What happens if your employer does not respond to the EEOC in 30 days? What if they never respond?

    States online that if the Respondent continues to refuse to cooperate then EEOC will seek jail time for the owner of the company. At least that's what it states on Google for the EEOC.

    Hi, I submitted my complaint to Louisiana Human Rights. After, I declined three different settlement offers which were, $1000, $2500, $5,000 I was assigned a investigator, I was told recently that the company has not responded to the last document that they requested and they sent a final saying they will have to determine their decision without that information. I was also informed that the company had gotten another attorney for the case and that attorney left the case. What does all this mean?

    @@aquiliaringwood6532Actually it is slightly true. Employer non response doesn’t mean guilt but any lawyer worth their salt will argue further retaliation which COULD be just enough to win the case. At least significantly increase their chances.

    Greetings, Vince. Thank you for your invaluable wealth of knowledge and wisdom. My former employer asked for an extension and the EEOC granted it. What does this usually imply? Also do you know how long the EEOC extensions typically are for Respondents Position Statements? My EEOC investigator would not tell me how long. Thank you.

    Hi vince eeoc investigator supervisor stated the commission in texas is waiting for a position statement from the employer by 2 19 2024 before an investigator is assigned to the investigation . The mediator told me my case was assigned to the eeoc investigator supervisor. above. What is going on ?

    I am a federal employee at the hearing stage. The AJ ordered settlement before the initial conference. We sent the agency a demand letter but they did not agree. After the IC, the AJ ordered us to give him a settlement status update after the conclusion of discovery. In the case management order, he was quite stern, writing that we need to be flexible and asserting we will settle in the future. Is this generally a good sign the AJ will rule in my favor at hearing, if not settled?

    My question: I am currently receiving unemployment benefits after voluntarily resigning due to personal reasons. I am now in the process of filing an EEOC claim citing retaliation. Will my approved unemployment claim help me?

    The company is refusing to pay my unemployment they are lying about my termination date for one I was also let go while admitted into the hospital should i hire a lawyer??

    I think this happened to me I don’t even recall filing though I filed with human rights division is it possible for you to get dismissed due to me not submitting a rebuttal and then eeoc gives me a notice even though I never filed? With them is this normal

    Hey Vince. I received a right to sue notice from the EEOC but they labeled it untimely. Do you think it's worth filing in federal court and will a good attorney take the case. Should I move on with my time or pursue fighting in federal court. Are there any chances of getting pass the EEOC untimely determination in court

    1. Check with local counsel to see if the EEOC is correct about your claims being untimely. 2. If your Federal claims are untimely, speak with local counsel about State or local claims that may have longer statutes of limitations.

    Depends on the jurisdiction, agency, Court, investigator or even the Judge, arbitrator or Administrative Law Judge who is making those decisions.

    Your employers position statement? It should be available but they also mail you a copy generally.

    I've been waiting over five months for a position statement from my former employer and I've yet to receive it the EECO serve them with my complaint again which was sent out as email which I received my lawyer and my former employer and they still have yet to responded what should be me next steps????????

    I was told by a supervisor EEOC investigator the employer has to submit their position statement before my case is assigned an investigator to investigation my case. Did you go through this as well ?
