When you come to a DUI checkpoint and you make a U-turn and you leave, there is going to be a cop on a motorcycle that is going to pull you over. So, if you come to a checkpoint, don’t do that. Don’t make a U-turn, just get in line. And when you come up to the front of the line, they ask you (they being the police) have you been drinking tonight. There is one answer. Only one answer. And that answer is No. I don’t care if you have a bottle of Jack Daniels in your hand. I don’t care if you have a bud lite in your hand and you give it to the cop. No. No. No drinking. Because guess what is going to happen if you say you have had one drink, or two drinks. They are going to say, “step out of the car and come over here”. So do not admit to drinking and driving. The best advice I can give you is don’t drink and drive, take an Uber, take a Lyft, or just plain old don’t drink. Thank you.

    The former head of the PA state police who in the 80's started a big DUI crusade, with the help of MADD, who called him our knight in shining armor, calling every drunk driver a murderer in waiting, was himself arrested for, yep, drunk driving!

    Every drunk driver IS a murderer in waiting. You make a conscious choice to get behind the wheel when drinking. Everyone knows the risk. Punishments for drinking and driving should mirror assault with a deadly weapon, not just a slap on the wrist.

    Damn, odd. What part of PA was he caught in. I’m in New York, Dutchess county specifically, not too far from Orange County which borders Milford, Pa. I actually almost border Danbury, Ct, but anyways, I digress! Umm yeah, just curious where in Pa that was because I know around here that police won’t arrest a cop they catch drunk driving, and I know that for 110% certainty.

    @@franko8572 then i feel sorry for you because that's your life and mine they're playing with. i wonder what your opinion would be if they happen to kill someone you hold dear? the cops in our area would pull over their mothers if they've been drinking because they have cameras on their person and cameras in their cars. no one wants the hassle so the arrest is made period.

    This happened to my dad in Cyprus. We got stopped and when asked if he’d drunk anything, my dad instantly just said ‘no’ with no hesitation or anything (blatant lie he’d had like a few glasses of wine) and the policeman was just like fair enough, thanks bye ✋

    True story. Once me and my cousin came back from a club. We got pulled over on the way home. I did have a few but It has been like over and hour since. They told me If I have been drinking. I said, " yea like 2. I think they smelled it on me too, but me and cousin got out the car. We got sat down on the curb. They even checked my eyes with a flashlight. " they did a breath test. And boom I passed. And they looked like assholes after that lol.

    Cop was in front of me driving maybe 10 on a 55mph hwy so I hit the signal and safely passed him. Pulled me over, I was sober and I passed each test fine. Which just pissed the cop off more and more each test. When he realized I was sober after the 5th test he wrote me a $300+ saying I recklessly drove around him and almost put him off the road. Who the hell does that to a cop. I said sir that's not true.. His reply was "who are they going to believe in court, me or you?" I was young, cameras weren't everywhere, ignorant of my rights and had to take it. Fk Lawrenceburg Indiana the whole entire town is crooked.

    This was before dashcams and cell phone cameras. He was doing no more than 15 on the main hwy, it was slowly follow or safely pass. He would've pulled me over for either. The asshole even made sure I had contact lenses in. He was pissed and congratulated me with a retaliatory BS ticket. And yes, those words were exchanged. Any other important details you need? * And anyone who knows that town knows how crooked the officials are.

    I had a friend from Chile answer truthfully when asked if 'he had anything to drink today'. He said, "Yes officer" The cop asked him *what* he had to drink. His reply, "I had orange juice this morning. A few cups of coffee... some water..." The cop asked him if he was trying to be a smart-ass. He said, "No officer. I am trying to answer your question truthfully. You asked me if I had *anything* to drink today. If I was to say 'No' I would be lying. Now, if you are asking if I had anything alcoholic to drink, well the answer would be no. I do not drink alcohol" It sounds even better when he tells it with his thick accent. No joke.

Another cop in Windsor Locks ran over a man riding a bicycle and his father a Sgt on the same force tried to cover it up, didn’t work, and the cop was so drunk at the bar that the victim’s family and their lawyers ended up owning it and sold it to a local restaurant group it is now called Three Figs in Suffield. The food is excellent.

    At a checkpoint, you should say "what crime do you suspect me of committing?" and "am i free to go?". I wouldn't even acknowledge their DUI line of questioning.

    I was pulled over and HAD been drinking, so much so, that I had the booze breath. I told the officer that, Yes, I had been drinking and he asked how much, I said at least a six pack. Normally that would result in an arrest and I'd be off to jail for processing. But no, this officer admired my honesty and noticed that my speech was not slurred. He asked where I would be going from this point to which I replied "Well I was going home, but now that's up to you." We both laughed, he handed my license back to me and told me to be careful on the way home. I GOT LUCKY. Whew!

    Once I got stopped at a DUI checkpoint and I’d had two beers with dinner while out with my gf. So I told the cop that, yes, I had consumed two beers, and that was clearly a major mistake as he made me get out and perform a sobriety test and blow. I didn’t blow over and was able to return to my car and go on my way. But to this very day, I’m pissed at myself for simply not telling him “no I haven’t.”

    The advice I'm about to give applies to many different encounters with cops. When you get stopped and have done nothing wrong, they're gonna go "fishing." (Asking stupid questions and looking around your car) I'll answer one or two questions, but then I'll ask one of my own. Look the cop in the eye and say, "Am I being detained, or am I free to go?" This puts them in the uncomfortable position of having to either tell you you're free to go, or they have to have reasonable suspicion in order to detain you. They can sit there and ask you questions for hours on end if you sit there and keep answering. I had a State Trooper in Texas try to find something to bust me for, but I'd done nothing wrong. After a few minutes of questioning, I got disgusted and remembered a little something I learned during Arrest, Search, and Seisure class I took while in the Police Academy. (I never became a cop. The amount of unethical crap they taught us, ways to find reasons to bust people, etc, left me wanting nothing to do with those a--holes) Anyway, I STRONGLY advise anyone reading this to get a copy of your state's current book on Penal Code. STUDY THE SECTION ON ARREST, SEARCH, AND SEISURE!!!! This section tells you what cops can and CANNOT do. It tells you what your right are. Learn the vocabulary. Understand what arrest, detainment, probable cause, and reasonable suspicion are. When a cop sees that you've read the Penal Code, they start backpeddling real fast.

    I've always been of the opinion that if you have nothing to hide, just comply. Don't make it any harder on law enforcement. It will become crystal clear you are innocent and then you can move on with the rest of your day while diffusing any situation that might arise out of non-compliance like a ticket or just the waste of time that goes with that back and forth.

    @Brian Doherty every time there's a police shooting in TV and it involves a "minority" the comments roll in and say, "you should have complied." Minority or not, I don't want to end up on the six o'clock news because of a misunderstanding with the cops. For me, this is worth the inconvenience of having to deal with an overzealous cop. But everyone has to make that choice for themselves.

    Years ago when I was asked by a cop if I had been drinking, I simply told him I had been sober over 6 years 4 months, and some odd number of days... He replied by barking back at me, "Are you getting smart with me kid? (I was actually 25, 6'6", 250lbs, and took my sobriety very seriously)". It was at this point I realized the kind of asshole I was dealing with and did what I hate doing most (and had to do most of my life), and that is put on a fake persona of complete submission to avoid an even bigger confrontation/hassle. At the end of the day, I was given a warning for doing nothing wrong and allowed to go home after 40 minutes of my life was wasted. It made me aware of something I really hadn't encountered before up until then with any police officer, that is, some of them are out there to create situations which only they can fix... That is why I do my best to obey the law and avoid them at all cost.

    I usually just say “¿qué? no hablo ingles” then when they bring a Spanish guy I say “Shénme? Wǒ bù huì shuō yīngyǔ.” Then when they bring a Chinese guy I say “Was? Ich spreche chinesisch.” Then when they bring a German guy I say “Nani? Watashi wa doitsugo o hanasemasen”. Then when they bring a Japanese guy, I’m sober and I say “surely you have somebody that can do this in English, right”?

    My answer to the CHP officer who pulled me over for 10mph over the limit…when he asked if I had been drinking…was “absolutely NOT”. I pleaded not guilty to the speeding in court, the cop never showed-up at trial…case dismissed.

    I don't drink and drive anything but yet I had to watch this guy's answer. Got into a looonggg argument with my wife. Was so pissed off and tired I crashed in the car out in front of the house. A passerby or neighbors saw slumped in the seat and called the cops. They had a hard time waking me up bc I had just pulled 6-12 hr shifts in a row and was exhausted. They were convinced I was intoxicated. They asked and I said no to any drinking. Although I had the keys out of the ignition they said they could still bust me for DUI/DWI and wanted to do a field sobriety test. I asked if they could just give me a breathalyzer. They did and of course no alcohol and the one seemed a bit pissed that I was sober. I told asked them if was illegal to sleep in my car in front of my house bc there was no way in hell I was going back in to fight with the wife!! They said no. So don't drink and drive for one AND I think now I know who called the cops in the first place.... my ex wife!!😂

    I hit a sobriety checkpoint once at about two or three in the morning back when I was in my thirties. I had gone to see a friend in the city, and since she pretty much didn't drink I didn't either. So of course the cop thinks they've got a score, right? Young fella on his way home from the city, of course he had some beers. But I hadn't. The cop asks. No. Asks if I'm sure. I'm sure. And I was grinning just a little because boy did I pick the right evening to have no drinks at all. The cop had this sour look because he knew damn well I wasn't lying, and he told me to go and not in an approving way either. You'd think they'd be happy I was such a responsible driver but oh well, sorry to disappoint. I still chuckle decades later.

    Have you reflected on your own behavior of crashing the car which is illegal operation of a vehicle on public street when physically impaired. DUI and dozing off are impaired and dangerous to others. Maybe your ex- is crowing to others that being the ex- was salvation of her life.

    A group of us were in a car, got into a checkpoint. When the cop asked "have you been drinking?" The driver gal said, "NOT YET!!" We all started laughing. Way too funny.

    That’s SO STUPID! I’m a progressive Democrat but would NEVER be this disrespectful to a police officer! When I served on a drunk driving task force in UTAH I was the only member who wanted 0.00% BAL. Distracted driving accounts for 94% of motor vehicle collisions and auto-pedestrian collisions. Distracted driving such as use of drugs both legal (alcohol) and illegal, talking/texting on a phone, singing along to loud music distracts you from 100% focus on driving. Working as a trauma doc and responding to such collisions, decapitations, crushed bodies is REAL. Despite safer cars and seat belts 38,000 people STILL die each year in US collisions. And my First Responders and I are the ones who are covered in blood, sifting through body parts and dealing with tragic family loss. TWO million people suffer permanent injuries. Folks paralyzed and now in wheelchairs are NOT from combat injuries…they’re from GSWs and car collisions. Your comment is bizarrely immature!

    Some of my favorite KZread videos are of drunk cops and officials trying to whine their way out of a drunk driving ticket while being treated like a favored relative, and the cop says they can't because of the cameras.

    One of the best ones I saw featured a perpetrator who knew one of the cops conducting the DUI investigation and kept alluding to how it was during the "old days" while begging to be let off the hook. The other cop started sweating bullets and told him to watch what he was saying because-you guessed it-cameras.

    Thank you. I got a drunk driving ticket while on a friends property which is illegal in Wisconsin however the DUV said they over ride the court and ordered me to go to counseling every day until they said it would end...I listened to my counselor and started going to AA and have been sober for years...which was the best gift ever...my life is so much better...But in the beginning I was so mad and believed they should not have been able to tell me how to live. My whole family is happy for the change in my lifestyle too. Love to all.

I'm not an attorney, so check with one, but my concern with refusing to answer at all would be in provoking the officer to anger, because he might see you as playing games with him.

    I had a crazy experience many years ago when I was about 21 years old. I was driving my brother's souped up sports car and had a lot to drink. I squealed around a corner and there right in front of me was a cop with his hand up to stop me. I had my friend with me and we pretty much knew I was busted. The cop came up to my window said "have you been drinking?" I was so drunk I wasn't even going to try to hide it. I can't remember exactly what I said but the cop looked to his left, then to his right and then waved me on.....My friend went insane saying "if that was me I would be in jail!" I went on to a few professional driving jobs later in my life. Driving city bus for 5 years for example. That would have never been possible if that cop arrested me that night. Divine intervention?

    I got pulled over once and was asked if I had been drinking. To that I said yes. The PO then started giving me a sobriety test which I passed everything. He then asked how long ago was my last drink. I told him right before you pulled me over. He looked in my car and couldn't find anything then he said what did you do with it. I pointed to the Coke bottle in the cup holder. He was pissed that I wasted his time. I then told him he wasted my time too and my time is just as valuble as his. I told him I didn't lie to him and that he needed to be more specific with his questions.

    @@MOAB-UT Well I was 18 at the time I'm 50 now and he was just looking for a reason to throw anyone in jail. I lived in a small town and this particular PO had a reputation as an asshole and a lot of the tickets he wrote were bogus The reason he pulled me over was improper backing, what does that even mean. If he had anything more important to do I wasn't stopping him. He was the one dragging it out trying to nail someone. SO in reference to your childish remark I say Yes, Yes he was. He should not have had the attitude he had when he pulled me over. I didn't do anything wrong and even answered his questions yes sir and no sir. BTW he ended up writing me the ticket for improper backing after not finding anything alcohol related. I went to court about it and the Judge asked him How did I improperly back he told the judge that I Backed out into the road from a local roadside store. The judge asked him if there was any traffic coming or did I hit anyone causing an accident he said no but I backed out fast and put my car in forward motion too fast. He asked if I spun My tires he said no. The judge never asked my side of the story but he told the PO that he was getting tired of his baseless tickets and reamed him pretty good. he wasn't there much longer. In short thank you for your opinion, but opinions are like assholes every body has one and most of them stink!

    I did the u-turn at the check point, only I didn't realize it was a check point because of the bend in the road, I just thought it was like an accident or something ahead. But anyway yeah other cops came out of the woodwork from side streets and where ever like roaches when the lights turn on.... and they told me avoiding a check point is the same crime as DUI, which I dunno if that is true, but I was saved (after having cuffs put on me and being placed in the back of the cop car), by the luck that a wanted fugitive bailed from his vehicle at the check point and a foot chase started and so the cops let me go to focus on that guy and gave me a verbal warning.

    if you can avoid the checkpoint without doing an illegal maneuver, you can avoid the checkpoint. They would need another justification to pull you over.

    The cops outright lied to you, as they usually do. We have no obligation to go thru the checkpoint, and if we do, we have no obligation to answer a single question. While the courts may have ruled checkpoints legal, they have not ruled that the Constitution is suspended where one is set up. You are under no obligation to roll down your window, either. A cop who demands you roll down ANY of your windows is looking to create a plausible reason to say he "smelled alcohol\weed". He is also lying if he says the law says you have to roll it down. Since you are under no obligation to speak to a cop, EVER, you only need to hear what he has to say. So only roll down your window a crack so you can hear his lies. And record the entire thing with your smart phone.

    From my personal experience (2 DUI’s) if they want to administer a breathalyzer or blood test & you KNOW that you were caught red handed. I highly suggest you refuse, why may you ask? Because the court will not know your BAC levels & therefore will give you a much lighter sentence. In my case, the first DUI I had two tall cans of king cobra in the middle of the center console. I knew I was caught so I refused the breathalyzer & blood test. My license got suspended for a year & I was ordered to do a 3 month DUI program. As opposed to my 2nd DUI, I did the breathalyzer test received a .28, & got an 18 month DUI program with a 3 year suspension, 5 year court probation & 25 days jail time & one year of having a breathalyzer on my vehicle, also 3 years with a SR-22 insurance requirement. Total cost of both DUI'S? A little over $10,000 which consisted of court fines, restitution, insurance requirements, vehicle breathalyzer, & an 18 month DUI program. I'm a firm believer that everything happens for a reason & due to that last DUI I became sober. Will be hitting the 5 year mark in February. If you are struggling with an addiction & think you can’t overcome this, think again. You are stronger than you think. Just for reference I obtained my first DUI in 2014 & the second one in 2018. Both in California.

    Refusal is an additional charge and you while have your license suspended for 1 year instead of 6 months for doing the test. Also you will be required to have an interlock device on your car if you refuse.

I was an active alcoholic for 17 years and I had to hit rock bottom and go to a treatment center to learn how to stop and stay stopped and how to live a sober life - something I didn't know how to do. But here's a hint, you might be an alcoholic if you ever consciously decide to drive while drunk. You might have a problem if after drinking you decide that getting behind the wheel is a good idea. In that case I implore you, please, PLEASE, get help and quit drinking completely. You'll thank God that you did, trust me.

    Back in 3/1995 I was pulled over by a CHP for not wearing my seatbelt (The button was broken in the closed Position (due to some spilled Coke that didn’t get cleaned up). At the time I had a three month old son who cried 12 hours a day nonstop I was exhausted and had a mild case of postpartum .When I left home that day I put my purse in the trunk. He pulled me over and of course demanded my license and registration. Told him I had to get out of the car to get my license from my purse which was in the trunk. To him I appeared frazzled and he asked me the question “how much of you had to drink today”? I looked at him and said “just as much as you have had officer”… He didn’t say another word.

    I got in an argument with an officer that pulled me over for not wearing my belt. I was however wearing it but It was covered by my big coat. I brought up the point to him; "why do I need to wear a seat belt when I'm only one in the car and could care less about my so called safety. He said "it's the law" It's a stupid law. ( when alone in the vehicle) I'll decide if "I'm safe" wearing it while alone in the truck.

    I had to go through a dui checkpoint one time. Came over a bridge and there they were didn't have much time to think. Answered all there questions, no problems. Good thing they didn't see the joint behind my ear. Did you guys hear about that dyslexic state trooper? He was handing out IUDs.

    I was stopped by the police once, they asked me the same question, I said no, they asked me to step out of the car and had an alcohol test. They found nothing and let me drive away. So no doesn't automatically mean they won't make you go through a test.

    He’s 100% right. At a recent DUI stop in TN, they stopped 2057 cars and got 2 DUIs, 16 bad or no license. The answer is always ZERO to drink. Unless you wanna have fun with them.

    If the lawyer is going to be in court defending you, he would strongly prefer that you'd answer "NO, I have not been drinking". Answering "YES, I HAVE been drinking" will make his job much harder and will make your case much weaker.

    Lucky me I will never be caught driving under influence since I hate the feeling of being drunk. One beer or sangria is enough for me for the day, or week, or month lmao. And only do it if I'm in a lotta pain at home so I can't be pressured to drink more. Yea mom and dad think I'm lame cos I didn't wanna go to a bar on my 21st bday.

    Something I learned in the insurance trade, get a card from a lawyer and carry it with your license. Any cop asks for your ID you have then the lawyers card too. It's no guarantee, but it helps.

    The law is they can't pull you over for turning around or avoiding the checkpoint...now the question becomes in the time it takes you to get home or where ever else you are going do you think you will not break any traffic laws...good luck??

    That’s a good point. It should not be against the law to try to avoid a checkbook as long as you do so legally and adhere to the traffic laws. And them coming after you merely based upon their suspicion that you may be trying to avoid them should not be a basis for pulling you over either as long as you made a legal turn.

    Correct me if I am mistaken, but I believe there was a Supreme Court ruling that upheld that it's legal to avoid a so-called "DUI checkpoint" by (a) U-turning so long as doing a U-turn is not illegal, and/or (b) turning into a sidestreet or taking an exit before the checkpoint if one is available.

    Avoiding a DUI check point is only leagal if you are a off duty Cop Or Fireman. Every one else gets the "Royal treatment" at check points. Best way to keep out of trouble is to stay home, drink at home if you need to.

    in my 20"s, i was rear-ended by a drunk driver @ 50 mph while i was waiting for a stoplight to go green. the sob totaled my brand new car, almost killed me, and drove off. the responding cop asked if i had been drinking, because he could smell alcohol. i told him a had one drink about 6 hrs earlier, but i bought a 1/2 gallon of rum that was in my trunk that got the hell smashed out of it, along with my camera gear. he looked, assessed, and said ok, gave me a ride back to my house. there are reasonable cops out there, but i agree with this advice. usually, just keep your mouth shut.

    six hours seems sufficient time to had truthfully said "no". but that makes me think. how much time must pass before you can honestly respond "no"? twenty four hours? i am not challenging you, but i've watched some FSTs being performed and not really sure what the trigger point is that fails the driver. i possess a commercial driver license. not only do i get random drug tests, i have to submit to random breath tests as well. the test results must show all zeros or i am not allowed to leave the test facility. ronically, i want to say up until the mid 80's it was legal (at the age of 18) to drink beer while driving your vehicle in texas. sorry to hear about your situation and car. just glad you're still here to talk about it. safe travels.

The average male weighing 200lbs will metabolize alcohol at the rate of approx. 3/4 of one standard drink (standard 12 oz beer, 5 oz glass of wine or 2 oz of hard liquor) per hour. Example,,, drink 3, 12 oz Budweiser's and take 4 hours to achieve zero blood alcohol content. Commercial operators are allowed zero alcohol content so not drinking heavily the day before you drive would be a good idea.

    @@garywalters3007 40 years later, my neck is still f/u, but thank you and you're right. with law enforcement, honesty is not always the best policy. i should not have even mentioned the drink 6 hrs earlier. the wrong a-hole could have made the situation go bad. my aunt ran a trucking company in the 70's and 80's. as i remember, she never had an issue with booze, it was guys on uppers, so they could pack the miles in. i guess nowadays, with regulations and restrictions, it's tough to make the kinda money you used to? (edit) oh, and about fst... pass/fail is 100% up to the cop. AND, you have no legal compulsion to participate, although there will probably be ramifications.

However since they are always done late at night and are clearly marked, pulling a U-turn after you're already in line is enough for the courts to whip out "suspicion" and "totality of the evidence" and call it a legal stop if you are pulled over afterwards.

    Yep happened to me. Learned the hard way. I literally had 2 drinks and thought honesty was the best option. They didn't do breathalyzer tests on site so I gotten taken to jail. Blew a 0.031 and 0.031 ... Yes . 03 not .3 State dropped the case but I still had to hire and attorney and appear in court multiple times.

    I was 18 and unaware of my rights. Cop pulled me over and said he smelled alcohol. Did a FST and failed. Cops arrested me and took me to the station. Blew zero on the breathalyzer. I hadn't been drinking or doing drugs on that night. Was released a few hours later with no charges. This was a time before body cams but as you said, FST are designed to make you fail. If you're nervous, you're bound to slip up. Cops will interpret that as you're impaired. Always refuse.

    That's what you SHOULD do. Where I'm from, that will probably get you jerked out of your car, roughly, WITHOUT your phone, and handcuffed, at least. You do that kind of thing if you can afford it and if there is someone who will bail you out of jail. I'm not advocating to roll over and take it, I don't. But one must pragmatically adjust to the existing conditions.

    I went to court and won my DUI case because because of "two" breath tests not knowing there were "two" tests The civil one and then the Criminal one when I refused the first one the cop said you'll lose your licenses for a year and go to jail so I said in that case I'll take it he said it's too late you've already broken the law so refusing the second test thinking I was going to jail which I did The jury just had one question that the judge refused to answer which was had I taken the second test and pasted would've I still gone to jail ? The jury came back after two minutes and said not guilty .

    sounds like bullshit and even if you did beat it the DMV wont give a fuck and make you do the program anyways to get your DL back, even if the DUI is 15 years old. I seen guys do 15 years in prison and get out and do a DUI program to drive again even though the courts dismissed it. I seen a lot of shit working at a DUI school... Never seen what you claimed happened. You dont get a jury trial for a DUI anyways unless you killed someone.

    The proper answer is "I don't answer questions without an attorney present". Answering any question surrenders your rights and gives the officer a method by which they can trick you into an answer that they can act on. Check how state laws apply.

    I remember I did a burnout in a busy city intersection after many shots. He said "who the hell taught you how to drive?" I said "honestly sir, i just wanted to see if the car could do it". He said "and youve had too many drinks tonight i can tell" I said "ive had a few". He had me park the car and call a ride. No ticket. Not ACAB.

    Illinois v lidster 2004. DWI checkpoints are lawful, any evidence seen in plain view during those stops may be seized and is admissible in court. Checkpoints are also lawful for information gathering purposes near a crime scene.

    I agree never admit to it .several years ago a states top attorney got pulled over she refused all test on the spot and eventually had her case dismissed .that kind told me that if a professional thinks taking the test it must be a good idea.

    Good advice, but I would suggest a slight modification. 1. You start correct, specifying you won't answer questions - if you just take the 5th in general, any follow up comment can be considered you waiving your right. 2. Pause, and if the officer asks a follow up question, immediately accuse him of violating your Miranda rights, and state that IF the detention continues, you wish to talk to his supervisor, and will file a complaint for violation of your Miranda rights. They ask a stupid question because if you answer it, you are considered to have waived your right until you declare it again (exception being identification). 3. Also declare you wish to have a lawyer present during questioning, and 4. you cannot afford a lawyer and will need 1 provided to you. You don't have to have a lawyer present on the roadside or be willing to talk to them over the phone, the officer isn't going to schedule a time in the police department building and make arrangements to provide a lawyer for a minor stop and fishing expedition. If 2 applies, you can also look for opportunities to accuse the officers of harassment - intimidation - retaliation for exercising your rights. Acts tht would otherwise be legal become illegal if performed as an act of harassment - intimidation - retaliation.

Look at the absurd logic of your proposal. You simultaneously suggest exercising the right to _remain silent_ and suggest _all this extra commentary._ None of that commentary is needed. Just express your intent to remain silent and then commit to that. Any extra commentary will not help you. Literally. What you say _cannot_ help you, as in anything you said to the cop that might have been helpful for you will not be allowed in court if the prosecution has passed the bar more than a day ago. Your words will only be used _against_ you. You're ranting and raving about harassment and violating Miranda rights _only_ helps build a case against you. It does not secure your freedom. If you don't know that, then you are in no place to give advice about how to handle police interactions.

    Because my job involved driving I didn't d&d. I was drawn into a check point in Cali years ago. The officer asked if I'd been drinking. I told him "no...I'm gonna". He chuckled, asked me not to drink 'till I got home and sent me on my way.

    In my country, (New Zealand), they always ask, I always answer "no," but never has it changed the result. If pulled over to be breath tested a simple "no I haven't been drinking," never changes the outcome. A yes gets you the same result.

    I am always drinking water. When they asked if i had been drinking, i responded with , 16 oz in the last hour. They were stupefied when their meter showed 0 alcohol. Then they saw the water bottle in the cupholder...

    I was pulled over leaving a bar after work. He asked me if I had been drinking. I said I had one 12 oz bud light over the course of an 80 minute Keno game. He had "invented" 3 citations he could ticket me for. Instead he said, thank you for being honest, have a nice night. Another time, I told cop, I know how to calculate my bac. I told him I was at a .06. he gave me breathalyzer, I blew a .06, and he sent me on my way. Sometimes honesty works.
