What Happened at my PIP Tribunal?

My PIP tribunal finally came around so I wanted to show a little bit of what happened on the day, the outcome and a little bit about the process

    I won my Tribunal a few weeks ago. I'm Autistic too. They owe me 20 months of back payments. I just hope they honour their commitment.

    First time I got it easy. Second I had to go through a Mandatory Reconsideration. Third time, I am going to tribunal. My local MP and her team got me in touch with a group called Spitfire and the staff I have spoken to so far have been amazing. Finally got some more work done towards my case yesterday, my computer decided to give me aggro, I think it's called challenging behaviour! I have Autism, Brain injury which is very severe, and Dyspraxia. The assessor, a Paramedic produced a report that was full of errors and lies, and she clearly has no knowledge, experience or understanding of these disabilities! So far I am owed over £1.5k in disability benefit. Not heard from my advisor yet, he has been on annual leave so has a tonne of things to catch up with! Hopefully speak to him today or tomorrow. The decision maker clearly didn't even bother to look at the evidence provided.

    All I can say is that based on my experience with the DWP, you were extremely lucky to receive anything. My son has BOTH autism and Deficits in: Attention; Motor Co-ordination; and Perception with Pragmatic Disorder. He was in receipt of DLA and we were invited to apply for PIP when he turned 16. Despite a carefully crafted application plus a 'phone interview with me, it was denied. My son meets pretty much every single one of the descriptors on the daily living form, to what sounds like a higher degree than yourself. Not only does he have to be prompted to eat and drink, but he is unable to prepare his own food because of problems with proprioceptive disorder, anything that involves ANYTHING fiddly is a challenge for him, he doesn't just require reminding to engage in self care, but his bath has to be run for him, his hair and his back have to be washed by me, he has to be shaved by me. He absolutely would not be able to handle public transport alone, he can not even manage to cross roads alone. Etc, etc. Despite all of this and more, he was awarded: NOTHING. Their reasoning: he had got a good clutch of GCSEs, so therefore he can not possibly be this disabled. Sent in a mandatory reconsideration together with a private report done some years ago, highlighting where the official tests matched up to the symptoms that I was describing and bingo, he was paid daily living around costs at the highest rate and the getting around component at the lower rate. They already had this paperwork, so it seems clear to me that they refuse people in the hope that they will not know about asking for a mandatory reconsideration or that they will be too busy and stressed out looking after a disabled to want to bother to go through any extra hassle.

    I completely agree that they more than likely give 0 points to more people that have hidden disabilities because it is harder for us to fight their decision. It's the reason I wanted to cover this topic and show my experience because fighting is worth it in the long run, especially if not doing it alone. I'm sorry you had to go through that experience but I am glad you got a good outcome. Most people I have spoken to who were given 0 points at the start ended up winning their tribunal, the only ones that didn't were the ones who didn't have the strength to fight it

    @@oneawesomeautistic6342 I remember seeing that one year they spent more money on fighting claimants in tribunal then they did on the actual benefit itself. Given that less than 0.5% of claims are actually fraudulent, they are actually making disabled people's lives much harder then they already are. During the time that our case was under mandatory consideration, we were only in receipt of about £44 per week income support for me and £20 per week child benefit for my son for 10 weeks. We were principally living off what few savings that I had and if the PIP had not come through then my son would have had to give up his A levels. As it stands His A levels are showing up the deep rooted nature of his problems. He is doing brilliantly at his computer science and while he understands his maths and biology, he struggles to apply it to the questions.

    @@banana9106 It is ridiculous that they even bother to try and stonewall people when it just creates more work for them plus the amount it costs them. Most people that go to tribunal will win something, especially with professional representation

    @@oneawesomeautistic6342 I am guessing that is why they frequently don't send anyone to represent themselves to tribunal, but do it over the phone. If people have ANY paperwork that proves a disability that interferes with day to day living, then the chances are they are going to be successful. The reality is that despite all of the 'no disability discrimination' and 'reasonable adjustment' rules, workplaces are in the main businesses and not charities and as a result they have a certain perception of their ideal candidate and that generally does not involve making allowances for people with disabilities or their carers. It seems bad that the DWP have such rose tinted glasses that they think that just having disability discrimination legislation, means that disability discrimination does not exist. Friends of mine have an adult daughter, who was diagnosed with autism at the age of 15. They run several tech businesses and as such they are somewhat wealthy and they are open minded about employing and helping disabled people. They have run a FREE cybertech course for neurodivergent individuals in the past, but the new Universal Credit conditionality rules and the number of times that they have kept calling the UC individuals in for interview has made it difficult for them to run the course. So here are people that are actively trying to give neurodivergent individuals a skill set, where in the main they succeed and are employable and the system itself is frustrating their attempts with its draconian conditionality rules. The whole system is not only betraying the people that are forced to use it, but it is completely self defeating in these sorts of instances.

    @@banana9106 Yeah you've got to be lucky to get someone at the job centre who works things in your favour. I am one of the lucky ones in that sense. They helped me find a job when they deemed me to have limited capability of working but the job nearly broke me and they've not asked me to even look for a job since. They're helping me get into self employment and, at the same time, helping me get assessed again for the higher rate capability meaning I will be classed as not able to work and I will get more money and not have to attend any job centre appointments or anything again

    That's better but tell them you cannot stay on phone as it's again a trap if you can answer phone for period of time then you can work in call centres ok .be careful of this trap .

    Thank you for sharing your experience, it helped me a lot. Today as in 31,October, I attended my PIP Tribunal which was pure torture because my health condition is Social Anxiety Disorder, so facing the Judge, Doctor and two other people, one by my side who was from the DWP, put me in panic, leaving me crying and shaking almost all of the time that seemed to have no end with one question after another. When the tribunal was over I was asked to wait in another room for a few minutes before being called back in and told I have won the appeal, which for both myself and my lovely wife who was my representative, left us both feeling a great relief with much emotion. Was explained that I would receive the standard rate for both Mobility and Daily living, back dated from March 2021 and would continue to receive until March 2024 before being assessed again. Still can’t believe I won, not just receiving what am entitled too, but also beating the DWP.

    Hi Colin just recently had my PiP tribunal after scoring 6 points on daily living which equals to no support, i had the cab involved on my case as it was a long process and i was assured i should have got more points, the tribunal went along with assessors report however i did qualify for the low level mobility component which i didnt get through the assessment, i felt i should have atleast got the minium points for the care component as my condition revolves around mental health, im fed up

    @@tahirmohammed2279 Hi Tahir, I’m so sorry to hear about how the Tribunal agreed with the assessors report, they can be as bad as the assessors as I found out on my very first Tribunal years ago. The low level mobility component isn’t enough for you to live on considering your condition. It’s seems to be harder to score points for mental health and believe they should have a separate questionnaire for this. When I failed a few years ago at my tribunal, I wrote not just to my local MP but also the Prime Minister, who I believe had some effect as a week or so later I got a letter from the DWP awarding me my payment, not sure how it worked out at the time but I remember I continued with my benefit. So maybe you could try doing the same as your in your right to do this and have a chance of things being overturned in your favour. I know how stressful this is for you as I have been through this over and over many times before wanting to give up on life, but with my wife’s support I was able to continue the fight to get what I was rightfully entitled too.     @@ColinRussianForce i got some advice from regarding pip discriptors for the cooking part they should have scored me 4 points as i dont use the cooker no more, i burn the fryer and fortunately for me i did have family members present, i also had a doctors medical evidence to back this up and still they denied it me, unfortunately the cab who delt with my case wont be able to help further so ive decided to leave it as it is my health is more important

    I have just gotten my Tribunal appeal decision, i was given 11 points for daily living and 18 points for mobility the Judge back dated it five years. I am glad that it is over for now.

    Thank you for sharing your experience. My son is due to turn 16 soon and has been in receipt of dla since the age of 4. He has HIGH functions asd & dyslexia. I’ve had the dreaded brown envelope advising us that they will soon invite him to claim PIP. I have to say that I’m absolutely worried sick about the process. I’ve been made his advocate as he’s unable to fill the form in himself etc and will struggle hugely answering the questions himself at a f2f assessment. Due to his age he is no longer under and specialist or support groups which seems to be normal these days. You’re pretty much given a diagnosis & left to it, once you hit high school age. He was given a great deal of support and help at primary school but once he started high school he pretty much fell through the net. He is SENCO registered at school but that means absolutely nothing with regards to extra help. Due to his school not really recognising his needs this means that now I have very little evidence to present along with his PIP application. The only evidence I have is a recent Ed psyc assessment report which reflects his cognitive processing difficulties & dyslexia. A two and a half hour Ed psyc assessment doesn’t really delve into his everyday living difficulties. I’m going to request his medical records to show confirmation of diagnosis and the support he got when he was little. Do you think my testimony of his struggles at home, the Ed psyc assessment report, & his medical records would be enough evidence ? With regards to your award - I’m pretty sure that once you get to about 6 months before your award ends you will be sent a pip review form which will have pretty much all the same questions as your original form. It will ask you if there’s any change in each section. You will also need to attend another f2f assessment more than likely. Please do keep us updated how you get on when your renewal time comes along. Any advice regards evidence and what kind of evidence is useful would be greatly appreciated. Thank you 🙏

    I was asked to get medical records to help my case and, I suppose, any evidence you can get is better than nothing. Having the medical records was good for me as there was a lot of proof of my struggles as I had had psychotherapy, been on various medications etc. I would probably advise contacting the National Autistic Society and Scope via their websites to see if anyone knows of any local support groups for your son. You could also contact the local council for an assessment for support in the house. If you're still waiting for the assessment you could still use that he is due one as evidence of needing extra support. I am lucky that my renewal isn't for a couple of years so it is something I can relax about for a little bit as well. I hope things go well for you with changing your sons claim over to PIP, please keep me updated. This is something my boyfriend will be going through soon as his son is 16 in January

    Be a descriptive as possible in regards to his difficulties with each activity. If he has an EHCP provide that as evidence. You want to make it so the HP who looks at the evidence against the PIP2 form feels that they can either complete the form without an assessment needing to be completed, or they are able to gather the needed evidence in a quick 10-15 phone call with yourself.     I'm due my pip review anytime soon and I'm terrified! The last 3 times I've been assessed they stopped it which is a huge stress as it takes ages to appeal the decision which leaves me with just my ESA to survive on so after my main bills are paid I'm left with aprox £141 per month for everything else! So aprox £35 per week but £22 goes to my cleaner! £13 per week for food, travel etc means I had to live on water and never go out because I have two cats that need to eat before me. It's so frustrating that even if you are given the Pip for 3 years you could still loose the payment on the yearly review! Thanks for sharing your experience xx

    i have arthritis in both knees and one ankle, i suffer with apnea and sleep with a cpap, i suffer pstd after i found my mum on the floor shortly before she passed away. i am 52 years old and have never been unemployed or claimed any benefits in my life. im getting hammered by the costs of taxis home (as im in agony by then) from work and the more expensive shoes and socks i need to support with my pain i suffer flashbacks of the image of my mum being lay there and i blame myself for not being there. i am constantly exhausted from lack of sleep and my life is an endless circle of work fighting fatigue and suffering panic attacks. i sleep on a mattress on the floor as the machine im on keeps my partner up at night. i scored 4 points and am now awaiting my appeal. Pip would change everything as i could reduce my working hours, get a camp bed and a safer way to cook, i can use the time i gain to exercise more and seek therapy i don't expect i will win however as the system isnt fair

    I would never let my partner sleep on a mattress on the floor knowing how much pain they were in. I would be on the mattress. That really upset me.

    I get DLA and I have been in receipt of pip for ten years, I am not going to list my illnesses, let’s just say they are life changing. My partner died last year and before he dies he told me to always take my brace of my knee and make sure that they can see my leg deformity, as soon as I did this there were literally no questions asked I am now on long term I suppose I get to my retirement. I will always wear the leg brace but I will take it off if I have to get a review. I must admit that a cleaner and home shopping wouldn’t be top of my list. I clean and shop myself and have full mobility payment. This is the difference between people, some people still try, my daughter also has invisible disabilities plus life limiting illness. This is why people are so put through hoops!

    Please anyone applying take note that Age Concern (if over 60) will help with the form. I had a lovely woman come to my house and fill in the form for me and then she posted it off. I had a good interview 3 weeks later and then 2 weeks after that i won standard everyday tasks and enhanced mobility. I am so lucky as it was really painless and Age Concern were brilliant.

    I was on DLA indefinite award for years. Had 4 points on my Pip decision. I was actually late with the appeal, but Dwp excepted it. I had help with my appeal with the law Centre so therefore had a representative. It took 12 months to get to appeal and I cried throughout. Things like this overwhelm me and also my Neck Arthritis was playing up, which effect my arm. The Judge, Doctor, and Disability lady were lovely. No DWP were present at my appeal. I was awarded Standard daily living and Standard mobility. All backdated £6000. I had a long award 3years. I got a letter last year saying that my award has been extended to 2023. Got my Review this July. One year early, but I know that's the norm. A Disability Rep filled in my Review Form as i was stressed out with the form. On my appeal letter. Judge stated that I have multi health issues and I am substantially limited. I have read stories where people have won on appeal, few years later done a review and have lost pip again. So have to appeal again. I think that is cruel. My conditions won't get better. My hearing impairment is for life, my Celiac disease is for life, underactive thyroid for life, Neck and back arthritis for life, diagnosed depression for life. I'm not even thinking about the outcome, because believe me if the outcome is not in my favour thank God I have a good advise service that can do the appeal again for me. Good vlog by the way.

    I find it disgusting that anything could go against someone in a review if their conditions are life-long. The review in those circumstances should just be one question - 'Has your conditions changed?' if the answer is no then the same points should be awarded, if the condition has worsened then more points should be added. The whole system is broken

    @@oneawesomeautistic6342 exactly. But I read somewhere that a lady won on appeal, had the award for 3 years, did a review and they took her pip away. She is now appealing a second time. How can the DWP, go against an appeal. I have my appeal letter. Judge told me to keep it safe. My tribunal went well, but I struggled for one year. Gluten Free food is expensive, and so is seeing a Chiropractor regularly. Struggling on just my Esa. Fantastic Vlog. Hope your doing well. ❤

    I have applied for this (PIP), I am badly covid vaccine injured and not able to work at all now - I have been put on LCWRA (Limited Capability for Work and Work-Related Activity) in addition to UC, and I've been advised to apply for PIP. I applied in September 2022. Am I expecting a long delay do you think? I understand its changed.

    Its 10 months since I first applied for pip. I'm at the last stage now. I got 0 points the first time and 2 points on the reconsideration. Now waiting on the tribunal. After a bone marrow transplant and many years of building my immune system, I finally got back to work. 1 year later covid happened and I've been in isolation since. Confined to a 1 bed flat and completely on my own. Too scared and anxious to socialise out of fear of catching covid. After everything I've been through I have never been as depressed and anxious as I am waiting on this tribunal. I really doubt I will get it and kinda just wish I never bothered.

    My tribunal was on 1 July 2022 and I won, after a rejection during my PIP review the previous May. I claimed PIP benefits already for some 5 years or so but they were stopped in May 2021. I got 0 points during the review in May, but managed get back my enhanced daily living and standard mobility. I think I got 12 points for the daily living and 10 points for the mobility part during the Tribunal. When you mention that your benefits will run till 2024 they will write to you about a year before the benefits are due for review so you will get another review letter in 2023 and you will be asked to fill in all the forms during that time and go through another assessment then. Thankfully I have been awarded PIP till 2025 but that means they will write to me one year before in 2024. I came across your video as I got a letter from PIP today when they said they need to look at my award again and make a new decision. The reason why is because one of my sons applied for carer's allowance for me and there he answered that I am getting widow's pension from Spain, so now they want to know the exact date and so I was trying to research whether getting widow's pension from EU would in any way affect PIP, but I could not got an answer to this question anywhere on the internet yet they make it look like my PIP will be affected by that which I do not believe is the case. But I suddenly started to suffer from the same anxiety as when my award was taken away from me in May last year , it feels a bit like being double stabbed. The widow's pension from Spain is deducted each month from my Universal Credit allowance - so surely it should not affect my PIP. My younger son was diagnosed with Asperger's Syndrome, but only in his early twenties. I never knew he had that, the only thing which was a bit out of the ordinary when he was young was that around the age of 18 months or so he suddenly stopped eating varied diet and would only eat plain foods. So I am still learning a lot what it all means for him and trying to understand what autism is about. He is also about to apply for PIP benefits, but he does not have any medical evidence apart from the diagnosis. He will often not share how he feels, that is why I never found out about his condition during his childhood. So not having much medical evidence I am not sure if he will be successful, still he is entitled so it is worth trying. When he applied it took DWP 6 weeks to respond, but he still did not get his questionnaire about how his disability is affecting him. Instead he was asked questions about his stay abroad, they wanted to know if he was getting any benefits while studying in Prague these last 3 years and he was not getting any benefits there . So somehow I think that his questions and mine are related regarding benefits from EU.

    I honestly don't know the answer to this one as I don't know if being out of the country for a long period of time or getting any money from another country affects PIP. I know that PIP is not means tested so shouldn't be affected by anything financial so I would definitely be asking questions about why they want to know about it. In your sons case medical evidence will, somewhat, help with the decision they make but not having any shouldn't matter. It might make it a little harder to fight for what he has a right to have.

    Hi, I am having tribunal in March this year. I am just wondering, when they asked you the questions are they going to ask you what is the evidence for whatever you’re saying or are they looking for it? I believe mine are linked in one of the forms from the mandatory reconsideration but I’m just scared I won’t be able to concentrate on everything as I get very anxious and I have different reports from different specialist that maybe repeat the same information about how my disability affects me

    Don't get your hopes up at the tribunal they are silent assasins that seem nice and supposedly impartial but they are in the pockets of DWP.

    It was lovely to win my very difficult and emotional tribunal back in late October. When I finally got the backdated PIiP in my account on the 28th of December that the DWP owed me, it was lovely and came at a great time to finish one year and start a new one financially better off which made Christmas and the new year for both my lovely wife Luciana. Receiving around £7800, made me have a little part for once. Also my wife and I applied for UC which we will get around £400 a month that will help towards the rent and bills, taking the strain of my wife needing to pay for all. Good luck to all who maybe facing a review or Tribunal to get what is rightly theirs. The best of luck to everybody this year, 2023.

    @@gplan4049 I wasn’t on any benefit since 2018 when I was receiving ESA, still having to pay back a few years of ESA as they said I wasn’t entitled too, it’s a long story, but they moved me from DLA to ESA when it should have been PIP. Anyway I won the tribunal in October and they awarded me the slandered rate, which am happy with after years without a penny. Also now getting UC that helps both myself and my lovely supportive wife.

    I won my Tribunal. I think I was very lucky to get a good judge, doctor and disability expert and they were on my side from the start. I was still very stressed and anxious but finally actual medical experts looked at my issues and put the DWP and (don't give) atos in their place.

    @@Mark..Birchenough You have to fight for your rights. It seems a lot of people are getting 0 points nowadays. I got 4 points. I have diagnosed depression and anxiety, but other health issues too. I cried throughout my appeal as I was reliving horrible times in my life. No DWP even attended my hearing. I got help with a local benefit advisory service. They did my appeal which was then forwarded to the Law Centre. These assessors are on commission I think, to turn down as many people as possible. To many people are getting 0 points, but then at appeal you miraculously get the points that you should have got in the first place. Bloody disgrace. My advice to you is any problems in future seek a benefit advocate who know the law. I have just sent back my Review Form. My advocate filled it in. Couldn't think straight with the questions as my anxiety worsens with things like that. And do you know what, if they deny me again it will be appeal number 2.

    They ABSOLUTELY 💯 must be ruthless it's the taxes of gard working people that are paying for this.l am sick to death of paying for people to sit around on benefits becuse they are adducts or alcoholics or have drug induced phycosis. Or they are depressed and anxious. You know who is depressed and anxious people who work hard pay taxes fir people that ABSOLUTELY don't deserve it!!@

    Congratulations on your win. I have my tribunal in the coming weeks as I only applied on the 6th March 2022, well my wife done all this for me online and I provided documentation to attach to the appeal request. I have not had any benefits since 2018, and have not applied for pip before as it was ESA I had claimed in the past until 2022 when I was told I was receiving benefit I wasn’t entitled for, and had to repay all back over the last few years, which my wife has to pay as am unable to work and receive nothing at all, also have to repay back rent overpayments. I had a tribunal years ago when on ESA, it was hell for me and worse when I had lost. Will keep you updated as and when news comes along with the date of the tribunal. Take care, god bless you.

    I hope everything goes well. I always recommend having someone with you that is an advocate for disability benefits. You can get someone to help for free through either Welfare Rights (department in some local councils) or Citizens Advice. It made the process a lot easier for me having someone advocate on my behalf that knows all the right jargon

    @@ColinRussianForce Your better off with a Disability advocate. Are there any in your area. My appeal was done by the Coventry independent advice Service, they deal with benefits, debt, homeless etc. When they did the appeal it then was forwarded to the Law Centre. My rep was with me throughout the Tribunal. Try and get help Colin. These people know the Law, no disrespect but your wife doesn't. Good luck.

Today as in 31,October, I attended my PIP Tribunal which was pure torture because my health condition is Social Anxiety Disorder, so facing the Judge, Doctor and two other people, one by my side who was from the DWP, put me in panic, leaving me crying and shaking almost all of the time that seemed to have no end with one question after another. When the tribunal was over I was asked to wait in another room for a few minutes before being called back in and told I have won the appeal, which for both myself and my lovely wife who was my representative, left us both feeling a great relief with much emotion. Was explained that I would receive the standard rate for both Mobility and Daily living, back dated from March 2021 and would continue to receive until March 2024 before being assessed again. Still can’t believe I won, not just receiving what am entitled too, but also beating the DWP.

    @@ColinRussianForce Brilliant Brilliant news Colin. I was the same. I have diagnosed depression and anxiety, just like you, but also physical health issues. I cried throughout my appeal, from the moment i sat down, to when i sat in the room afterwards. I won. I have standard daily living and Mobility. All back dated. This was in December 2019. One whole year i waited for my appeal. I'm just waiting on my Review outcome. I had my representative fill in the form. Having that extra money a month sure helps. I'm in the Esa support group. My Judge, Doctor, and Disability lady were lovely, couldn't wish for a better panel of people. They knew i was genuine, you don't cry for nothing, plus my arthritic neck and back were playing up that day and i was in discomfort. Hopefully now things will get easier for you as you will just get a review form in 2024, which is much easier to fill in then that Dreaded Pip claim form you fill in to apply for Pip. Estastic for you, and I really mean it. Happy Christmas when it comes to you and your Wife. Just pray for me Colin as I'm waiting for my Review outcome. Really really happy for you. ❤️👍

    I applied a few years ago, I got 0 points, and then they said they didn't recieve my letter for the mandatory reconsideration and I was struggling too much to try to apply again all on my own. A few months ago I applied again, I had the head of autism support in my county to help me with the phone assessment. It seemed like it went much better this time, I even explained masking to the assessor and told them that was why I would seem functional on the phone. Anyway none of these things helped, I got the decision back with 2 points. "You said you can't do this, but I decided you can" to everything with no evidence, you know how it is. In the assessment, the assessor seemed really friendly and nice. He asked me what I do in my spare time so I told him I play games. He asked me which game I was playing at the moment and at the time it was Elden Ring, so that's what I said. When I got the letter on the decision, I was shocked to find that the examiner had asked that not because he was a nice person, but so they had something to use against me. The decision maker wrote "you play difficult games" as one of the reasons why I was declined. She also used the fact that I'm bad at making budgeting decisions against me, despite me getting 0 points in that category, saying "you purchase takeaways and games" - like somehow that means that I'm not disabled, because I can waste all of my money every month... Anyway I went through the mandatory reconsideration on the phone, in which they ask you all of the questions again and get you to add more information. I didn't know what to expect and I was alone on that call, had no idea what to add as everything I originally said was seemingly intentionally misunderstood and used against me. I fully expect them to give me 2 points again, so I'm just trying to save all my energy for the tribunal. Thanks for your videos on this, they help with understanding what to expect and ways in which I can get help with it.

    I got the exact same replies 'you said you cant do this but we think you can', as though a phone assessment can really show everything. They had even said I showed no physical signs of anxiety, which would be a miracle if they could be seen over the phone. I would highly recommend contacting your local councils welfare department (if they have one) or citizens advice to get an advocate ahead of time as they can also fill out the forms for the tribunal for you

    Similar with me i applied nearly a year ago and first got 0 points. Made an appeal had a phone call assessment which lasted about 5 minutes then months later got a letter back which said I was rewarded 3 points. Made a mandatory reconsideration they didn't change there mind so now im going to court about it. I have doctor diagnoses, records that go back all the way to 2009 but none of that was looked at. They used me playing games and me having a phone as evidence against me but I sat there thinking well done lol I play games and have a phone this would be actual decent evidence if I was claiming to be disabled. My uncle on my dads side of the family has schizophrenia My mum has bipolar, and I've been diagnosed with symptoms which link to both. They claimed I didn't sound anxious or show any signs of mental health which doesn't make sense since the assessment was through a phone and not in person. I've had medical assessments before and they've looked at my records asked a few questions then I've passed them straight away.

    @@jakeking518 They did the same thing with me by saying that I didn't seem anxious but I don't understand how they can tell that over the phone. I provided copies of my medical records to the tribunal that covered 2 years to show how I was affected during that time. The DWP won't bother looking at your medical records unless you shove them in their face so providing copies at least a couple of months before a tribunal will, hopefully, help

    @@oneawesomeautistic6342 they also used the fact I have an xbox and phone as to why I got 0 points. They said because I went to college I was able to understand basic do most things. Yet I got kicked out due to attendance, and during school I wasn't in a class or set I was in a group of 6 people with similar problems to me And I got 0 gcses. They completely lied on paper to make me look bad Said things which was twisted and untrue Now im going to a tribunal in less than a month. Can't wait to show them records that go back all the way to 2009, and recentl doctor diagnoses and notes.

The only thing that annoyed me at my tribunal was they gave me less points on mobility because I moved as a single person over a year before I applied for PIP. which shouldn't have been taken into consideration. The more evidence you have on how things affect your life then the less they can say 'well we think you cant do it'

    Yes I help people get their pip awards. I am myself sick and was awarded pip 9 days after the assessment. All the people I help get awarded pip. You simply have to understand the system.

    My tribunal is on the 14th, So, I'm not religious, but pray for me. I've been on PIP and the previous benefits for nearly 20 years now. I saw n assessor though for ESA and she told me I should be in the higher rate of daily living in her opinion. However PIP disagree, they not only said no but tried to take my mobility car off me and send me a bill for over payment. After reading my PIP assessors report I understood why. It was a complete work of fiction, and I'm not alone in that feeling when it comes to these reports it seems. It's a very common way of describing the reports from our friends at (don't give)ATOS. There is a news report done a few days ago that has former assessors stating they are made to F people over. So please, if you do pray, say a little one for me.

My ESA assessor put down that I can wash the pots unaided when I don't even wash the pots at all, my boyfriend comes round to do them for me because of the extreme sensory issues I have with that activity

    @@oneawesomeautistic6342 I technically wash up, but I just put hot water and soap in the sink and let them sit, then rinse them. I use to bake and cook nice meals but I don't bake anymore and most meals are microwaved and made from prepared ingredients. It's not like I'm doing what people in reasonable health do, I'm just trying to get by and pushing myself.

    I went to atos for my pip assesment with my daughter, the have you on camera from getting through the door, to shorten this, the assessor was an ex NHS paramedic, the reports she produced was, wait for it zero points, I have severe degenerative bone disease, I have had a knee replacement, that hasn't work, I have no cartilage in any joint or spine, in constant pain,attend hospital pain management clinic, have an array of MRI reports and CT scans a wealth of documental proof all ignored. I won my tribunal ,did not attend as was in hospital due to a fall, I have lots of of falls and broken bones. My tribunal stated I won on my won on my wealth of documentation. So I tell everyone not do not give in to these criminals, fight your case but have proof to back up your condition and hospital reports are brilliant. I spoke online to an ex navy doctor who stupidly worked for atos a short time, his manager told him to change a cancer patients award points to a fail, he kicked off and told them no and walked out, sent the evidence with mine to disability right activist John pring, that went to the European court, the UK lost hands down. Teresa Coffey ex DWP minister sat for years on a DWP deaths and mistreatment report with damming evidence from many senior coroner's courts ,suicides, and starvation due to stopping benefits illegally,and more. The DWP has a white board in offices and call centres targets every week to cut off callers, misinform callers, Coffey was on the blower to DWP managers to make sure targets of intentional cruelty were kept up with. Many staff left because of this as they did not agree, but many stayed fearful of being jobless. That's why no one should ever vote Tory ever again.

    I hope it goes well for you. I only got 8 points on DL and 4 on mobility but I have stuck with it for now as I am hoping to up it on appeal as my health declined since the initial assessment

    did you know that you can do this tribunal by video and you can also ask your representative to attend on your behalf? As these are allowable reasonable adjustments, maybe you can combine both but if you do not ask you will not get, so i would do a video or ask someone to speak on my behalf, as it is a court process and people have lawyers and when people go to court and the lawyer talks to the court, so same idea get an advocate to talk on your behalf, remove nerves and stress in your life

    I had my tribunal on Monday over the phone, DWP wasn’t representative wasn’t at the hearing. Mine is going back almost 2 years & lasted 1 hour and 30 mins. Just the wait for the results is eating me away, but I’ve had a bad experience but still got worst outcome in my mind until I get the result

    I got my decision by email and I won was a relief but got standard for both. I didn’t put down another condition that I suffer from and they said to fill out another application. Would my current award be affected if I did do another application

The letter I received after my outcome said that if my health declined or improved I should tell them but I suppose it depends on how many points you have and if it is worth telling them. If you're only a couple of points away from getting a higher amount then I would say it is worth. It may also be worth it to make the reviews easier in the future

    It's weird isn't. They want you to claim, but don't give you what your entitled to. I was given 4 points. Was on DLA before that with an indefinite award.

    Pretty much the same kind of things that is asked during the first assessment. They asked about what I struggle with. A lot of it is a bit of a blur now because I was so nervous

    I want to ask if the tribunal made any recommendations to the DWP about when your award needs to be reviewed. I had my first claim awarded after MR. At the second review, a couple of years later, the case was due to go to Tribunal. I had a date for tribunal but DWP phoned the day before and said they would reinstate, and backdate, my award. I accepted although I had a choice to go to tribunal anyway. I wonder if there was something I missed about the powers of tribunal that might have helped. I'm partly paralysed from a spinal injury. There's no way my condition can improve, yet DWP continue to review and assess me every couple of years. This seems harrassing and unnecessary. I've just completed yet another review form. I've no idea if DWP will carry on messing me about. So, I wondered if you thought the tribunal was a better process to go through. It sounds much more transparent.

    The gamble you take with going to tribunal is that they could award you with less points and you could get less money. The best thing would be to get more professional advice. Check if your local council has a welfare rights department (you can do this by sending an email to their generic email address) or contact citizens advice. If you have something that is going to make your health worse over time then it is worth having the reviews to be able to get more points and more money, if you're already on the highest amount then the reviews are unnecessary so then it is worth finding out if you can get the reviews scrapped

    @@oneawesomeautistic6342 I'm on the high rate mobility and standard care. The important thing, for me, is to get this settled. So I can plan my life in a sensible way. The first time they stopped payments during the appeal, they told me that I had no right to use my blue badge any more. So I didn't leave the house for 6 months. They reinstated the money, but they can't put right the fact that my life was on hold while they made up their minds. It's the fact that they can do this every two years that angers me.     @@CC-hx5fz Do you have any support form Adult Social Services? If not, these might be a good place to turn to for a support worker as well. Even if it is someone to help for a few hours a week it is someone that then can put more supporting evidence on your behalf about daily struggles. I am sure that there is a long-term decision that they can make about your PIP so that you don't have to keep having reviews

    @@oneawesomeautistic6342 I've been helped by Adult Social Services with practical equipment like a bath lift. I live with my husband and adult children. I get lots of help day to day. For this review, I did complete the form a little differently. This is the first time that I persuaded my husband to write down everything that he does for me, every day as my main carer. I also included some parts of my medical records that the DWP won't have seen before. That includes the consultant's assessment of my level of disability before and after surgery, as well as follow up appointments and physio. When the neurologist did the surgery, he was quite clear that I was unlikely to recover my previous level of ability, and I didn't. It's only the DWP that seem surprised that you can't regenerate a new spinal cord. What worries me is that I'm not currently seeing any health professional as a regular patient. Why would I? I don't use pain killers. There isn't a cure. So, there's nothing I need to bother my GP about. That's my main concern. The DWP might assume that you must have fully recovered if you aren't always pestering your GP.

    They question everything as well so you feel a little bit like you're being grilled by the police or something. I imagine if there was someone who was autistic on the panel they would just get it and understand rather than the constant 'why?' all the time

    I'm not sure what would happen. I imagine they would have to base their decision just on the evidence they have. Is it a possibility to be 'present' via telephone? Do you have an advocate speaking on your behalf?

    @@oneawesomeautistic6342 went through a bad trauma found my uncle he took his own life i was homless got support they put me in a run down flat noisy couldnt cope had anxiety and depression then my grandmother passses away lost two stone in weight horrible experience im getting no answers from anybody got my tribunal on phone this week iv got evidence medical report and support worker my first apppeal was injorned needed medicial report i did have the all clear put eating and sleeping is terrible i weight 8 stone still going through trauma

    @@dewiroberts9119 I am sorry to hear you are going through a tough time. Having medical evidence does strengthen your case and having a support worker will, hopefully, help. I hope it all goes as well as possible
