therapy with our daughter for the past 2 years. She never asks about our child- this is the first I’ve heard from her since I obtained emergency custody snd she quit visits

    Hello Brain Meyer, After more then one year of dropping off and picking up in public areas. The Judge have order that it is in the best interest of our son to be pick up and drop off at both parents residence since we shared custody week off and on. Also I receive a text message from the girl friend stating that they pay property tax, mortgage and city taxes and they have all rights to not allowed me in there property driveway or in front of there house. Father involves the girl friend and refuses to communicate with me. Today It was my pick up date at my child’s father’s home and they barricade the driveway and front entrance. Our son was in the girlfriend car. He walk by himself out of the car to meet me to my car. I cried seen my son witnessing so much ignorance. He was very sad to see that I was unwelcome and gave me a big hug and said mommy I am sorry. What is your advice how can I approach this matter to the Judge?

    I have a contempt action in play now. My s/o will come to the exchange place weekly but will not leave the exchange area after the child gets out of her car and comes to mine. She records the entire event every time. My child will come to my car , refuse to get in, and walk back over to my ex's car. Sometimes 15 or 20 min aftrer showing up at my car. My ex says the court order doesnt say leave the area. The order says that I pick up after school from the school. My ex would normally not be there if it weren't for COVID-19 and home-school. Her bringing my child to the exchange place (school) , then sitting there recording the events tells me that she is staging and /or condoning my child not getting into my car at exchanges. My ex, after letting my child re-enter her car will then leave the exchange area and that's it. No exchange made. Every week for two months this has been happening and I have 2 more months to go until the hearing. This is alienation , interference with parenting time/ custody etc. but will the judge do anything?

    Where to file that kind of case? I live in Virginia and my ex husband and child is in Hawaii. He purposely withheld visitation of my child to me this winter break 2020. Although the court order says I have the right to spend the time with my daughter and my daughter to fly to me every school break. He got the full physical custody because I relocated here in Virginia from Hawaii. But my ex husband says on his email to me that I can only see and be with my daughter once a year. Do I file the contempt against him in the court? Is it court of Virginia or Hawaii? TIA

    Well contempt of a visitation order is only a misdemeanor, so after a warrant has been put out for your arrest for that misdemeanor that warrant automatic terminates in five years.. according to the law in TN. so anyone looking for a loophole there it is, check your local laws to see if the same applies. my wife's grandmother and dad made my wife sign her custody to her grandmother under duress and the justice system has only failed us on that. we've got custody back but there's conflict of interest between the judge and grandmother and he granted her visitation of our child until she's 18..so I've been diligently searching through the law for the past few years for loopholes, so I took advantage. sometimes we just have to take matters into our on hands and do what's in the best interest of our children and when a bad Apple has been placed in a seat of authority..plus we reside two counties away from the jurisdiction that set that order in place..major plus. and may I add..this crooked judge allowed the grandmother to claim our child on her income taxes just because she requested it..screw the parents huh. family law is nothing more than a fraud..it was created by attorneys for the attorneys.. financially draining both parties that are battling for the children.

    Question ‼️First thank you for your video ,I was wondering if text msgs from my x wife and me ,Planning days/ dates for kids,Also (Asking her to return my daughter for 9 months ,Informing her it was illegal ect) Can be used by me to prove what she has done? It's kidnapping I don't feel she's safe ,My daughter just turned 13 ,And has gotten depressed ,cut herself ,And didn't return after I took her phone Devises for, Lieing (Online inapropriet pics ,drug talk with strangers ect .Her mother my x would go to her school early and pick her up on my Days Already (Agreed/planned ) By text messages between me and x wife . I have two sons 15 and 11 , They come back and forth ,My youngest had a large fingernail mark in his neck after returning from mom's house ,‼️Anyways I want to fix this HOW? I Only waited cause she promises to bring her on text then just DOESENT ,But I have the messages ,Can I use them to help my kids ?     Can I keep my daughter because my ex has and continues to violate court orders, she moved hey out of county as ordered to stay in several times removed her out of school, never cubes with me on any things as I have joint custodity, need to modify but right now?!! Cps been called on her many times drugs used but they never find that proof endnotes my faucets confessed and they changed her story, but that mother saying to my daughter they will take her away lying as always

    I have a question about GPS tracking devices. A hidden device was found in our child's diaper bag that we share. It was placed into the lining of the backpack, and I was not made aware of this ahead of time. I found it when my phone warned me about a tracking device.     When the head Juror states before the judge and defendant, after the trial that the jury respects the defendant and requests leniency for the defendant father and never states a Guilty verdict, does that constitute a conviction.?

    Doesn't work in Collin County Texas. The courts are backed up 2 to 9 months. Also Greg Willis the District Attorney will not prosecute a warrant from a Police Department to enforce Section 25.03 of the Texas Code which is a State Jail Felony. Good Luck everyone. I haven't seen my child in 6 months.

    My son's mother did everything she could to keep him from me. We had a shared parenting plan. We each had to do things. But she took it upon herself to decide if I did what I was suppose to do. And guess what? She said I did nothing. Later the court said it should not be up to the parents to decide if each other did what they were suppose to or not. Then mom came up with this fake letter that she claims I wrote to prove I was going to family counseling. Then had the therapist write a letter saying it was fraud. But never showed up to court to testify. Yet the court accepted the letter and then used it against me to take away my shared parenting. I argued against it. Then they broke up the shared parenting plan and used some stuff. Once again mom decided if I was doing what I was suppose to do. We went back to court. I brought this up. I asked for a neutral third party to be assigned to the case to help us execute the plan. Mom said she did not want this. So they did not do it. Then ordered I am to see my child at safe and sound. Keep in mind I have custody of my 10yr old. I argued so I am fit to be a parent to one but not the other. The judge said the child is on another case so it did not count. That was 2.5 years ago. I have not seen him since. The GAL assigned to the case wanted 4.5 thousand for her services from me alone. I could not pay it. So they said until I pay the fees I cannot file any more motions in the court. So they won't even help me determine if she is in contempt of court.

    There are court cases stating that inability to pay certain cost cannot be used as a basis for denial of visitation. Visitation is the child's right. Suggest going to your local county law library, ask for the visitation/custody volume of Calif Family Law Practice and Pleadings or the equivalent where every your are, spend the day reading.

    In Iowa there are no options ex has a history of it been found guilty of content and she had suspended sentence and still 3 years later it'll be in March I will can't see him they decided to file NCO start accusing of everything under hunt son even though it's quasi criminal her and her attorney admitted in these last ones she's in contempt and until I agree to their circumstance they will keep violating courts order🤬

    This is posted to help people how the law works; it’s not posted to help men facing gender bias in the courts feel advocated. I explained using a hypothetical example that I estimated would help people understand the law. In other videos, I use hypothetically examples where the “mom” Is the culprit, and yes, people complain that I do. If I don’t use a hypothetical example, people complain about that. If I use “person 1” / “person 2”, people complain about that. Thank you for your input, but I will leave this video posted and continue to covey the information in a manner that I estimate to be the easiest to be understood.

    What if is the dad Who is at the good end of the stick and the mom reg visit F-5 S-5 At disclosed local. She shows up but refuses her to leave with because she’s “gonna miss a pool party” there’s lots of family health issues birthday weekend and a new member to the family all included in that weekend plus a festival we never miss. She takes off with her... I folded with S.O. This is not the first or second time this is happened, but what am I doing wrong just by going to get my daughter on her normal time. Sorry, not sorry I’m not driving across the state for a hour party It says nothing of the sort in front of my eyes are read the docket. Sorry if I tap out I hope you can understand keep it easy thanks for your help

    What if they are using a “gray area” in the order, by order stating reviving parent pick child up from school but other parent is saying because there is no school anymore(due to virus) they withhold ?

    Hi Sabrina. If the language in a court order is unclear, the option is to file a motion for clarification. If the other parent has been unreasonable in their interpretation or has taken unfair advantage of an ambiguity, that can be a basis for modifying the existing order to give the other parent less power in their situation.     Mom got served to not leave the county. Mom moved 4 hrs out of state and hasnt let me see or talk to my kids in 33 days. Court hearing coming up. Mom is now being a narcissist spreading around I sexually abuse my kids. Which isn't true. She moved for a Boyfriend. What are some things you've seen from Judges to fix this issue? She got my kids out of school and moved away from family they grew up to. She's been ignoring mandated mediation who will do abuse screenings as well.

    @@brianmayer28 Thank you! The mother is denying the father access to the child's physical address by not responding to his text messages. There is a court order that says, "Mother cannot block the father from child's information." the father wants to file a police report but it might be too soon; the supervised visits have not started yet.

    IAmYokoHaze the answer is that contempt is the willful, knowing disobedience of a court order. If someone willfully and knowingly disobeys a court order, they can be charged with contempt. Otherwise, they cannot.

    My child was placed in the care of my ex husband mom's best friend and she is in contempt of every court order and alienation of myself and the violation of the Alabama parent child visitation protection act. I am a disabled veteran and I don't have much money to fight this but I do have my oldest boys. Why is dhr not doing anything, I even called for a welfare check and nothing was done and I managed to get a neglect investigation opened but they couldn't catch her home so they had her come to the office. Her father is in prison for his second term and I am a disabled veteran without any felonies and a top secret security clearance. I don't have any family or influence so I can't win.

    I’ve been claiming my daughter for 6 years, and I got the 250 extra last year! Yet, my ex decided to claim my daughter. We don’t have an official court order, but I take care of everything from school, medical insurance, and doctors appointments. Will the IRS think it’s suspicious that someone else is claiming my daughter?

    Check my KZread channel for a video titled “who gets to claim a child on taxes”. The video describes what happens if two parents claim the same child on different income tax returns for the same tax year, but to be clear, the IRS will not flag a return simply because one parent claims a child one year and a different parent claims the same child on a different year.
