The concept is from Byrne v. Boadle in 1863. It wasn't a refrigerator, it was a barrel of flour from the second floor of a shop. In law school, we took "res (pronounced race) ipsa loquiter" to mean "If a barrel falls on your head, it's the other guy's fault."

On the white board (0m16s) we are told that we may presume that the defendant must have been careless. In the cartoon (2m32s) we are told that we may presume that the defendant had been careless. The word "must" is used in the first description of what may be presumed, but not in the second. Only the second seems to me to describe a rebuttable presumption. Clarification would be appreciated.

On the question of physician-assisted suicide, could rest ipsa loquitur be used as an argument for why someone should be allowed the assistance? it seems to me quite reasonable that if someone asks for physician-assisted suicide, that the act itself rises above self preservation enough so that it should be honored automatically.

Les Ipso Loquitor shall be appropriate in mediation matters in the medical profession .Doctors would face negligence for treating a patient and charging for an ailment that never prevailed converting hospitals into profit making bodies. The noble profession has finally bedn included under the Consumer Act. Medical profession has been covered under tge Consumer Protection Act but does not cover government hospitals or government employees treated in private hospitals claiming from govt. So, patients are referred to pathologists and hospitals by govt. doctors. this was to introduced to make the service available convenient besides land lease agreement of hospital bldg etc. The question is how can you differentiate a patient as consumer and ine who is not a consumer merely on the basis of receiving payment. The next question that arises is the patient fies not pay for himself many times when on bed. Its from his account, his guardian who pays for him. How can a civil servant who has entered into a service contract includes medical benefits not be a consumer. The govt. may provide private or public facility is its policy. The doctors are paid from revenue . How do insurance companies deal with it?
