In New York State there are so many cars being driven illegally that there is an epidemic of hit and run auto accidents. The NYS DMV and police estimate that in parts of some cities one out of every two cars is illegal. The NY Legislature, in their infinite wisdom, decided to address this problem by REDUCING the penalties for hit and run accidents DOWN from a Class A misdemeanor to a traffic infraction if there are no deaths or serious injuries requiring hospitalization from the accident. Their reasoning was that treating hit and runs as a criminal offense was having a disproportionate impact on some minority groups who are committing the hit and runs. New York roads are now like something like a Mad Max movie. My advice is to get the best insurance you can afford.

How’d your situation go ? Me & my 5 yr old daughter were involved in an accident yesterday & dude left. I seen his work tag, that he worked at wal mart & there is only 2 in town. What should I do ? Go find him ? I was going to make police report but since I pulled over a bit from accident. Cop told me if I filed the report I’d be getting a Felony Charge for fleeing the scene of accident smh

@@joelgarcia6802 go find him man. The cops don’t do jack, especially in my case. I ended up getting slapped for a DUII for no reason. Even when I conceited to a UA test and it all came back negative, 6 eye witnesses and the cops didn’t believe me. System is jacked up

Got into an accident today and saw the guy flee the scene. Fortunately, lots of people all around me were able to help identify the man, where he went and where he was currently at. I’m waiting to see if my car is totaled but it took a lot of damage and the air bag deployed. I got a burn hole through my shirt and underwear, rash line from seatbelt, minor burn and marks on my left arm, and lots of neck pain. We both were trying to beat the yellow light that resulted in an accident. However, he was at fault and got two tickets. One for reckless driving (bc I had the right away) and one for fleeing the scene. All of this ended up on a police report and I may get a subpoena but I’m wondering what to do next. Do I get a lawyer?

Im in ky. I was hit from behind on my motorcycle, flew about a house and a half down the street tumbling. The guy turned around and ran and the police found him. He apparently has no insurance and since i only had liability my uninsured motorist coverage is only for bodily injury. Although, even if i wanted uninsured motorist property damage, my insurance will not give me the option to add it on there, so Im thinking it might contain both under my uninsured motorist coverage. Im not sure. I hope I am able to get my motorcycle and gear fixed, as im not able to replace it on my own, probably not for a year or two. I think its so dumb that I have to be responsible for someone else’s negligence

Hey Brandon, sorry you're dealing with this. Yep the only way you can protect yourself is by having certain insurance coverage. So sorry you don't have that. It is total b.s. how the system is set up. You did nothing wrong and have to pay the price. Sorry to hear this....... Barry

I got into an accident a few days ago, I was turning left on a t- intersection when a car and I collided, she had the right of way but did not have her lights on said a witness, I ofc did not see her coming. The car then drove away and we now found her and the cop is mostly putting me at fault and said he can’t check the traffic light cameras. What do you think.

Hmm. Odd if she didn't have her lights on how are you supposed to see her? I think you have a good argument to the insurance companies that you are not at fault or at least not mostly at fault.

Almost three years later, I went to practice mediation yesterday. I’ve had X-ray technician tell me that I’ve had compression fractures, to a chiropractor telling me that I’ve had a brown transverse process and thinning of the disk in my neck.. idk weather I’m coming out going at this point. What I do know is my credit is shot since being laid off due to the hit and run. I returned to school since I won’t be welding anymore, and I need tires, because my car doesn’t align like it should. I’ll update you after the actual mediation takes place sometime next month. I’m not even expecting much.

Hi there. I need some advice. I was involved in a hit and run yesterday. Someone hit my car, both our cars were damaged but the driver of the other car fled the scene. I regret not going to the ER because when I woke up this morning, certain areas of my body is in excruciating pain. I received a call from one of the officers this morning who called to see if I was ok. He sent me texts of where my car is towed to and told Me the person that hit me was a thief and the car was stolen. My car and the stolen car are both totalled and he strongly suggested I go to the ER. I will but I only have liability insurance with no rental coverage. I don’t know what to do from here and now I’m out of a car because a thief decides to cut me off because he was speeding to get away instead drove and hit my car. Any suggestions would be greatly appreciated appreciated.

Sorry to hear this. Depends on the insurance policy whether there will be any insurance coverage from the other side. I'm skeptical but you should pursue it and find out. But listen, I always tell people, focus on your health and not your case. If you have health insurance get medical help.....

@@LawFull I had full coverage because I only financed it a couple months ago. New to the auto world of driving so I never knew that I had to get a photo inspection in order to keep the full coverage. I work two full time jobs so when I called GEICO yesterday they said they dropped my coverage from full to liability. My body is in so much pain and now I don’t have a car to go to work with and I have to take taxi. I have no one to help me financially. I’m not sure what to do now. I was involved in a head on collision. This person was traveling the wrong way on a devided street and when I tried to avoid him he still turned 8nti me so I hit the brake hoping he would try to avoid me but he yet again turned into me and we collided. I managed to get his insurance information but he would not give me his I D AND FLED the scene. I contact his ins company and he under is covered but will not return the Calles if the ins company. No atty will take the case and the ins co will not move untill he responds. Wow sorry to hear this. Well, I don't have any good news for you. If you don't know who the other side is, and he doesn't have coverage, there isn't much you can do. But, I would press your insurance company to prove to you that there is no coverage. Don't just take their word for it. And if you want you can appeal that decision if need be. But don't delay because there are probably time limits on how long you have to appeal.

Hello, Lawer Barry Zlotowicz, I live in North Carolina, a lady hit my car and ran away , I chased her she stopped after some chasing; however she only stopped to take pictures of my vehicle and plate tag, she made hand sign offensive signs to me and said that I would end paying to her. The police arrived after more than 2 hours. I report to the officer and showed him the photos I took with the tag #. However the officer did not show the insurance information of this lady as He said that He went to the address and did not see such car. I was involved in a hit and run. I was waiting in my car at a signal when someone crashed on my bumper and sped away. All that I know is that it was a white car. Their bumper broke and debris were down on the road. I filed a police compliant then and there. And later informed the insurance and they opened a claim. I am not sure if that was an uninsured motorist claim. Will I need to pay for my deductible when I get this to body shop for repairs ?

..also, there were cameras in the signal and nearby shops. If the police really want to find the car, they can. But I am not sure if they would as no one was hurt. I cannot go and ask the shop owners etc for cctv footage

I'm in the process of one. Got a police report at the time it occurred. Got an attorney. Been 50 days recovering from my injury. I lost 7000$ of wages so far. The doctor said he want me to go to work 3 month after and that time is coming up. I got a released form to back to work when that times comes. I am doing physical Therapy still and I will see the doctor in 120 day about 3 month out from this post. I have my attorney working on my case and. It just following procedure from here on out. I got a hip fracture and scaring on my head. Seat belt and air bag didn't hold or braced me. One fracture finger. It just a healing process now and hopefully. I was a passenger. Went through uninsured motorist claim. 100/300

Hi, if they deny your claim you have only 2 options: 1. get the damage fixed by your own insurance and let them go after the other side 2. File a lawsuit against the other driver

If you still reply on this video I have a question about something that happened yesterday. I merged into a right lane and a guy behind me got super upset I got in front of him and purposely hit the side of my car trying to hurt me or create damage to my car then fled the scene. I was out of control at first but then called cops. We have a aggravated assault filed but I have yet to see if my dash cam has got the license plate. If it does not catch it my insurance is making me pay for my rental which is $1200 and my deductible. If I find out the license plate should I prosecute or just let insurance handle it if he has insurance

Tough for me to make a call like that for you. If it were me personally, hmm, I might just use my own insurance. But that's me and I don't think I'd want the aggravation.

I am a victim of hit and run. The driver run off. I rely on the police crash report and after claiming under his policy I am told it's under investigation but 3 days later I am still being told the same. Someone hit my car in my apartment complex parking lot. I did everything you've said. Contacted the police filed the report. Called insurance filed a claim with Liberty Mutual...they are telling me they can only cover the damage if I can identify the driver. How it was a hit and run. My apartment complex gave me a thumb drive of the video of the car hitting me unfortunately can't identify a plate number or person with the video footage. What else can I do at this point. I thought uninsured motorist would cover this. It's atleast 1000$ worth of damage to my car if not more. Any advice???

Hi, I would start by telling them to show you where in your insurance policy it says that they can't comp you without identifying the driver. And I would consider appealing their decision. Get a copy of your policy asap don't wait, and figure out how to appeal the decision.

i got in an accident last night, it was pouring rain and out of nowhere the car infront of me swerved out of the way and there was another car driving on the wrong side of the road and hit me pretty bad, luckily me and my friend who was in the car were fine but the guy drove away. It really sucks because my car is very damaged and maybe totaled. The other persons mirror fell off and i have it, im wondering if that mirror will help at all. There were not any witnesses that im aware of because it happened at 2am, i assume the guy was drunk since he was driving in the wrong lane. I dont know a whole lot about this kind of thing. How long will it take for this to be resolved do you think and should i get a lawyer? Thanks

If your own insurance company is denying your claim, all you can do (and do it fast) is ask for a copy of your policy and inform them immediately that you are appealing their decision. But make sure you appeal the right way (that's why you need a copy of your policy). But act immediately as there probably is a time limit to appeal their decision.

Hey Colette, that is not normally the coverage that you would use. I've seen it called 'uninsured motorist property damage' coverage or just collision coverage. Just call your insurance company and ask what type of coverage you have for this situation. Barry

hit and run, 4 days ago, guy in front lost control on the ice, bounced off the left cement barrier on the freeway and crossed all lanes and hit my car driving both of us into the right lane barrier. he then started his truck backed up and left. I got his plate number. the officer showed up 20 minutes later asked the color and make of the truck and said" hold tight, I will go to the next exit and see if I can find him" and she never came back. I waited for about an hour packed all my stuff into a backpack and left as it was very cold out and my motor wouldn't start. its been 4 days, my insurance now has my car and is having it looked over to see if its salvaged and still have not heard from the police officer who still has my drivers license....Washington state trooper btw..i didnt go to hospital, am only a bit sore... not quite sure what I should do now? any advice would be awesome. thanks

Hey, well, that is definitely one of the more unusual circumstances I've heard of. If it were me I'd be calling the state highway patrol to find out who was patrolling that area at that time and try to reach out to them. But I don't have any better insight on this than that. That is what I would probably do....

Hi Three nights ago as I was driving my friend home, leaving the exit to enter the street turning left another driver hit and run my car passing a red light. I pulled aside and checked me and my friend seemed fine but definitely in shock. I parked by the gas station and waved the other driver but they started driving away and leaving the scene. Good morning, next step is to go ahead and file a claim with your ins co.... Whether they total the car or not depends on the value of the vehicle and the amount of damage - so don't assume it's just going to be totaled automatically.

Hi, technically you might have to but if there's really no damage to the vehicle and there's no injuries then there's not much point in filing any kind of claim.

Thank you for the information. My son and I were hit by a stolen car (freshly stolen according to the police), and the drivers fled the scene. There were many witnesses, police was called, a report was filed, my car was totaled and towed to the police impound. My insurance company claims that I don't have collision coverage, I doubt that I would have ever purchased a policy without accident insurance. However, does this case falls under the underinsured claim? Oh my, there is so much to think about and I am at a loss for what to do.

Good morning, if you suffered injuries, you may be able to claim compensation for your damages under your uninsured motorist coverage. Collision coverage for the prop damage is a totally different issue. Where did this take place?

I was the victim of a hit and run 2 days ago. The police luckily found the other driver. My car was parked and I heard when my car was hit so I ran to it and it starts but does not run anymore. I am worried because the other driver was drunk, driving an unregistered car and does not have car insurance. I do not have uninsured motorist coverage. The police said I should file a civil lawsuit but to be honest (and a bit judgemental) the other driver looks/seems broke. So the questions is do I spend money suing this guy who probably doesn’t have money or any assets?

Hi, good question - the only problem is if you don't have ins and neither does he, the only chance you have of recovering is to file suit against the guy... Research how to file a small claims lawsuit in your county - probably on your county website. That sounds like it may be your only option I'm very sorry to say....

@@braden755 Braden, this is just me. But its a hit and run, minor damage. I would use my own insurance to get the damage fixed asap. Then let them go after him for reimbursement. Filing suit will delay things and will take you down the rabbit hole. Just my personal opinion though.

Hello, so I was in a car with my mom and my brother and we were stopped at a stop light and a guy in a really big car came and wrecked us and drove away my brother called 911 a took a little over three minutes to pick up and then me and my mom spent 30 minutes waiting for the police To show up we tried to get the licence plate we were also really trying to save money for a vacation. Hi, well, if you don't know who the other driver is, you file with your own collision insurance coverage and get them to pay it - you'll have to p ay your deductible.....

I got rear-ended by another vehicle. The driver showed me the registration and an insurance card but took off while I was calling the police (although I had asked him to remain at the scene). As it turned out, the driver was not the register owner of the vehicle. Neither was the insurance policy. He took off before I got around to collect his driver's license information. Does this constitute a hit and run? If so, what do you suggest that I do?

Hello! I was a passenger in an Uber and the driver left the scene of an accident he caused. Because I was scared of why he was leaving, I began to record and ask him to call the police because I was injured. In the recording he told me no. Hi sir, I stay in Ontario, Canada. My car was hit and run. I parked in front of my home. I tried but didn’t find any evidence in my neighborhood. I reported at police collision centre. Later insurance took over my car and dropped at auto body shop for repair. And insurance they didn’t informed me anything about the process. I called them every week they mentioned ‘we are waiting for the report’ and after 60 days they denied my claim. And next month my insurance is expiring, I don’t want to renew and go with them anymore. Please sir, help/suggest me what I can do further process. Thank you!!

I was backing out of a parking lot and I guess the guy didn’t see me. It was dark and he had a big black truck with camera footage idk what kind of car it was. Maybe ford or ram idk. No damage to his car not that I could see in the heat of the moment but my car was severely damaged and he didn’t really care and I couldn’t get a chance to get his license plate and he threatened to put a bullet in me and he got upset so I just walked away and waited till he left. Hey Barry, I have been watching your videos and very helpful. I ended up hitting rear of another call while changing lane on a freeway and I couldn't really stop because there was lot of cars and I couldn't move out of the lane. Though the damage looked very minor for my car and their car am sure has very little damage as its minor hit, what can I do now? As I did not stop the car after hitting another car, how should I inform my insurance company about it as i was driving a rental car with full insurance. Should I mention to them that I hit other car and did not stop, this looks like am accepting the fault or should I not talk about hitting another car and just say them there is a damage to my car. I was run off the road and had a bad crash. I couldn't remember what happened for 4 days. @@LawFull I still have vision loss in my left eye and a spinny-light and must see a neuro-opththomologist. I was very bruised. I had seatbelt cuts, I still have a deep bruise on my leg, a painful area on my head and suffer with headaches. This happened August 2, 2021 and they just now gave me an answer.

one major issue is it's extremely difficult to find a lawyer that will take a property damage claim only. so we are at the mercy of the insurance companies lawyers. smh.

Morning - true. I don't know any lawyers who will take 'property damage only' cases.... So the burden is left on the victim to represent him or her self. It's unfortunate but true.

How about the people who did the hit and run? How do they protect them selves?

Today, my boyfriend was ran over while riding his bike in Santa Monica. The $&@ ran him over and pulled off. Crushed his bike and left him with multiple injuries. The paramedics and police came. We made sure to make a report and the police took a statement from all the witness. It was a busy street. Someone took a picture of the License plate so they gave that to the police as well. We have it as well. My boyfriend doesn’t drive, just rode his e-bike around the city, therefore no auto insurance. He is currently admitted into UCLA hospital and I am trying my best to figure out what to do now. So thanks for this video. We just don’t have the finances for a lawyer so this is helpful.

I was in a hit and run driving last week. Tried to file a claim with my own insurance (Just liability) but the only response was "You do not carry first party coverage on your vehicle so we will not be able to cover the damages. We can run a dmv search on the the other party and attempt to reach out to their insurance company to assist with taking care of your damages done to your vehicle as a result of the accident." The police have the person's information on the incident report based on the license plate a bystander took a picture of. Do I have any other options?

Somebody hit me a few days ago and drove off while I was riding my bicycle to work at 3:40 AM. The police haven't started to investigate but I did receive the crash report yesterday. I did get in touch with a lawyer to get the ball rolling. What if the driver can't be identified?

Hey Michael, the insurance rates side is tough for me to comment on....that's more a question for the insurance agent you work with. From a personal injury attorney side, I just wouldn't know whether they're going to raise the rates or not. I'm sorry I can't be more help on this one. Barry

I was driving trying to get my flat fixed with my flashers on when 2 cars rear ended me the hit was so hard it pushed me a little further down the street when we came to ourself after the shock of it all the driver number 1 who was in back of driver that hit me fleed the scene and I later on found outthat the car that I was driving didn't have insurance on and mind you my car is totalled out can I still go after car 2 for hitting me aswell

I'm not sure I entirely understand the fact pattern. This sounds like a case I would consult with a local attorney on. Do you know someone local you can talk to? If not, just google it, I'm sure there's many you could talk to.

So my boyfriend was in a hit and run we have liability insurance the car that hit him was left at the scene because the driver was not able to move it the police were called and the car that hit us was reported stolen what is the next thing we can do

Morning - not entirely sure I understand your question. So you don't know who the driver of the other vehicle was? If it were me, I would file claims with all ins co's involved to try and find ins coverage. If you already filed with your own ins and you only have liab ins, then turning to the other party's ins is your only option. What if any impact the car being stolen will have on your ability to recover - I honestly don't know. I'd assume that depends on the ins policy - what does it say in this situation.... I wish I could be more helpful on this one but this is not a question I've been asked or a situation I've dealt with before....

What if the damage is very small? Dent in the door? And some scrapes of paint

Hi, well first generally speaking you'd file a claim with the other guy's insurance. Then if after the process plays out with them, you could theoretically file suit. How bad is the injury?

Hi, I don't know NY law. But I would think you can still file a report. Not sure why not. I would strongly recommend though that first you consult with a NY attorney about this however. Just do a search on Google for 'personal injury lawyer near me'. Lots will pop up.

Hi, if you are saying you caused an accident and fled the scene - I wouldn't comment about it any further on social media. After that, there's not a lot I can say about this since fleeing the scene of an accident is probably a crime in your state I would guess.

I got into a hit and run literally on new year day … some guy cut me off and I hit him from the back but this guy kept going and I had no choice to exit the freeway bc my break and my gas wasn’t working I was already slowing down but I couldn’t stop on the side of the road bc I didn’t have space since it was a bridge

Hi, I'm sorry you have to deal with this. Odd situation for sure.

A guy calls me saying my driver hit him, and he wants me to pay for his mirror. Is this a scam? If not, what should I do, because my driver showed proof that he was driving legally and that the other driver was trying to cut him off. He got scared when the driver was asking him to pull over because he looked mad that he didn't allow the other driver to cut him off so he didn't stop. There was no damage to his truck, he didn't know he was involved in an accident. They are both semi trucks.

Morning, sorry you're dealing with this. Well, my usual advice is to just turn this over to your insurance company. This is why you have insurance in the first place. But if all that is damaged is a mirror? You could theoretically pay for the mirror and be done with i t.....

@@mrsulaiman19 So your guy says there was no collision at all? If so, why would you report it as a hit and run. I'm confused I guess. I can't provide advice on this based on what I've read above. If it was a hit and run, you probably have a legal obligation to report it. If there was no hit and run, then probably not.

My son was killed in one. He was waking. I don’t think the guy that was driving has anything as in assets but I would love to keep him in jail forever plus some as you can imagine he had ran away from the law for 10 days plus he is a known drug dealer but anyway I just want to make sure everything is being done that needs to be done to do this is there anything I should do? Don’t really have the money to have a lawyer of my own other than the prosecutor on the case advice please I’m a hot mess right now and I’m just looking to get everything done that I possibly can within my power to get justice for my son he was a veteran

I'm so sorry to hear this. Awful. I can't advise regarding the criminal aspect of the case. But if you are trying to recover compensation from somewhere (which of course could not ever compensate you appropriately for this type of loss) but if you are trying to recover something, you would file a claim with the guy's insurance (though it sounds like he might not have any) or your son's auto insurance. Do you by chance know if your son had auto insurance? Again I'm so sorry to hear this.

I am the victim of a hit and run I suffered a broken leg and I received multiple stitches in my leg I am currently walking in crutches the police found the person but I need a good lawyer so I can get the best help I just don't have any money to pay for a lawyer and I did suffer some pretty bad injuries

Can I sue the police department my daughter was hit by a car yesterday & I filed for a hit & run the officer wrote it up as a pedestrian accident because he said he dont believe the driver intended the hit & run. Hi my son and daughter was hit by a semi truck in my sons suv was badly damaged. My son only had liability insurance which doesn't cover his vehicle repairs. The insurance company for the semi truck driver is denying the claim to pay for the property damage. He owes about 10k on the vehicle we have a personal injury lawyer but don't know what to do about the property damages. Plus the semi driver gave a conflicting story than my son and daughter. Do you have any suggestions for how to fix his vehicle?

Hi, I don't understand why your attorney is not taking care of the property damage for you in addition to taking care of the personal injury aspects of the case.

My insurance company which is progressive filed wrongfully as a standard not at fault collision and then raised my rate by $50. I'm curious as to if I can file a bad faith claim suit against them for this because they hardly covered anything and now because of it any other insurance company I go with my rates are also increased. I have record of the police report and everything that clearly states it was a hit and run

Hi Kassandra, well, it depends on what type of lawyer you need. Auto accident? If you were the victim and you suffered injuries, getting a p.i. lawyer should cost you nothing. I was involved in a hit-and-run cop put it down as a hit-and-run put me not at fault dash cam footage shows the car coming to Lane hear me scream provided to the insurance company it should be under uninsured motorist because they left the scene my insurance company is trying to make another comprehensive. So I pay $1000 instead of $250

So you do not have any contact info for the person who hit you - and you did not have insurance at the time of the accident? Is that correct? If so, then yes, I don't have good news for you. Did you by chance go back to the scene of the accident to see if there are any cameras anywhere that might have recorded the incident - so that you might be able to see the license plate of the guy who hit you?
